No improvememnts are required from Warden Bridge to the subject property because use o f this route has been removed from the scope of the project . Per recommended condition #27, the applicant will upgrade the pedestrian bridge route (the route east of Warden Bridge) an d the subject property, as necessary, to remove any obstructions or uneven pavement, an d provide an evaluation of creek-side lighting . However, maintenance to Warden Bridge is scheduled as part of a funded Capita l Improvement Plan project. The project includes smoothing/re-leveling of the existing surface , new code-compliant guard rails, and a new handrail along the west portion of the bridge . The project is scheduled to begin January of 2013 and will take approximately one month to complete . The maintenance project will be completed prior to the proposed relocation of SL O Brewing Company . Condition 3 – With respect to occupant loads, what is the definition of "substantially comply"? The Community Development Department uses the term substantial compliance to revie w modifications to a project as compared to an original approval . In terms of this Use Permit, th e Community Development Director defines substantial compliance as at, or below, th e maximum occupant loads provided in project plans reviewed by City Council on Novembe r 20, 2012 and in compliance with California Building Code requirements . Condition #13 was modified because condition #9 was added to preclude all live or ambien t entertainment in any outdoor areas, including the proposed rooftop use . Condition 40 — Why has the hold harmless clause been removed ? The hold harmless clause was a recommendation to mitigate against any liability that could b e alleged against the City as a result of the intensification of use and proposed queuing o n Warden Bridge . Condition #40, which specifically relates to use of the Warden Bridge, ha s been removed because use of the Warden Bridge route is no longer proposed as alternat e queue.
