Notice to Correct Code Violation(s)/Notice of Violation

Dear Property Owner,
On March 28th, 2023, City of San Luis Obispo Community Development Department staff noted the
following violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed
address:
1. Permit Required (SLOMC 15.02.010, California Building Code 105.1)
“Any owner or owner’s authorized agent who intends to construct, enlarge, alter, repair,
move, demolish or change the occupancy of a building or structure, or to erect, install,
enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing
system, the installation of which is regulated by this code, or to cause any such work to be
performed, shall first make application to the building official and obtain the required
permit.”
Corrective Action: Permit or remove any unpermitted additions or alterations that were not
present on the last applicable building permit(s). The bedroom that is on the first floor of the
residence does not have an associated permit and will need to be either permitted or removed.
2. San Luis Obispo Municipal Code § 15.02.025, CA Residential Code § R314.3
Smoke Alarms, Location. Smoke alarms shall be installed in the following locations:
a. In each sleeping room.
b. Outside each separate sleeping area in the immediate vicinity of the bedrooms.
c. On each additional story of the dwelling, including basements and habitable attics and
not including crawl spaces and uninhabitable attics. In dwellings or dwelling units
with split levels and without an intervening door between the adjacent levels. a smoke
alarm installed on the upper level shall suffice for the adjacent lower level provided
that the lower level is less than one full story below the upper level.
d. Smoke alarms shall be installed not less than 3 feet (914 mm) horizontally from the
door or opening of a bathroom that contains a bathtub or shower unless this would
prevent placement of a smoke alarm required by Section R314.3.
Corrective Action: Ensure smoke alarms are properly installed and are operational in all of the
spaces mentioned above.
3. CA Health & Safety Code § 17926(a)
Housing, Regulation Of Buildings Used For Human Habitation, Rules And Regulations. An
owner of a dwelling unit intended for human occupancy shall install a carbon monoxide
device, approved and listed by the State Fire Marshal pursuant to Section 13263, in each
existing dwelling unit having a fossil fuel burning heater or appliance, fireplace, or an
attached garage, within the earliest applicable time period as follows:
4. For all existing single-family dwelling units intended for human occupancy on or
before July 1, 2011.
5. For all existing hotel and motel dwelling units intended for human occupancy on or
before January 1, 2017.
6. For all other existing dwelling units intended for human occupancy on or before
January 1, 2013.
Corrective Action: If gas burning appliance is present in the dwelling unit, carbon monoxide
detectors are required to be installed per the California Health and Safety code above.
4. CA Health and Safety Code § 17920.3
Housing - Regulation of Buildings Used for Human Habitation - Rules and Regulations. Any
building or portion thereof including any dwelling unit, guestroom or suite of rooms, or the
premises on which the same is located, in which there exists any of the following listed
conditions to an extent that endangers the life, limb, health, property, safety, or welfare of the
public or the occupants thereof shall be deemed and hereby is declared to be a substandard
building:
a) Inadequate sanitation shall include, but not be limited to, the following:
13) Visible mold growth, as determined by a health officer or a code enforcement
officer, as defined in Section 829.5 of the Penal Code, excluding the presence of
mold that is minor and found on surfaces that can accumulate moisture as part of
their properly functioning and intended use. (CA Health and Safety Code 17920.3.)
Corrective Action: Take steps to properly remove, clean and prevent all mold/mildew growth.
Before cleanup begins, it is recommended that sampling and testing is completed by a qualified
mold testing company to determine the potential health hazards of the observed growth. All
recommended remediation practices described by a qualified mold remediation company will be
required to be performed.
ALL REQUIRED WORK MUST BE COMPLETED WITHIN 90 DAYS OF PERMIT ISSUANCE.
We request that you voluntarily take action to correct the above noted violation(s) no later than
04/28/2023. These violations constitute a public nuisance and must be abated. Failure to correct the
violation(s) by the specified date will result in the issuance of an Administrative Citation requiring
payment of FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that
remain uncorrected after issuance of an Administrative Citation, the City may seek enforcement by other
civil or criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by
completing the enclosed Request for Director’s Review Form and submitting it to the Community
Development Department via email at code@slocity.org or to 919 Palm Street, San Luis Obispo, CA
93401, within five (5) days of the date of this Notice. This Notice shall be deemed final unless you
timely file a Request for Director’s Review
