Advisory Body Appointment to the Mass Transportation Committee (MTC) Item 6h Department: Administration Cost Center: 1021 For Agenda of: 7/11/2023 Placement: Consent Estimated Time: N/A FROM: Greg Hermann, Deputy City Manager Prepared By: Kevin Christian, Deputy City Clerk SUBJECT: ADVISORY BODY APPOINTMENT TO THE MASS TRANSPORTATION COMMITTEE RECOMMENDATION Confirm the appointment of Ryan Meller to the Mass Transportation Committee (MTC). POLICY CONTEXT The Advisory Body Handbook, last adopted by City Council in September 2021, outlines the recruitment procedures, membership requirements, and term limits for all City advisory bodies. Additionally, the City Council Policies and Procedures Manual, last updated May 2023, describes the “Appointment Procedure” and “Process” for Advisory Body appointments. Recruitment and appointment recommendations were performed in conformance with all recruitment procedures, processes, and bylaws found in these resources. California Government Code Section 54972, Local Appointments List (Maddy Act), requires that on or before December 31st of each year, each legislative body shall prepare an appointments list for their boards, commissions, and committees whose members serve at the pleasure of the legislative body. This obligation was met and is ongoing. DISCUSSION The vacant MTC position is for the Cal Poly Associated Students Inc. (ASI) representative. This position requires that the individual be a registered Cal Poly student and that they have an endorsement from ASI to represent the group. It does not require residency in the City of San Luis Obispo. The past-appointed representative for this position resigned as he was graduating and leaving the area, creating this unscheduled vacancy. Per the Advisory Body bylaws, appointments for this two-year term position are usually made in September to coincide with the start of the Fall term. However, as the ASI President was able to provide an endorsement for a qualified candidate at this time, the Council Liaison Subcommittee assigned for the MTC, Councilmembers Francis , and Shoresman, recommend Ryan Meller to fill the unscheduled vacancy through August 2023, and additionally, to a two-year term beginning in September 2023. Page 329 of 465 Item 6h Public Engagement Notices that the City was accepting applications for City Advisory Bodies Annual Recruitment were placed on the City’s website and “e-notification” service, listed in the annual Local Appointments List (Maddy Act Notice – GC 54972) on the City Website and City Information kiosk, and distributed via City social media outlets, in November 2022. A notice that the City was specifically recruiting for the current unscheduled vacancy was posted in the City Information kiosk outside City Hall and on the Advisory Body Vacancies page of the City website on May 16, 2023, following Maddy Act guidelines. Additionally, notification of the vacancy was sent to the ASI via email on May 16, 2023. CONCURRENCE The Council liaisons for the MTC concur with the recommendation. ENVIRONMENTAL REVIEW The California Environmental Quality Act does not apply to the recommended action in this report, because the action does not constitute a “Project” under CEQA Guidelines Sec. 15378. The costs related to recruitment are accounted for in the annual budget appropriation in the City Clerk program. Page 330 of 465 Item 6h ALTERNATIVES Council could recommend changes to the subcommittee’s recommended appointments or direct staff to re-open recruitment for additional candidates. This is not recommended as the applicant has been endorsed by the ASI and the Council Liaisons for the committee have interviewed the recommended candidate and feel that they have been quite thorough in their consideration of the applicant and the Council’s needs in their selection process.
