SUBJECT: ITEM 4A - 1700 PALM ST. (DIR-0378-2023) CAPSLO SAFE PARKING
SITE – APPLICATION WITHDRAWAL.
Discussion
The City values the community’s input on Item 4a of the September 6, 2023 Special
Meeting of the Planning Commission regarding review of an Interim Safe Parking
Location at 1700 Palm Street (DIR-0378-2023). In the course of reviewing agenda
correspondence related to this item, City staff was made aware of recent case law that
casts doubt on the City’s ability to temporarily close Palm Street pursuant to California
Vehicle Code Section 21101(e) to establish a safe parking location at that location. At this
time, Community Action Partnership of San Luis Obispo (CAPSLO) has withdrawn their
application for the 1700 Palm Street location. Therefore, there is no application for use of
Palm Street as an interim Safe Parking location under consideration by the Planning
Commission (or the City’s Community Development Director).
The Planning Commission will still hold a meeting tonight and staff will provide an
overview of the rotating safe parking program with an opportunity for the public and
Planning Commission to provide comments, however no action will be taken by the
Planning Commission.
