WHEREAS, the undersigned own certain real property commonly known as 1330 Monterey, and
WHEREAS, th e und ersigned hav e reque ted and been granted a temporary exce ption by th e Public Works
Direc tor from the req uireme nt of in tailing certai n publi improvements o n said property conditioned upon exec uti on of
a covenant by th e properly ow ner agreeing to in s ta ll sai d improvements at such time in the futur e as the city may request
same, and
WHEREAS. the ow ner has requested that vehicle acces U1rou gh the palio co urt yard be maintained to th e
building int erior. The owner ha ' req ues ted the app ro val of fe ncin g a nd vehicle ga tes to contr I said access. The owner
has agreed to man age said co ntro ll ed acce so th at vehicle are not req uired to park or idl e within tJ1 e driveway

WHEREAS , th e und er igned as a co nditi o n of th e San Luis Obi s po Architectural Rev iew Commis i n approval
ARC-I 002-13 (Co nditi o n #18) i required to aba n lon th e driveway approaches per City E ng ineering tandards if, th e
regular vehicle acces into U1 e building i not utili zed or if aid acces is not managed to provide 0pen and unob ·tructed
vehicle movement through th e vehicle ga te and/or pedestrian passage i unreaso nably res u·ictect' becau e bf th ese
operati o ns.
NOW THEREFORE, in consideration of the granting of permission to temporarily defer installation of certain . ·
public improve ment s con islin g of:
Abandonment of the existing driveway approaches per City Engineering tandards. The-scope of work shall
include but is not limited to the removal of the existing driveway approaches, restoration of1Jie curb, ·gutte1·
sidewalk, and landscaping pe1· City tandards in effect at the time of the abandonment. · ·
The und ersigned own r (s of property hereinafter described hereby covenant with the City of an Luis Obispo to · install
all of sai d public improve me nts without cost to City upon 30 days written notice from the C ity of San Luis Obispo
requesting that said improvements be installed .
Said property is located in the City of San Luis Obi spo, County of San Luis Obispo , State of California, and is described
as follow ·:
1. Legal: Lot 5 and Portion of Lot 2, in Block 41 of the City of San Luis Obispo, in the City of
San Luis Obi po, County of San Luis Obispo, State of California, a hown on Page 168 of
Maps Book A, filed on May 1, 1878 in the C lerk Recorder office of said County.
2. Assessor's Parcel Numb er : 001-224-028 (Portion), 001-224-028 (remainder), 001-224-024
3. Commonly known as 1330 Monterey Street, San Luis Obispo, CA 93401
This covenant shall run with the land and shall be binding upon the undersigned owners, their heirs, executors,
administrators, and assigns .
