SUBJECT: FY 2023-24 GRANT APPLICATIONS FOR THE ALCOHOLIC BEVERAGE
CONTROL AND BUREAU OF JUSTICE ASSISTANCE; AND
ACCEPTANCE OF GRANT FUNDING FROM THE CALIFORNIA BOARD
OF STATE AND COMMUNITY CORRECTIONS
RECOMMENDATION
1. Authorize staff to submit grant applications to the following entities:
a. FY 2023-24 Department of Alcoholic Beverage Control – Office of Traffic Safety in
an amount not to exceed $40,000.
b. FY 2023-24 Edward Byrne Memorial Grant for $16,271.
2. Authorize staff to accept funding from the California Board of State and Community
Corrections for an Officer Wellness and Mental Health Grant in the amount of
$42,124.96; and
3. Adopt a Draft Resolution entitled, “A Resolution of the City Council of the City of San
Luis Obispo, California, authorizing Grant Applications for funding provided through the
Department of Alcoholic Beverage Control and the Office of Traffic Safety through the
National Highway Traffic Safety Administration to increase education and enforcement
programs focusing on underage drinking and authorizing the City Manager or their
designee to execute all related grant documents”; and
4. If the grants are awarded, authorize the City Manager or their designee to execute grant
related documents and authorize the Finance Director to make the necessary budget
adjustments upon the award of the grant.
POLICY CONTEXT
The recommended actions are consistent with the City of San Luis Obispo’s Financial
Management Manual, Section 740 - Grant Management Policy. The policy states that
Council must approve all grant applications in excess of $5,000 and delegate receipt and
contract execution to the City Manager.

Background
Alcoholic Beverage Control – Office of Traffic Safety Local Enforcement Grant
The Alcoholic Beverage Control – Office of Traffic Safety Local Enforcement Grant Program
(ABC-OTS) awards grants up to $50,000 to local law enforcement agencies to utilize the
Minor Decoy and Shoulder Tap programs. This grant is sponsored by OTS through the
National Highway Traffic Safety Administration and managed by ABC. The overall goal of
the program is to deter underage drinking. The department intends to utilize grant funds for
overtime to conduct various operations associated with alcohol enforcement and education.
Notification of the grant was sent to the department on August 7, 2023 and the deadline to
submit a letter of interest was September 8, 2023.
Edward Byrne Memorial Grant
The U.S. Department of Justice Edward Byrne Memorial Justice Assistance Grant (JAG)
Program is the primary provider of federal criminal justice funding to the State and local
jurisdictions. The JAG Program is a non-competitive formula grant, and the funding
allocation is based on the population and crime rate of the local jurisdiction. The amount
available to the City of San Luis Obispo for 2023 is $16,271.
The grant application deadline was August 31, 2023, if necessary, staff can withdraw the
application or decline the award if the request is denied. Last year, JAG funds were used
to purchase rifle-rated vests and due to limited funding, the department was only able to
purchase one for each vehicle. This year the department intends to use grant funds to
purchase the remainder of the rifle-rated vests which would enable the department to assign
each officer a vest. These vests provide greater protection to officers that may respond to
an active shooter situation in publicly accessible areas, which could place first responders
and community members at significant risk for loss of life. The rifle-rated vests would be in
addition to the mandatory ballistic vest officers wear on duty. Lastly, funds will also be used
to purchase one ceremonial uniform for the department’s Honor Guard team.
California Board of State and Community Corrections
Established as part of the 2022 Budget Act (AB 178, Chapter 45, Statutes of 2022), the
Officer Wellness and Mental Health Grant Program provides funding for City and County
law enforcement agencies for the purposes of improving officer wellness and expanding
mental health resources. The funding may be used for any of the following purposes:
a. Establishing or expanding officer wellness units
b. Establishing or expanding peer support units
c. Services provided by a licensed mental health professional, counselor or other
professional that works with law enforcement
d. Expanding multiagency mutual aid programs focused on officer wellness and
mental health
e. Other programs and services that are evidence-based or have a successful track
record of enhancing officer wellness

