Dear City Mngr Derek J. Johnson,
I am reques?ng access to records in possession or control of the City of San Luis Obisco for the purposes of inspec?on
pursuant to the California Public Records Act, California Government Code § 7920.000 et seq. (“CPRA”), and Ar?cle I, §
3(b) of the California Cons?tu?on. Please limit all communica?ons regarding this request to email. Please do not
telephone me regarding this request. Please also respond to this request in the body of emails as opposed to a le?er
a?ached to emails, except when providing responsive records.
The specific records I seek to inspect are listed below. As used herein, “Record” includes “Public Records” and “Wri?ngs”
as those terms are defined at Government Code § 7920.530 & 7920.545. I request all calls for service received by City of
San Luis Obisco from or about 11050 Los Osos Valley Rd., San Luis Obispo 93405-6200, from Jan. 15, 2023 to June 30,
2023 and all accompanying CAD records and incident reports related to the calls for service.
If you contend that any por?on of the records requested is exempt from disclosure by express provisions of law,
Government Code § 7922.525(b) requires segrega?on and redac?on of that material in order that the remainder of the
records may be released. If you contend that any express provision of law exists to exempt from disclosure all or a
por?on of the records I have requested, Government Code § 7922.535 requires that you no?fy me of the reasons for the
determina?on not later than 10 calendar days from your receipt of this request. This request was sent to you on June
30, 2023. A determina?on is due to me no later than July 9, 2023 to be followed or accompanied by the prompt release
of the requested records as required by the act. Please note that prompt, as used in the act is defined as “performed
readily or immediately.”
Government Code § 7922.540 requires that any response to this request that includes a determina?on that the request
is denied, in whole or in part, must be in wri?ng and include the name and ?tle of the person(s) responsible for the
agency’s response.
Government Code § 7922.500 prohibits the use of the 10-day period, or any provisions of the CPRA or any other law, “to
delay access for purposes of inspec?ng public records.”
In responding to this request, please keep in mind that Ar?cle 1, § 3(b)(2) of the California Cons?tu?on expressly
requires you to broadly construe all provisions that further the public’s right of access, and to apply any limita?ons on
access as narrowly as possible.
