Herndon@ksby. com RE: Public Records Act Request Dear Kathrene Herndon, I am responding to your Public Records Act request received by the San Luis Obispo Police Department via email on April 26,2023, in which you requested the following: " ...body camera footage from officers who responded to a crash in San Luis Obispo on Nov. 21, 2022 atong Sacramento Drive...also requesting any dash cam footage of the incident now that the San Luis Obispo Police Department has completed its sfage of the investigation." Pursuant to Government Code section 6254(f), "Records of complaints to, or investigations conducted by...any state or local agency...." are exempt from disclosure. See also Haynie v Superior Court (2001 ) 26 C. 4th 1063. Any body-cam or dash-cam video is considered part of the investigation conducted by our department, and is therefore exempt from disclosure. I have provided a copy of the public log and a Summary Sheet for this incident which contain all the information that must be released per GC 7923.600. I have also included the media releases related to this case. Additionally , in Wiltiams v. Superlor Ct. The driver was not suspected of alcohol impairment; a traffic collision report was completed, andthe carwas towed. On T\resday, November 22,2o.22, at 4.4o pm, SLOPD received a report of a deceased dog in the creek bed in the 34oo block of Sacramento Drive. OfEcers investigated the scene and attempted to contact the owners of the dog but were unsuccessful and began to make arrangements to have the dog brought to Animal Control. Several hours later at approximately 9:4S pm, SLOPD received a missing persons report regarding two San Luis Obispo residents who had not arrived at their expected location in Modesto. Family members provided photos of the residents and their dog. Offieers searched the resident's home and found it empty with no signs of foul play. Upon viewing the photo of the missing dog, a SLOPD dispatcher was able to make the connection between the earlier report of the deceased dog with the dog owned by the missing residents. Officers returned to the heavily wooded creek bed and after further search of the area discovered the deceased bodies of the missing residents underhearybrush. San Luis Obispo Police Departrnent Detectives are investigating the scene with assistance from the San Luis Obispo Coroner's Office, to determine if there is a connection between the traffic accident ontt/zt/zozz and the deceased victims. The cause of death is pending the coroner's report. This investigation is on-going.
