HomeMy WebLinkAboutF-275CITY CLERK'S FILE no. _ SUBJECT: DRAFT DRAFT ORDINANCE NO. (06,fSeries) AN ORDINANCE REGULATING THE OCCUPATION OF TRANSIENT OR ITINERANT PORTRAIT OR COMMERCIAL PHOTOGRAPHY. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. It shall be unlawful for any person, firm or corporation except news- papers and commercial printers to engage in the business, occupation or profession of transiei or itinerant portrait or commercial photography, or color photography or transparencies, or i the enlarging, copying, coloring or portrait finishing of photographs, or to solicit or offer for sale any of such goods or services, directly or indirectly, verbally, by telephone, through the use of coupons or tokens of whatever nature, or by means of printed advertising of any form, I subterfuge or otherwise, in the City of San Luis Obispo, without first having procured a license or permit therefor as hereinafter provided. SECTION 2. Applicants for a license or permit under this ordinance must file with the City Clerk a sworn application in writing (in duplicate) on a form to be furnished by him, which shall give the following information: (a) Name of applicant. (b) Permanent home address and full local address of applicant. (c) A brief description of the nature of applicant's business. (d) If employed, the name and street address of employer, together with credentials establishing the exact relationship. (e) The City, County, State and the street address where the taking, finishing, coloring or enlarging of photographs will be done, the proposed method of delivery, and the average length of time within which delivery will be made. (f) All the cities in the State of California in which the applicant has done business within the past year. At the time of filing the application for a license or permit, a fee of Five Dollars ($5.00) shall be paid to the City Clerk to cover the cost of investigation of the facts stated therein. SECTION 3. Upon receipt of such application,. the City Clerk shall investigate the character and business responsibility of the applicant and is satisfied that the applicant per- forms in accordance with his advertising and contracts, shall issue a business license in accordance with the business license provisions. SECTION 4. Any person aggrieved by the action of the City Clerk in the issuance or denial of the business license shall have the right to appeal to the Council of the City of San Luis Obispo. Such appeal shall be taken by filing with the City Clerk, within ten (10) days after notice of the action complained of has been mailed to the applicant and said appeal shall contain a written statement setting forth fully the grounds of the appeal. The City Council shall consider said appeal at its next regular meeting. SECTION 5. Every person, firm or corporation engaging in the business, occupatio or profession of transient or itinerant, portrait or commercial photography, color photographs or transparencies or in the enlarging, copying, coloring or portrait finishing of photographs shall file with the City Clerk a surety bond running to the City in the amount of $1, 000.00, Witt surety acceptable to and in form approved by the City Attorney, conditioned that said applicant shall comply fully with all the provisions of the ordinances of the City of San Luis Obispo and the Statutes of the State of California, and guaranteeing to any person of the City of San Luis Obispo doing business with said applicant that the photographs purchased or the service con- tracted for will be delivered or performed according to the representations of such applicant. Action on such bond may be brought in the name of the City for the use or benefit of the aggrieved person. (b) Said surety bond, regardless of period of license, shall be in force for a period of one year following date of issuance of license or for such period as shall be re- quired for licensee to submit satisfactory proof to the City License Inspector that all orders taken under the permit have been delivered to the satisfaction of the purchasers and no license shall be renewed until a bond in the aforesaid amount has been filed with the Citv Clerk. SECTION 6. The applicant shall further appoint the City Clerk of the City of San Luis Obispo as his process agent in all matters connected with or arising out of said applicant's business, occupation or profession of portrait or commercial photography or color photographs or transparencies or the enlarging copy of portrait finish of photograph or the solicitationor offering for sale thereof whether by the applicant or by his agents or employees in the City of San Luis Obispo, before obtaining such license. It shall be the duty of the City Clerk immediately to advise the applicant by registered mail addressed to said applicant at his place of business at the address furnished in the Indemnity Bond of the nature and pendencq of any action brought against said applicant wherein process is served on the said Clerk. SECTION 7. Violation of any provision of this ordinance shall constitute a misdemeanor and shall be punishable in accordance with Section 1200 of the San Luis Obispo Municipal Code. SECTION 8. If any section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses and phrases of this ordinance, or the ordinance as an entirety, it being the legislative intent that this ordinance shall stand notwithstanding the invalidity of such section, sentence, clause or phrase. SECTION 9. Fitzpatrick, City Clerk Attached is a copy of the ordinance for the City of Beverly Hills, con- trolling solicitors and peddlers, which is of the basic type I would recommend for your consideration. I believe the fees set forth in Section 6-18.07 are too high and could probably be successfully attacked. I would recommend a $10 appli- cation fee, $2 yearly renewal fee based upon no change in the original application, and a business license fee of $25 per year. Miller City of San Luis Obispo Gentlemen: Attached for your information are copies of Ordinances from the cities of 91 Cerrito, Beverly Hills and Pleasant Hill dealing with control of solicitors, canvassers and other door to door salesmen. The attached Ordinances allow this type of operation under various controls. According to the letter from the League, more cities prohibit door to door solicitation than allow it, all with Ordinances similar to the Ordinance presently enacted in San Luis Obispo. I have also sent for copies of the city of Fillmore's Ordinance dealing with control of this type of operation, as it is apparently the only city in our general area allowing door to door solicitation under strict control. I have given Mr. Houser and Mr. R. D. Miller a copy of this letter and attachments and if you wish, I will make arrange- ments for a meeting date and time at your convenience. Respectfully, J. H. THE CITY COUNCIL OF THE CITY OF PLEASANT HILL DOES ORDAIN AS FOLLOWS SECTION 1. FINDINGS AND PURPOSE. Based upon these findings, the City Council concludes that the unregulated and uncontrolled activity of solicitation, canvassing and peddling, affects the welfare of the City and is a public nuisance.
