HomeMy WebLinkAboutItem 6f - FY 2023-24 Grant Applications for Alcoholic Beverage Control, Office of Traffic Safety and Police Reform Item 6f Department: Police Cost Center: 8001 For Agenda of: 5/16/2023 Placement: Consent Estimated Time: N/A FROM: Rick Scott, Police Chief Prepared By: Melissa Ellsworth, Senior Administrative Analyst SUBJECT: FY 2023-24 GRANT APPLICATIONS FOR THE ALCOHOLIC BEVERAGE CONTROL, OFFICE OF TRAFFIC SAFETY, AND POLICE REFORM AND RACIAL JUSTICE GRANT PROGRAM RECOMMENDATION 1. Authorize staff to submit grant applications to the following entities: a. FY 2023-24 Department of Alcoholic Beverage Control in an amount not to exceed $95,000. b. FY 2023-24 Office of Traffic Safety in the amount not to exceed $170,000. c. FY 2023-24 Police Reform and Racial Justice Grant Program not to exceed $75,000. 2. Adopt a Draft Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, Authorizing Grant Applications for Funding Provided Through the Department of Alcoholic Beverage Control to Increase Education and Enforcement Programs Focusing on Underage Drinking and Retail Alcohol Outlets” authorizing the City Manager to enter into a contract with the State as required by the Department of Alcoholic Beverage Control; and 3. If the grants are awarded, authorize the City Manager or his designee to execute grant related documents and authorize the Finance Director to make the necessary budget adjustments upon the award of the grant. POLICY CONTEXT The recommended actions are consistent with the City of San Luis Obispo’s Financial Management Manual, Section 740 - Grant Management Policy. The policy states that Council must approve all grant applications in excess of $5,000 and delegates receipt and contract execution to the City Manager. DISCUSSION Page 639 of 1165 Item 6f Background California Office of Traffic Safety Grant The California Office of Traffic Safety (OTS) provides grant funding to agencies each year aimed to prevent deaths and injuries on our roadways through special enforcement and public awareness efforts. Grant funding helps the City’s ongoing effort to improve traffic safety and quality of life in our community. The department has been awarded funding from the Office of Traffic Safety for well over twenty years. OTS grant funding has enabled the Police Department to conduct numerous operations specifically focused on alcohol or drug impaired drivers. For FY 2023-24, an application was submitted for grant funding in the amount of $167,424. If awarded, grant funds will be used for overtime costs associated with the following activities: DUI Checkpoints, DUI Saturation Patrols, Traffic Enforcement, Distracted Driving, and Pedestrian and Bicycle Enforcement. Due to the timing of the grant deadline, staff submitted the application prior to Council approval. If Council denies this request, the application will be withdrawn. Alcoholic Beverage Control Grant The purpose of the Alcoholic Beverage Control (ABC) grant is to enable agencies to expand efforts in addressing alcohol related problems through a comprehensive strategic approach. The grant allows local agencies to work directly with ABC to create proactive strategies to address alcohol related problems at the point of sale. These strategies include reducing (with the goal of eliminating) sales of alcohol to underage persons by utilizing enforcement tactics and providing educational programs to alcohol outlets to institutionalize responsible serving and selling practices. The grant application has been submitted because it was due on April 3 rd; if Council denies this request, the application will be withdrawn. Police Reform and Racial Justice Grant Program The U.S. Conference of Mayors teamed with Target to create a Police Reform and Racial Justice Grant Program aimed at identifying, supporting and promoting police policie s and practices in cities shown to be effective in advancing the goal of justice for all residents. The department submitted an application on April 18 th focused on supporting police services that reflect the values of protection and promotion of dignity for all in the community. The department is requesting grant funds to help fund crisis intervention training for more police officers in the department, training in juvenile mental health, and supplies (such as clothing and blankets) for the department’s Community Action Team (CAT) to distribute when needed. Funding may also be used to support family reunification expenses. With these additional resources, the City could increase the impact and effectiveness of CAT and the role it plays in pursuit of equitable treatment for all persons within the community. The City of San Luis Obispo’s CAT serves as an example throughout the Central Coast of California as a dignified and collaborative approach to addressing crime and recidivism among unhoused community members and those experiencing mental health crises. If Council denies this request, the application will be withdrawn. Page 640 of 1165 Item 6f Public Engagement This item is on the agenda for the May 16th, 2023, City Council meeting and will follow all required postings and notifications. The public may have an opportunity to comment on this item at or before the meeting. CONCURRENCE The Director of Finance concurs with staff’s recommendations. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended action in this report because the action does not constitute a “Project” under CEQA Guidelines Section 15378. These grants provide funding for specialized equipment purchases and overtime for targeted education and enforcement opportunities. Without grant funds the department would not be able to carry out these types of programs which increase safety in our community. ATTACHMENT A - Draft Resolution authorizing the City to submit a grant application for funding provided through the Department of Alcoholic Beverage Control Page 642 of 1165 R _____ RESOLUTION NO. _____ (2023 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, AUTHORIZING GRANT APPLICATIONS FOR FUNDING PROVIDED THROUGH THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL TO INCREASE EDUCATION AND ENFORCEMENT PROGRAMS FOCUSING ON UNDERAGE DRINKING AND RETAIL ALCOHOL OUTLETS AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED GRANT DOCUMENTS WHEREAS, the San Luis Obispo Police Department (the “Police Department”) through the City of San Luis Obispo desires to undertake programs to increase education and enforcement to focus on regulating retail alcohol outlets in the community; and WHEREAS, the Police Department submitted a grant through the Alcohol Policing Partnership (APP) administered by the Department of Alcoholic Beverage Control (ABC) in April 2023 to conduct education and compliance activities related to local businesses that hold alcohol licenses; and WHEREAS, the grant funding, if awarded, will be used to support the Police Department’s efforts to reduce the sales of alcoholic beverages to underaged persons by using overtime to conduct enforcement operations and educational programs; and WHEREAS, in June 2023, the Police Department will be notified of the ABC grant award in an amount not to exceed $95,000. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Chief of Police or his designee is hereby authorized to continue the pursuit of an Alcohol Policing Partnership grant administered by ABC, the application for which was submitted by the Police Department in April 2023. SECTION 2. The City Manager of the City of San Luis Obispo or his designee is authorized to execute all grant related documents, including the State of California Standard Agreement, any extensions or amendments thereof, and any subsequent contract with the State in relation to the APP grant administered by ABC. SECTION 3. The Finance Director is authorized to make the necessary budget adjustments upon the award of the grant. SECTION 4. The City agrees that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency and acknowledges that the State of California and ABC disclaim responsibility for any such liability. This award is not subject to local hiring freezes.
