NOTICE OF REQUIREMENTS
TRACT 2428-1
The following items are required to be carried out by the owner(s) of the Remainder Lot
of Tract 2428-1 in the City of San Luis Obispo, County of San Luis Obispo, State of
California, according to map recorded in Book ' of Maps Pages I L to a
in the office of the County Recorder of said County.
1. Per Conditions of Approval of Council Resolution 10514 (2014 Series), the real
property referred to as future residential Lots 165 to 169, inclusive, as shown on
the amended tentative map for Tract 2428 shall be dedicated to the Housing
Authority of San Luis Obispo (HASLO) or another entity approved by the City of
San Luis Obispo to satisfy the affordable housing requirements that were deferred
from Phase 1. The dedication shall occur prior to or concurrent with recordation
of the next phase of the subdivision, and an affordable housing agreement shall be
recorded concurrently therewith. If any portion of Lots 165 to 169 is impacted by
adobe sanicle that cannot be relocated, then additional lots or reconfigured lots
will need to be dedicated to meet the affordable housing requirements for
Tract 2428.
2. With the exception of the designated affordable housing lots, per Conditions #66
and 67 of Council Resolution No. 10514 (2014 Series), all lots within Tract
No. 2428 shall be annexed to and subject to the Declaration of Conditions
Covenants and Restrictions of the Toscano Homeowner's Association, prior to the
close of escrow of lots. Any common areas serving said lots shall be annexed at
the same time as said lots.
Per Condition #1 of Council Resolution 10514 (2014 Series), subject to available
right-of-way, construction of a Class 1 bike path connecting the existing terminus
of Prado Road to Broad Street at the Damon -Garcia Sports Fields is required upon
subdivision or development of Remainder parcel, whichever occurs first, unless
deferred to a later phase by mutual consent of the owner and the City.
4. Depending on the outcome of the California Incidental Take Permit process with
the California Department of Fish and Wildlife, additional conditions or project
revisions may apply to future phases of Tract 2428.
Depending on the outcome of the California Incidental Take Permit process with
the California Department of Fish and Wildlife, construction or reconstruction of
the San Vincenzo Drive street improvements where it crosses the westerly
drainage channel near Calle Malva may be required to meet tentative map
requirements and City standards.

The following items are required to be carried out by the owner(s) of Lot 87 of said
Tract 2428-1 map:
1. No obstruction of the line of sight shall be allowed within the vertical clear zone
identified on Sheet 78 of the approved Tract 2428 improvement plans on file with
the City Engineer of the City of San Luis Obispo.
The requirements specified herein shall be binding on the parties hereto and their heirs,
successors and assigns.
This information is recorded simultaneously with the final or parcel map and is for informational purposes,
describing conditions as of the date of filing, and is not intended to affect record title interest pursuant to
Section 66434.2 (a) of the California Government Code (SUBDIVISION MAP ACT).
