SWCA understands the City is reviewing an Architectural Review application concerning revisions to the design of the Motel Inn project at 2223 Monterey Street in San Luis Obispo, and prepared an Addendum to the Initial Study prepared for the project, for the Planning Commission’s con sideration in taking final action on the application. We understand the City received correspondence from a law firm (Mitchell M. Tsai, Attorney at Law) representing the Southwest Regional Council of Carpenters , which questions the adequacy of the Addendum that was prepared. As requested by the City, and described in the attached scope of work, SWCA will conduct an updated environmental review for the proposed project modifications to ensure the previous and/or subsequent environmental documentation is legally defensible and meets current standards pursuant to the California Environmental Quality Act (CEQA). The cost to complete the proposed tasks, as described in the attached scope of work, is a time-and-materials budget not to exceed $18,612 (assuming preparation of an Addendum) or $20,670 (assuming preparation of a Subsequent IS/MND). Principal Planning Team Lead 2223 Monterey Street Environmental Services Page | 1 SCOPE OF WORK The following scope of work provides a description of environmental review support services that SWCA Environmental Consultants (SWCA) will provide to the City of San Luis Obispo (City) for the proposed 2223 Monterey Street Motel Inn Project (project). SWCA understands the City is reviewing an Architectural Review application concerning revisions to the design of the Motel Inn project at 2223 Monterey Street in San Luis Obispo, and prepared an Addendum to the Initial Study prepared for the project, for the Planning Commission’s consideration in taking final action on the application. We understand the City received correspondence from a law firm representing the Southwest Regional Council of Carpenters (Mitchell M. Tsai, Attorney at Law), which questions the adequacy of the Addendum that was prepared. As requested by the City, our scope of work includes conducting updated analysis for the project in the form of preparing a new Initial Study (IS). Based on the results of the updated Initial Study, and coordination with the City, SWCA will either prepare an updated Addendum (with the IS included as an attachment) or a Subsequent Initial Study/Mitigated Negative Declaration (IS/MND) for the proposed project modifications to ensure the appropriate environmental document is legally defensible and meets current standards pursuant to the California Environmental Quality Act (CEQA). SCOPE OF WORK PHASE 1 Task 1.1: Project Description A finite and stable project description including project objectives (if necessary) is essential to success ful completion of the environmental documentation process. A draft project description will be prepared based on the project details provided by the City and/or Applicant, as well as existing documentation available for the site. SWCA will review all materials associated with the project and submit a data request (as needed) to the City where additional information or clarification may be needed to prepare the project description and to support the CEQA analysis. Upon receipt of requested project information, SWCA will prepare a preliminary project description for the City’s review and approval. Project design details in the project description will be supplemented with any information needed to facilitate preparation of the technical studies and Initial Stu dy (IS). This task assumes one round of review of the Project Description by the City and the Applicant team. This task also includes necessary support and documentation (preparation of a draft notification letter) to support the Assembly Bill AB) 52 process (if necessary). Task 1.2: CalEEMod Modelling Following the City's approval of the Project Description, SWCA will conduct a preliminary run of the California Emission Estimator Model (CalEEMod) to assess whether project air emissions are anticipated to exceed applicable San Luis Obispo Air Pollution Control District (APCD) thresholds. If emissions are not anticipated to exceed applicable thresholds, SWCA will complete the CalEEMod modelling to support preparation of the Air Quality section of the IS/MND and the modelling results will be included as an appendix to the IS/MND. If, however, project air emissions 2223 Monterey Street Environmental Services Page | 2 are anticipated to exceed applicable SLOAPCD thresholds, SWCA will coordinate with the City and Applicant team to discuss mitigation and/or design alternatives available to reduce potential impacts. Task 1.3: Initial Study and Conformity Review Once the Project Description is finalized, SWCA will conduct an updated environmental analysis in the form of an IS and conformity review of the City's original IS/MND for the proposed project to determine if the proposed project has the potential to result in a new significant impact(s) compared to what was previously evaluated . The conformity analysis will be completed for each of the issue areas identified in Appendix G of the CEQA Guidelines and will be used to support the City’s determination of the appropriate level of CEQA documentation needed for the project anticipated to be an updated Addendum or a Subsequent IS/MND). The