SUBJECT: Notice of Code Violation at 1605 Calle Joaquin, San Luis Obispo
Dear Mr. McTeer:
On April 23, 2008, Public Works Department staff inspected property you occupy at 1605 Calle Joaquin and noted that
an illegal sign advertising the Courtyard Marriott was in the City right-of-way. This sign was removed by the Public
Works Department as is available for pick up at the City’s Corporation Yard located at 25 Prado Road. To schedule a
time to pick up this sign please call Sheila New at (805) 781-7220.
Please be aware that the situation described above constitutes a public nuisance as defined by San Luis Obispo
Municipal Code and violates sign regulations and the following code section:
M.C. 15.40.300I Signs in the Street Right-of-Way -
On February 14, 2008, a notice of code violation was sent to you warning that a second violation of this type within a
year would result in an immediate Administrative Citation and confiscation of the sign. Enclosed is an Administrative
Citation, please follow the instructions on the back. If you feel that this is an incorrect action you may appeal this
Administrative Citation within ten days of the date of issuance of the notice of Administrative Citation.
Please be aware that if there is a third violation of this type within a year we will issue another Administrative Citation
and fines may begin at $200.00 per violation per day violation continues. The City may also confiscate unpermitted
signs in the right-of-way and transport them to the Corporation yard.
If these violations continue we will forward this case to the City Attorney. The law allows the City Attorney to take
further enforcement measures such as:
1) Issue an Administrative Citation: If you fail to comply voluntarily, all persons with interest in the property will be
subject to a daily fine starting at $100.00 and increasing up to $500.00 for each violation. (See enclosure).
2) Seek an Injunction: The City of San Luis Obispo may seek a court order which will require interested parties to
comply with City laws, be liable for civil penalties of $250.00 per day and pay all costs including attorney fees to
ensure the public nuisance is abated.
3) File a Criminal Complaint: Each violation constitutes a misdemeanor and carries a maximum penalty of six (6)
months in jail and a $1,000 fine for each day the violation exists.

Fines shall be paid to the city within thirty days of the due date. Payment shall be made by check or money order. The
fines shall be paid to the City of San Luis Obispo Finance Department within thirty (30) calendar days from the date of the
citation. Unpaid fines may be subject to an assessment and lien procedure.

You may file an appeal to this Administrative Citation by submitting a request in writing to the Hearing Administrator within
ten days of the date of this Administrative Citation. An appellant may contest the notice of administrative citation by
denying that a violation occurred, by denying that it was not corrected within the required correction period or, if
applicable, by establishing that he or she is not the owner of the real property or the owner of the business at the time the
violation should have been corrected. Each responsible party is individually required to file an appeal. See the reverse
side for more information.
