COVENANT TO PAY FAIR SHARE MITIGATION FEES UPON REQUEST OF CITY
WHEREAS, the undersigned own certain real property commonly known as 1301 Calle Joaquin, and
WHEREAS, a traffic study conducted by Omni Means dated August 2014 found that the rezoning of parcels
053-152-001, 053-152-002, 053-152-003, 053-152-004 along Calle Joaquin would generate 1,038 pm peak hour trips
and result in a significant impact at the intersection of Calle Joaquin & Los Osos Valley Road (LOVR) when those
parcels developed, and
WHEREAS, that traffic study identified widening of the SB Cal le Joaquin approach and installation of a second
SB thru lane as mitigation, and
WHEREAS, a 115 room hotel has a 7% fair share percentage of the mitigation measure identified, and
WHEREAS, the undersigned have requested and been granted temporary deferral of mitigation implementation
upon execution of a covenant by the property owner agreeing to pay in full 7% of the cost to install a second southbound
left turn lane at Calle Joaquin and LOVR at such time in the future as the City may request same.
NOW THEREFORE, in consideration of the granting of permission to temporarily defer implementation of
mitigation consisting of: Constructing 2"' Southbound left turn lane at Calle Joaquin and Los Osos Valley Road
The undersigned owner(s) of property hereinafter described hereby covenant with the City of San Luis Obispo to pay 7%
of Engineering, Right of Way, Construction, and Inspection costs to the City upon 30 days written notice from the City
of San Luis Obispo requesting that fair share payment be made.
Said property is located in the City of San Luis Obispo, County of San Luis Obispo, State of California, and is described
as follows:
Legal: Parcel 3 of Parcel Map SLO 04-0615 in the City of San Luis Obispo, County of San Luis
Obispo, State of California, as shown on map recorded in Book 67 of Parcel Maps Pages 68 to 70
in the office of the County Recorder of said County.