IS will include analysis missing from the City's 2016 IS/MND that is required pursuant to Appendix G of the most recent update to the State CEQA Guidelines, including energy, tribal cultural resources, vehicle miles traveled, and wildfire. The IS will include the updated project description prepared under Task 1.1, and the updated CalEEMod modelling prepared under Task 1.2. Following preparation of the IS, SWCA will coordinate with the City to discuss the preferred approach to CEQA documentation prior to moving forward with preparation of an updated Addendum or a Subsequent IS/MND. PHASE 2 Based on the findings of the updated analysis and coordination with the City conducted under Task 1.3, SWCA will either prepare a 2nd Addendum or a Subsequent IS/MND for the project, as described in the optional tasks below. Optional Task 2.1: 2nd Addendum If, based on the findings of the updated analysis and preparation of the IS and coordination with the City, it is determined that the project would not result in a new significant impact compared to what was evaluated in the City's 2016 IS/MND, SWCA will prepare a 2nd Addendum for the project pursuant to CEQA Guidelines Sections 15162 and 15164. The IS and updated CalEEMod modelling will be included as attachments to the Addendum. The Addendum does not need to be circulated for public review but can be attached to the adopted MND prior to the lead agency making a decision on the project. Optional Task 2.2: Subsequent Initial Study/Mitigated Negative Declaration Task 2.2.1: Administrative Draft IS/MND SWCA will prepare the Administrative Draft IS/MND using the IS and supporting analysis prepared under Phase 1 tasks. The IS/MND will include a Mitigation Monitoring and Reporting Program (MMRP), which will identify each mitigation measure, the appropriate milestone or timing to implement the measure, the responsible party, and any reporting requirements. Task 2.2.2: Draft IS/MND and CEQA Noticing This task assumes up to two rounds of City review and revision for all sections of the IS/MND. Following receipt of comments from the City, SWCA will finalize the Draft IS/MND and MMRP for public review and circulation. SWCA will prepare all required CEQA notices, including the Notice of Intent to Adopt a Mitigated Negative Declaration (NOI), Summary Form for State Clearinghouse submittal, and Notice of Completion (NOC). SWCA will submit electronic copies of the Draft IS/MND, MMRP, and notices and assumes the City will reproduce the IS/MND and submit to all agencies and interested parties identified on a City-approved mailing list, including the State Clearinghouse for circulation. SWCA assumes the City will be responsible for all public noticing, such as onsite posting, newspaper advertisement listing, and filing the NOI with the County Clerk. 2223 Monterey Street Environmental Services Page | 3 Task 2.2.3: Response to Comments and Final IS/MND After the close of the 30-day public comment period on the Draft IS/MND, SWCA will review agency and public comments received by the City. Although not strictly required by CEQA for an MND, if requested by the City, SWCA will prepare written responses to substantive comments received on the IS/MND for the administrative record and to inform decision makers. SWCA assumes no more than 10 substantive comments will require responses. SWCA will incorporate any necessary clarifications and edits and prepare the Final IS/MND and MMRP. SWCA will prepare a draft Notice of Determination (NOD) for the City’s review and assumes the City will file the NOD at the County Clerk’s office upon final project determination. This task does not include payment of California Department of Fish and Wildlife (CDFW) CEQA Environmental Document Filing Fees or County Clerk processing fees. ASSUMPTIONS We assume additional technical studies will not be required to support preparation of the environmental documentation. Should the need for additional technical studies be identified, SWCA will notify the City and can perform the additional work under a contract amendment. We assume up to two rounds of review by the City for each deliverable. We assume all deliverables will be provided in electronic format. SCHEDULE SWCA is prepared to initiate this scope of work immediately after receiving a signed contract . Table 1. Proposed Schedule. We commit to timely document preparation, consistent with the schedule agreed to by SWCA and the City. Project staff will be flexible with their schedules should adjustments need to be made to maintain progress. Frequent delays outside of the control of SWCA could have implications on the budget as well, so we will communicate frequently with the City to provide an up-to-date schedule. 2223 Monterey Street Environmental Services Page | 4 COST ESTIMATE The budget for the proposed scope of work is a time-and-materials (T&M) not to exceed estimate of $18,612 assuming preparation of an Addendum) or $20,670 (assuming preparation of a Subsequent IS/MND). We have attempted to be conservative in preparation of the budget with regard to the level of effort required so that the overall cost estimates are reasonable for your planning purposes. SWCA will not proceed with any work in excess of the T&M budget without prior authorization to proceed from the City. A detailed cost breakdown is provided in Table 1. Table 1.
