Well, I'm back "in the fray" again, hopefully helping out the Mission Orchard Neighborhood Association. A
wine bar is proposed to be located at the edge of our neighborhood. A number of us are appealing this project to
the Department of Alcoholic Beverage Control. I've stated the reasons for my protest below. If you, too, wish to

1 am protesting a proposal to locate an alcohol outlet (Vine Intervention LLC) at 800 Palm Street in the historical Ah Louis Store. The law says ABC may deny
any retail license located within 600 feet of a school. This proposed alcohol outlet will be located within 145 feet of the Mission School Annex at 772 Palm St.
— a school annex comprised of 12 -13 year old students - and 480 feet from the Mission College Preparatory Catholic High School at 682 Palm Street.
I am also protesting granting an alcohol outlet license to any new proprietor located within Downtown San Luis Obispo. A new alcohol outlet, the 64 °i license
Downtown, compounds the state of over - concentration and thwarts the City's recent progress in controlling the Downtown alcohol environment. The ABC is
charged with the responsibility under State statute (B &P 23958.4) to deny an application if the issuance of that license would add to an undue concentration of
licenses, But most importantly, the City of San Luis Obispo has already exceeded the maximum number of off -sale beer and wine licenses by rive.
With regards to ABC Act Article 23817.5 23817.5. "Off -sale beer and wine license ratio ". (a) (1) "The number of premises for which an off -sale beer and wine
license is issued shall be limited to one for each 2,500, or fraction thereof, inhabitants of the city or county in which the premises are situated. No additional off -
sale beer and wine license, other than a renewal or transfer or as permitted by Section 23821, shall be issued in any city or county where the number of premises
which all off -sale beer and wine licenses are issued is more than one for each 2,500, or fraction thereof, inhabitants of the city or county ". That would be 19.6
licenses for the City of San Luis Obispo assuming a population of 49,000.
In Census Tract l 1 1.01 alone (Downtown SLO) there are I I off -sale beer and wine licenses. Last I counted there are 14 additional off -sale beer and wine licenses

within the City and outside the Downtown Core resulting in a total of 25 licenses (including 9 wine bars) and 5 over ABC's maximum (see the attachment below).
Finally, a 2011 Fairbank, Maslin, Maullin, Metz & Associates public opinion poll found that 60% of San Luis Obispo residents consider "alcohol- related crimes
and problems "very serious" or "somewhat serious ". In 2012, a utility bill survey found that 59% of the 2,200 San Luis Obispo respondents sought fewer bars in
Downtown SLO. So there are serious, on -going concerns locally about the need to regulate on -site and off -site alcohol outlet density in our Downtown and surrounding
neighborhoods.

• Refer to Form ABC -510, Information Regarding ABC License Application and Protests (Rev. April 2010), before
completing and submitting your protest. The ABC -510 is located at www.abc.ca.gov and in each district office.
• Please print legibly or type. Incomplete and /or illegible information will cause the protest to be rejected.
