W I T N E S S E T H: REFERENCE IS MIEBY MADE to that certain proposed subdivision of that certain real phperty situated in the City of San Luis Obispo, County of San Luis Obispop State of California, description of which is shown on final "Map of Tract Ho. 94, Richland Terrace, a resubdiviaion of Lots 8� 21, and part of 7 and 22y Goldtree Vineyard Tract and Block A, Tract :o. 55, City of San Luis Obispo", as approved by the City Council, on day of 1955, subject to approval of all engineering plans and specification by the City ingineer. WHEtFAS, the Subdivider desires that said Subdivision Map of said Richland Terrace be accepted and approved as a final map pursuant to the Sub- division Regulations and Ordinances of the City of San Luis Obispo, and WLPn';'rAS� it is a condition of said regulations and ordinances that the Subdivider agrees to instal the street i^tarovenents and utility lines and facilities therein set forth. idOd T:ZLL'ORE, in consideration of the foregoing, the Subdivider does hereby agree to construct and install the following subdivision improvements in accordance with said subdivision ordinances and regulations, and in accordance with approved plans and specifications on file in the office of the City Engineer, City of San Luis Obispo, to wit: 1. LIGHT AND GAS rACIUTISS: A letter from each public utility to the City Engineer, stating that such services will be provided, is considered to be satisfactory compliance with said ordinances and reg,lations. ?. All the above facilities shall be inatalled in the locations designated and to the plans and specifications on file aria approved by said City En-Ineer. The lines and grades for all of said improvements skiall be established by the Subdivider in accordance with said approved plane and specifications. The Subdivider agrees that the work of i stallin; the above improve- ments shall begin within sixty (60) days from the date of recording, of the final ❑ap, and that the work shall be completed within eighteen (18) months of said recording date. As to public lands or section property included within said Subdivision, if any, for the restoration of lost section comers and for retracement of section lines, the met]:od followed shall be in accord with the instructions set forth in the "'Manual of Instractions" for the Survey of :ublic Lands of the united States, published by the Commissioner of General Land Office, Department of Interior, vlashi.ngton, D. C. The Subdivider hereby attaches hereto, and as an integral part hereof, and as security for the performance of tiis agreement, a good and sufficient bond signed and executed by the Subdivider a,td owner of the land, as principal, and by his surety, in favor of the City of San Luis Obispo, and conditional upon the faithful perfoa, ce of this agreement, which said bond is in the amount of �29,500.00, and which is in the amount of the estimated cost of said improvements. Rich shall deposit with the City the sum of m750.00, from which deposit the City will pay the salary and expenses oian inspector or inspectors to inspect installation of off site improvements and certify that they have been completed in accordance with the plans and specifica- tions. Article 9, Chapter I of the San Luis Obispo Municipal Code, entitled "Subdivisions" - All plans and specifications on file with said City Engineer as a part of said Subdivision :lap, and all other documents filed with the City by the Subdivider are hereby referred to for further particulars in interpreting and defining, the obli,^,ations of the Suhdivider under this agreement. In the event that the City desires to iodif`y, enlarger or extend any of the improvements herein referred to, or shown on the approved plans, and if .said modifications, enlargements or extensions are in excess of Bose required end as approved by the Engineer. it is expressly agreed that the City will pay tLe actual additiaud cost of said modifications, enlargements or extensions. It is agreed that the Contractor will furnish. copies of the successful bidder's contract unit prices and total bid prices for all of the improvements herein referred to.
