I hereby certify and represent the following responses are true as of the date of this letter: 1. The zoning of the subject property is Community Commercial with a Special Focus Overlay (C-C-SF) as detailed in Zoning Regulations Chapter 17.28. 2. The subject property is located within the Special Focus Area (SF) Overlay zone as detailed in Zoning Regulations Chapter 17.52. 3. The current use of Mixed-Use Development on the subject property is a permitted use by right in the Community Commercial (C-C-SF) zone. 4. The subject property is not part of a Planned Unit Development. 5. Approval of the current development on the subject property was completed through the City’s Architectural Review process (application ARCH-2794-2016) and Conditional Use Permit Review process (application USE-2882-2016). There are no additional variances, special permits, use permits, exceptions, or conditions applicable to the subject property. 6. The subject property is currently regulated by Chapter 17.28 of the Zoning Regulations. 7. The subject structures were developed in accordance with current zoning code requirements and is legal conforming. 8. Rebuild: In the event of casualty, in whole or in part, the structures located on the subject property may be rebuilt in their current forms, consistent with Zoning Regulations Chapter 17.92. • The City’s use regulations are specified in Zoning Regulations Chapter 17.10 and thresholds for levels of development review are specified in Zoning Regulations Chapter 17.106. 9. As of this date, there are outstanding fire code violations that apply to the subject property. A Fire Inspections Report for this property has been sent via email along with this letter. Approval of the current development on the subject property was completed through the City’s Architectural Review process (application ARCH-2794-2016). On December 5, 2016, the Architectural Review Commission passed Resolution No. ARC-1027-16 which granted approval of the project. The decision was appealed (application APPL-4278-2016) to the City Council in December 2016. On February 7, 2017, the City Council passed Resolution No. 10771 (2017 Series) which denied the appeal and granted final approval of the project. The use of the current development on the subject property was completed through the Conditional Use Permit review process (application USE-2882-2016). On August 24, 2016, the Planning Commission passed Resolution No. PC-1009-16 which denied the proposed project on the subject property. The decision was appealed by the applicant to the City Council in August 2016. On October 18, 2016, the City Council passed Resolution No. 10749 (2016 Series) which upheld the appeal and granted final approval of the project. Links to the agenda packets (including site plans) and resolutions for these applications have been sent via email along with this letter. There are no additional variances, special permits, use permits, exceptions, or conditions that are applicable to the subject property. 11. Certificates of Occupancy were issued for this property, but copies of the certificates could not be located. The absence of certificates of occupancy is not considered to be a violation and will not lead to any enforcement action affecting the subject property. A new certificate of occupancy would only be required in the event of damage or destruction that would result in a building permit to be issued that would generate a new certificate of occupancy. This letter is not binding on the City of San Luis Obispo with respect to any amendments to the Zoning Regulations or General Plan, which may be adopted in the future.