Under this Board of State and Community Corrections (BSCC) program, officer wellness
is defined as the consideration of the physical, emotional, or mental condition or well-
being of an officer. Officer wellness programs are services or programs that are intended
to support or improve the physical, emotional, or mental condition or well-being of an
officer.
A total of 394 California law enforcement agencies were allocated funding under the BSCC
Officer Wellness and Mental Health program, the allocation for the San Luis Obispo Police
Department was $42,124.96. Staff is working to identify areas that would most benefit from
the funding, some examples include officer wellness training, peer support unit training,
equipment to expand officer physical wellness, and other programs that are geared toward
a holistic approach to wellness. All funds must be expended by December 1, 2025.
Grant applications were not submitted to the BSCC for this funding since disbursement was
made in accordance with the Budget Act of 2022. The allocations were based on the number
of peace officers described in Penal Code section 803.1 for each law enforcement agency.
Public Engagement
This item is on the agenda for the September 19, 2023, City Council meeting and will follow
all required postings and notifications. The public may have an opportunity to comment on
this item at or before the meeting.
CONCURRENCE
The Director of Finance concurs with staff’s recommendations.
ENVIRONMENTAL REVIEW
The California Environmental Quality Act does not apply to the recommended action in this
report because the action does not constitute a “Project” under CEQA Guidelines Section
15378.

ALTERNATIVE
Do not submit grant applications or decline funding. This alternative is not
recommended. These grants provide funding for officer wellness, specialized equipment
purchases and overtime for targeted education and enforcement opportunities. Without
grant funds the department would not be able to carry out these types of programs which
increase safety in our community.

OBISPO, CALIFORNIA, AUTHORIZING GRANT APPLICATIONS FOR
FUNDING PROVIDED THROUGH THE DEPARTMENT OF
ALCOHOLIC BEVERAGE CONTROL – OFFICE OF TRAFFIC SAFETY
THROUGH THE NATIONAL HIGHWAY TRAFFIC SAFETY
ADMINISTRATION TO INCREASE EDUCATION AND ENFORCEMENT
PROGRAMS FOCUSING ON UNDERAGE DRINKING AND
AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE
ALL RELATED GRANT DOCUMENTS
WHEREAS, the San Luis Obispo Police Department (the “Police Department”)
through the City of San Luis Obispo desires to undertake programs to increase
education and enforcement to deter underage drinking; and
WHEREAS, the Police Department submitted a grant through the Department of
Alcoholic Beverage Control (ABC), sponsored by the Office of Traffic Safety (OTS),
through the National Highway Traffic Safety Administration (NHTSA), in August 2023 to
conduct education and enforcement activities to deter underage drinking; and
WHEREAS, on August 7, 2023, the Police Department was notified of the ABC-
OTS Local Enforcement Grant opportunity in an award amount not to exceed $40,000.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Chief of Police or his designee is hereby authorized to submit
grant applications consistent with program requirements to pursue a grant administered
by ABC-OTS, including the Police Department's August 2023 application.
SECTION 2. The City Manager or designee of the City of San Luis Obispo is
authorized to execute all grant-related documents, including the State of California
Standard Agreement, any extensions, or amendments thereof, and any subsequent
contract with the State in relation to the ABC-OTS Local Enforcement grant
administered by ABC.
SECTION 3. Authorize Finance Director to make the necessary budget
adjustments upon the award of the grant.
SECTION 4. The City agrees that any liability arising out of the performance of
this contract, including civil court actions for damages, shall be the responsibility of the
grant recipient and the authorizing agency and acknowledges that the State of California
and ABC disclaim responsibility for any such liability.

SECTION 5. Grant funds received hereunder shall not be used to supplant
expenditures controlled by this body.
SECTION 6. This award is not subject to local hiring freezes.
