Wayne Peterson, applicant's representative, stated he felt the city could comply with the conditions of approval as recommended by staff. He also stated that the existing building will remain until a permanent parking structure is constructed on the site. The public hearing was closed. Request to allow temporary outdoor sales of cut flowers; 692 Marsh Street; C-C zone; Nancy and Denise Gingg, applicants. (Continued from November 20, 1981 meeting) Dan Smith presented the staff report, recommending that the request be denied. He noted it was the consensus of the Community Development Department, Police Department and Public Services Department staff's that this property would not be suitable for temporary sales of cut flowers because of potential traffic con- flicts that it would cause on Broad and Marsh Streets. The public hearing was opened. Nancy Gingg, applicant, stated that she only wants to sell flowers two days per week, on Fridays and Saturdays. She said that flower sales would be on a very small scale, and she would cater mostly to impulse buying of cut flowers to pedestrians and not to those in cars or those that are interested in services available from a full florist, such as flower arrangements. Dan Smith noted testimony requesting denial of the request from the last hearing (November 20, 1981). Henriet Smith spoke against the request feeling that the sale of cut flowers at this location without permanent facilities would be unfair competition to florists in the area who provide their own on -site parking, restroom facilities and pay taxes. Steve Potratz stated he was opposed to vendors in general, which unfairly compete with downtown businesses. He felt the request should be denied. Doug Morris said he was in support of the request but was unfamiliar with procedures for regulating these types of uses and desired a copy of applicable city regulations. The public hearing was closed. Ken Bruce, Hearing Officer, stated that the city is in the process of preparing a street vendor ordinance and is working with the Business Improvement Association on a draft. Use Permit Appl. 119-81. Request to allow expansion of restaurant with entertain- ment at 675 Higuera Street and off -site parking at 668 Marsh Street; C-C zone; William S. Dohan, applicant. Dan Smith presented the staff report recommending approval subject to appropriate conditions which he outlined. The public hearing was opened. William Dohan, applicant, was present and explained the request. He said he has revised the project description slightly allowing a maximum of 75 seats. He said the restaurant will be open from 11 a.m. to 1:30 p.m. Entertainment would not start until 9:30 p.m. He noted there would be a maximum of 4 video arcade games in the restaurant. He said the outside patio would not be used, and the door leading to the patio would be used as a fire exit and for deliveries only. He said 200 square feet of floor area would be devoted to a dance floor. Steve Potratz, owner of adjacent book store, expressed concern with the rear patio area and back door, noting that other restaurants with entertainment in the area have not been good neighbors.' Patrick Gerety, owner of adjacent furniture store, stated he has no basic problems with the use as described by the applicant. He said there is a problem at the rear entry to the restaurant. He said the area behind the building is a private drive- way and there has been problems with people loitering in this area and some instances of vandalism of private and business vehicles parked there by adjacent uses. He felt the rear entry door should be used as a fire exit only. He also felt that the use permit should limit entertainment to after 9:30 p.m. so it does not conflict with retail sales in the area. He felt the use permit should contain a provision that if the use becomes a nuisance, the Zoning Hearing Officer may reconsider the use permit to add conditions or revoke the use permit. He did not feel there was any parking needed for bicycles. He said video games should be limited to four in number, as proposed by the applicant. He asked if the use permi, was approved, if it could be transferred to another person. William Dohan responded, indicating that the rear entry door could be posted "For Deliveries Only" and thereby patrons would not be inclined to use it. He noted the door was needed for deliveries. Ken Bruce, Hearing Officer asked what type of live entertainment would be provided in the restaurant. Mr. Dohan indicated that it would be rock music primarily and would occur Tuesday through Saturday only. He said it is a concrete block building and there should not be any problem with noise to adjacent uses. He stated that the use permit could be transferred to another person (it runs with the property), but the project description and conditions of approval would remain the same unless amended. The public hearing was closed. Ken Bruce approved Use Permit 119-81, subject to the following conditions: Administrative Hearing Minutes Meeting of November 20, 1981 Page 3 1. The use permit is for the sale of Christmas trees and related accessory items only. 2. No display of signs in public right-of-way; no living quarters or trailers to be used as such; and no loud speakers operated. Camper for overnight security may be parked on -site. 3. No fencing, signs, trees or other material shall be located within 10 feet of the street right-of-way. 4. Maximum sign area on -site shall not exceed 32 square feet. No bunting strips, banners, flags, whirlygigs, or other attention -getting devices shall be dis- played on -site. 5. Applicant shall post a refundable deposit of $150 with the city Finance Department to assure site clean-up, if necessary. Deposit shall be made prior to occupying the site. 6. 2A 1OBC rated fire extinguishers shall be provided within 75 feet of all points on -site. Any trees sold for use in public facilities shall be flame - proofed with a state Fire Marshal -approved material. 7. Site shall be maintained in a neat and orderly manner at all times. Temporary fence and all trees and sales equipment shall be removed by December 31, 1981. Use Permit Appl, 118-81. Request to allow temporary outdoor sales of cut flowers; T 692 Marsh Street; C-C zone; Nancy and Denise Gingg, applicants. Greg Smith presented the staff report, recommending denial due to potential traffic conflicts. Ken Bruce noted that no final action could be taken on the application today since the legal advertisement had been published incorrectly. The application would have to be continued to a future meeting. He opened the public hearing to receive testimony. Henriet Smith, owner of the Gazebo Flower Shop, spoke in opposition to the request. She stated that street -corner vendors were unfair competition to florists with permanent facilities in buildings who paid taxes and BIA fees, and were required to provide restroom facilities and parking. She stated that vendors were prohibited in Morro Bay and other cities, and said she felt vendors made no contribution to the city. June Clark, owner of Clark's Florists, was opposed to the request. She felt that the location was too congested, and that vendors should be prohibited at this location. Ken Bruce continued the hearing to December 4, 1981. He advised Mrs. Smith and Mrs. Clark that prohibition of vendors would require an amendment to the city's regulations and suggested they approach the Planning Commission with their views on the subject.
