With reference to our previous letter of May 19th
and to our discussion at the council meeting of that
evening, please be informed that our contractor has
completed the job of clearing the streets, and we would,
therefore, request that your council pass a resolution
of acceptance of this subdivision and instruct the city
clerk to release the bond of the Glens Falls Indemnity
Company securing the performance of this work.
To confirn; our verbal offer of the previous matting,
the Trojan Construction Company pledges itself herewith
to pay 50% of the cost of constructing a drainage culvert
on the south side of Foothill Blvd. from Rincon Drive
easterly, said sum not to exceed $1,000.00.

and attention to this matter.

Gentlemer:
For the past several weeks our organization has been working in
conjunction with the office of the city engineer of San Luis Obispo
with the objective in mind of preparing Me Millan Manor Tract No. 9
for acceptance by your city. In conformance with discussions held
with the city engineer and hisstaff, we feel that the subdivision
Is now ready for acceptance.
We refer specifically to a letter of May 12th from the city engineer
to Williams 8- Burrows, Inc., our general contractors on this job,
wherein the procedure was outlined with certain items set forth as
a condition of acceptance.
We apparently are in complete agreement on all phases of the streets,
and the subdivl sion as a whole, vi th the exception of the question of
culverts and their future enlargement. It is the position of our
comrany that the cost of enlarging the culverts if such should
prove necessary, is not a proper burden to be paced upon this sub-
division. The culverts in question were designed in accordance with
engineering consultation with the city, and the construction of the
culverts was inspected and approved by the city. The fact that an
abnormal storm condition, co-inciding with extremely bad obstructions
within an existing culvert under Foothill Boulevard, resulted in an
overflow does not seen to warrant charging the expense of any correct-
ive action desired as a proper charge against this subdivision. We
would respectfully suggest that the cost of any corrective action
desired be charged against the future development of land to the
west inasmuch as this future development would add additional burden
to the culverts in question.
We respectfully request, therefore, that the City of San Luis Obispo
accept the streets as dedicated in McMillan Manor Tract No. 9, and
that your city clerk be authorized to release the surety bond of
the glens Falls Insurance Company securing the performance of this
work.

in connection with said installation; said payment to be made as
follows:
The sum of $13,000.00 to be paid at the time of the signing
of t.is agreement, and the balance of $5,039.56 to be paid on or
before August 1, 1952, with no interest.
