Gentlemen:
At the regular Council Meeting held Monday, October 4, 1965,
the City Council discussed the traffic patterns and street routes
in the north portion of the City above Foothill Boulevard. In the
course of this discussion, the matter of the re -submitting of the
map for Tract No. 125 was brought to the Council's attention, partic-
ularly the extension of Westmont Drive west thru this tract to the
boundary of Tract No. 257.
After discussion with members of the City Staff, the City
Council took the following action to guide your consideration in your
approval of Tract No. 125.
It was moved by Councilman Spring and seconded by
Councilman Miller that the Planning Commission
be instructed to require the developer of Tract No. 125
to extend Westmont Ave. westerly to the eastern line
of Tract No. 257.
Motion carried unanimously.

Attached for your information is a copy of the new tentative ma; of Tract 125,
College Highlands No.3. This tract was approved two or three years ago and
brcause of the time element, has been re, uired to be resubmitted. This is
the subdivision which was the topic of conversation during the approval of the
last Ferrini subdivision and presented by Mr. Somogyi on behalf of Mr. Flagg,
The contention of Hr, Flagg has been that Westmont Avenue should run straight
through his property without curving to meet the alignment of Westmont on
Mr. Ferrini's property. Because of V:is contention, Mr. Flagg:s original
map of 125 has been altered and resubmitted as you see it here, leaving out
the most westerly portion of his land and thereby, the connection that wo,.ld
nuke Westmont a complete street all the way from Ferrini Heights to State
Highway 1. Aside from the fact that Wast nt does not make the connect.on
desired by the City, the subdivision is in order and will be approved as is
by the Planning Cosmission unless there are eomo conditions the Council might
wish to attach.
After the Subdivision Review Board meeting on this subdivision, 1 had a private
conversation with Mr. Morgan Flagg and stated that the City was not particularly
interested in whether or not Westmont made a connection between Flagg property
a:id Farrini property, but that we were vitally interested in the completion of
Westmont to provide circulation and better fire and police protection to the
people purchasing Iota and building houses in the proposed subdivisions, 1
asked him if he would not forget his diffrrencas with Mr. Ferrini and develops
the property and build the street connection as soon as possible. Mr. Flagg
stated that he had no intention of building this str et but that he would give
the remainder of this subdiv:edon to the City for a public park and the City
cr,il.d then construct the remainder of Westmont and make the connection between
this Tract 125 and Jeffery Drive. I asked him when this gift would be made to
the City, he said that this would depend upon the time that the value of the
land had increased to such an extent that the girt to the City mad reflect a
tax hrea, for him, This street could probably be completed with gas tan money
within the next three or four years, If we had this property. If Mr. Flagg is
at the meeting, it might be of benefit if Hr. Flagg could be drawn out to
igaia make a statement as to his willingness to give this property to the City,

In reference to a letter from Loretta Blair, Secretary,
Office of Building Inspector, dated May 6, we hereby
request a refund of $20.00, due to the fact that we
had sent a check to cover fees for two variances
applied for in conjunction with residences to be con-
structed on Westmont Avenue in College Highlands, Unit 3.
Mr. Keith Fraser was not aware that we had sent this
check, and collected an additional $10.00 for each
variance from Crompton and McNamara.
We also request a refund of $33.00 for Building Permit
#1381 which was cancelled, by reason of house not being
built, and subsequent issuance of Building permit #1717
dated April 10, 1958.
