We will provide a mor e detailed explanation to the City Council regarding these requested modifications at the hearing . CONDITION NO . 8.Live entertainment, above the level that is compliant with the City's definition of ambien t entertainment, shall be confined to the second level auditorium as shown on project plans an d entertainment events shall not be performed outside the hours of 6 :00 p .m . to 1 :00 a .m .A modification toeven t hours ofoperation (second level auditorium) toallow earlier operation o f small scale events withno patron queue may beallowed subject to thereview and wTitten approva l eneral business hours for use of th e space that does not include live entertainment shall be limited to 7 :00 a .m . to 2 :00 a.m . Monday through Sunday with all outdoor hours of operation limited to 9 :00 a .m .7 :00 a.m .-to 11 :00 p .m . 9.Live and/or ambient amplified entertainment shall not be allowed in any outdoor area s (i .e ., Higuera Street dining, creek-side dining, roof level patio).Acoustic or backgroun d music may he allowed during hours of operation . 10.The proposed use shall operate in conformance with the City Noise Ordinance (M .C . Unless otherwise approved by the City, an alternate queue commencing from the creek - side entry/exit and extending across the pedestrian bridge shall be used when the even t schedule might conflict with Farmers Market . Use of the pedestrian bridge route as a patron queue may be allowed to avoid conflict with other downtown events (e .g ., permitted parades or assemblies, permitted work within the Higuera Street right-of-way , or other potentially conflicting event as identified by the City of San Luis Obispo or th e applicant) subject to approval of the City . This alternate route shall be managed so tha t clearance is maintained for public pedestrian passage . ofthe pedestrian bridge .This orderly patron line shall have the appropriate gaps to allo w pedestrian to circulate across the line unobstructed . 37.This Use Permit shall be reviewed by the CityCouncil Planning Commission one year from date of occupancy :The CityCouncil shallhave the ability to modify,delete, add conditions, or revoke theUse Permit tominimize advers e impacts to adjacent businesse s and residences based on documents or testimony evidencing such impacts arising from o r pursuant to the City of San Luis Obisp o Municipal Code Title 1 – General Provisions, Chapters 1 .04 – 1 .24 . and Chapter 17 .7 2 Enforcement . 38.This Use Permit shall be reviewed at a public Planning Commission hearing if the Cit y receives substantiated written complaints from any citizen, Code Enforcement Officer, o r Police Department employee, which includes information and/or evidence supporting a conclusion that a violation of this Use Permit, or of City ordinances or regulation s applicable to the property or the operation of the business, has occurred .
