WHEREAS, the undersigned ("Owner") owns certain real property commonly
known as 3680 Broad Street, legally described as Parcel 4 of Parcel Map SLO-13-0003 in
the City of San Luis Obispo, County of San Luis Obispo, State of California, according to
map recorded in Book 77 of Parcel Maps Page 16 in the office of the County Recorder of
said County; and
WHEREAS, the City of San Luis Obispo approved a Use Permit (USE-0809-
2015) to develop apartment buildings on said Parcel 4; and
WHEREAS, said Use Permit included certain conditions required to be carried
out by Owner of said Parcel 4 at a later date.
NOW THEREFORE, in consideration of the above recitals and mutual covenants,
terms, conditions and restrictions contained herein, Owner hereby declares that Parcel 4
shall be held, transferred, encumbered, used, sold, conveyed, leased, and occupied subject
to this Notice of Requirements and Covenant to Install (and incorporating the above
iceitals herein by this re erence) `.Which sh., run with the land 1..nd shall be binding upon
Owner's heirs, successors in interest, legal representatives, administrators, grantees,
assigns, lessees, or any other occupiers and users of Parcel 4, or any portion of it, as
follows:
1. Per Condition # 16 of said Use Permit, the pork chop island driveway shall be
modified by Owner to restrict all left -turn movements when the planned median
along Broad Street is constructed or sooner if a left -turn collision pattern
develops.
2.. Owner covenants with the City of San Luis Obispo to perform said driveway
modifications without cost to City upon 60 days written notice from the City
requesting that said improvements be made.
3. Per Condition #17 of said Use Permit, Owner is put on notice that Broad Street
pedestrian crossings are provided currently at Industrial Way and in the filture at
Prado Road. No pedestrian crossing provisions will be provided on Broad Street
between Prado Road and Industrial Way.
4. Owner shall notify all residents about said pedestrian crossing locations and
restrictions.
