City Council to order in the Council Hearing Room at City Hall, 990 Palm Street, San

The City Council will hold a Regular Meeting on September 19, 2023 at 5:30 p.m. in
the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
2.CALL TO ORDER
Mayor Erica A. Stewart will call the Regular Meeting of the San Luis Obispo City Council to
order.
3.PLEDGE OF ALLEGIANCE
Vice Mayor Jan Marx will lead the Council in the Pledge of Allegiance.
4.PRESENTATIONS
4.a CITY MANAGER REPORT
Receive a brief report from City Manager Derek Johnson.
5.PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA
Not to exceed 15 minutes. The Council welcomes your input. State law does not allow the
Council to discuss or take action on issues not on the agenda, except that members of the
Council or staff may briefly respond to statements made or questions posed by persons
exercising their public testimony rights (Gov. Code sec. 54954.2). Staff may be asked to
follow up on such items.
6.CONSENT AGENDA
Not to exceed 15 minutes. Matters appearing on the Consent Calendar are expected to be
non-controversial and will be acted upon at one time. A member of the public may request
the Council to pull an item for discussion. Pulled items shall be heard at the close of the
Consent Agenda unless a majority of the Council chooses another time. The public may
comment on any and all items on the Consent Agenda within the three-minute time limit.
Recommendation:
To approve Consent Calendar Items 6a to 6g.
6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES
Recommendation:
Waive reading of all resolutions and ordinances as appropriate.
6.b MINUTES REVIEW - SEPTEMBER 5, 2023 COUNCIL MINUTES
Recommendation:
Approve the minutes of the City Council meeting held on September 5, 2023.
6.c EQUIPMENT SURPLUS DESIGNATION AND AUTHORIZATION OF SALE OF
WATER DISTRIBUTION, WASTEWATER TREATMENT, AND IRRIGATION
ASSETS
Recommendation:
Authorize the designation and disposal of surplus items in accordance with the City’s
policies and procedures as prescribed in the Financial Management Manual
Sections, 480-A, and 480-B.
6.d APPROVE USE OF FUNDING FOR RECYCLED WATER USER SITE
IMPROVEMENTS
Recommendation:
1.Authorize the use of up to $172,647.45 in available funding from the
Recycled Water System Retrofits CIP (Project #2000573) to make recycled
water and water distribution system protection site improvements on
qualifying private properties; and
2.Find that the use of this funding does not constitute a gift of public funds
and fulfills a public purpose; and
3.Find the action categorically exempt from the California Environmental
Quality Act.
6.e FY 2023-24 GRANT APPLICATIONS FOR THE ALCOHOLIC BEVERAGE
CONTROL AND BUREAU OF JUSTICE ASSISTANCE; AND ACCEPTANCE OF
GRANT FUNDING FROM THE CALIFORNIA BOARD OF STATE AND
COMMUNITY CORRECTIONS
Recommendation:
1.Authorize staff to submit grant applications to the following entities:
a.FY 2023-24 Department of Alcoholic Beverage Control – Office of
Traffic Safety in an amount not to exceed $40,000.
b.FY 2023-24 Edward Byrne Memorial Grant for $16,271.
2.Authorize staff to accept funding from the California Board of State and
Community Corrections for an Officer Wellness and Mental Health Grant in
the amount of $42,124.96; and
3.Adopt a Draft Resolution entitled, “A Resolution of the City Council of the
City of San Luis Obispo, California, authorizing Grant Applications for
funding provided through the Department of Alcoholic Beverage Control and
the Office of Traffic Safety through the National Highway Traffic Safety
Administration to increase education and enforcement programs focusing
on underage drinking and authorizing the City Manager or their designee to
execute all related grant documents”; and
4.If the grants are awarded, authorize the City Manager or their designee to
execute grant related documents and authorize the Finance Director to
make the necessary budget adjustments upon the award of the grant.
6.f AWARD CONSTRUCTION CONTRACT FOR FIRE STATION 1 FLEET
MAINTENANCE ROOF PROJECT, SPECIFICATION NO. 2000075-5.01
Recommendation:
1.Award a Construction Contract to Edwards Construction Group, Inc. in the
amount of $348,290.86 for the Fire Station 1 Fleet Maintenance Roof
Project, Specification Number 2000075-5.01; and
2.Approve the transfer $81,893 between Major Facilities Maintenance
Account subprojects to support the project; and
3.Approve the transfer of $18,000 from the Local Sales Tax Fund Completed
Projects Undesignated Capital Account to the project account (Spec. No.
2000075-5.01).
6.g AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT TO
TRANSDEV’S AGREEMENT FOR HIRING INCENTIVES AND TERM EXTENSION
Recommendation:
1.Approve the sole source procurement for transit operations and
maintenance services; and
2.Authorize the City Manager to negotiate and execute an amendment to the
transit operations and maintenance agreement with Transdev North
America, formerly First Transit, to include hiring incentives and to extend
the term of the agreement.
7.PUBLIC HEARING AND BUSINESS ITEMS
7.a AWARD CONSTRUCTION CONTRACT FOR THE CULTURAL ARTS DISTRICT
PARKING STRUCTURE PROJECT, SPECIFICATION NO. 90435 (Estimated Time:
20 minutes)
Recommendation:
1.Approve the final project plans and specifications for the Cultural Arts
District Parking Structure Project; and
2.Adopt a Draft Resolution entitled, “A Resolution of the City Council of the
City of San Luis Obispo, California, to appropriate $47 Million in Bond
Proceeds to the Cultural Arts District Parking Structure Project Account”;
and
3.Award a construction contract for the Cultural Arts District Parking Structure
Project to Swinerton Builders Inc. in the amount of $41,070,044.00.
7.b INTRODUCTION OF AN ORDINANCE APPROVING LOCAL AMENDMENTS TO
THE CALIFORNIA ENERGY CODE (Estimated Time: 45 minutes)
Recommendation:
Introduce an Ordinance entitled, “An Ordinance of the City Council of the City of San
Luis Obispo, California, adopting Local Amendments to Part 6 of the Building
Construction and Fire Prevention Code, 2023,” to be codified under San Luis Obispo
Municipal Code Chapter 15.04.060 – “Amendments – Energy Standards”.
8.LIAISON REPORTS AND COMMUNICATIONS
Not to exceed 15 minutes. Council Members report on conferences or other City activities. At
this time, any Council Member or the City Manager may ask a question for clarification,
make an announcement, or report briefly on their activities. In addition, subject to Council
Policies and Procedures, they may provide a reference to staff or other resources for factual
information, request staff to report back to the Council at a subsequent meeting concerning
any matter or take action to direct staff to place a matter of business on a future agenda.

9.ADJOURNMENT
The next Regular Meeting of the City Council will be held on October 3, 2023 with Closed
Session at 4:30 p.m. in the Council Hearing Room and the Regular Meeting at 5:30 p.m. in
the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
