ARTICLE I. -- Witns sseth, That for and in consideration of the pay-
ments and agreements hereinafter mentioned, to be made and performed, by
the said party of the first part, and under the conditions expressed in
the two bonds, bearing even date with these presents, and hereunto annexed,
the said party of the second part agrees with the said party of the first
part, at his own proper cost and expense, to do all the work and furnish
all the materials, except such as are mentioned In the specifications to
be furnished by said party of the first pert, necessary to construct and
complete in a good worknonliloa and substantial manner and to the satisfac-
tion of the City of Sea Luis Obispo, the water system improvements, in
strict conformity with the plans and specifications prepared therefor and
adopted by the City Council of said City, entitled "Water Supply Line and
California Blvd. Water !fain, Project No. W-56-1," dated July, 1956, which
said place and specifications are hereby specially referred to and by said
reference made a part hereof.
ABTICLP. II. — And the said Contractor agrees to receive and accept
the following prices as full compensation for furnishing all materials not
to be furnished by the Party of the First Part, and for doing all the work
contemplated and embraced in this agreement, also for all loss or damage
arising out of the nature of the work aforesaid, or from the action of the
elements, or from any unforseen difficulties or obstructions which may
arise or be encountered in the prosecution of the work until its accept-
ance by the Party of the First Part, end for all risks of every descrip-
tion connected with the work; also, for all expenses incurred by or in
consequence of the suspension or discontinuance of the work and for well
and faithfully completing the work and the whole thereof, in the manner
and according to the plans and specifications, and the requirements of
the Engineer under them, to -wit:

Should any dispute arise respecting the true value of Fury work omitted
or of any extra work which the Contractor may be required to do, or re-
specting the size of any payment to the Contractor, during the performance
of this contract, said dispute shall be decided by the City Council and
it's decision shall be final and Conclusive.
ARTICLE III. — The said party of the first part hereby promises and
agrees with the said Contractor to employ, and does hereby employ, the said
Contractor to provide the materials and to do the work according to the
terms and conditions herein contained end referred to, for the prices afore-
said, and hereby contracts to pay the same at the time, in the manner and
upon the conditions above set forth; and the said parties for themselves,
their heirs, executors, administrators, successors and assigns, do hereby
agree to the full performance of the covenants herein contained.
ARTICL3 17. — It is further expressly agreed by and between the
parties hereto that should there be any conflict between the terms of this
instrument and the bid or proposal of said Contractor, then this instrument
shall control and nothing herein contained shall be considered as an accept-
ance of the said terms of said proposal conflicting herewith,
ARTICLE V. -- The Contractor shall forfeit, as penalty, to the City
of San Luis Obispo, Tan Dollars ($10.00) for each workman employed in the
execution of the contract by him or by any subcontractor, for each calendar
day during which any workmen is required or permitted to labor more than
eight (8) hours in violation of the provisions of Article 3, Chapter I,
Part 7, Division 2 of the Labor Code end all amendments thereto.
ARTICLE VI. — The Contractor shall forfeit as penalty to the City of
San Luis Obispo, Ten Dollars ($10.00) for each alien knowingly employed in
the execution of the contract, for each calendar day or portion thereof,
during which said alien is permitted or required to labor in violation of
the provisions of Article 4, Chapter 1, Part 7, Division 2 of the Labor
Code, and all amendments thereto.
ARTICLi. VII. — Only such materials shall be used in the performance
of this contract as conform to the requirements of Chapter 4 of Division 5
of Title I of the Government Code of California.
ARTICLE VIII. -- Reference is hereby made to the rate of prevailing
wage scale established by the City Council of the City of San Luis Obispo
and attached to the specifications, the provisions of which are hereby
specified as the rate of prevailing wage to be paid workman on this project.

ARTICLE IX, -- The Contractor shall begin work within ten (10) calen-
dar days after the date of the signing of the contract and shall diligently
prosecute the ewe to completion of Project Unit 1 before the expiration of
seventy-five (75) working days from the date of the signing of the contract,
and to completion of Project Unit 2 before June 15, 1957.
ARTIOL E X. -- Reference is hereby made to Ordinance No. 147 New Series
of the City of San Luis Obispo, entitled, "An Ordinance Enforcing Preference
for the Employment of Resident Laborers Performing Labor upon Public Works
In the City of San Luis Obispo," applicable to work performed under this
contract.

required to put up the specified amount in the form of a cashier's

We are won&ering if you are familiar with this incident, or
if you might direct this letter to the person who is familiar with
it, so that we may ascertain whether or not there was anything
lacking insofar as the Bid Bond was concerned, or whether it is a
normal requirement of yours that a certified check be used for
bidding purposes on certain projects.
