MEMORANDUM
From: William M. Houser, Jr., City Attorney'te_-
To: Councilman Donald Q. Miller
Councilman Emmons Blake
J. H. Fitzpatrick, City Clerk
Attached is a copy of the ordinance for the City of Beverly Hills, con-
trolling solicitors and peddlers, which is of the basic type I would
recommend for your consideration.
I believe the fees set forth in Section 6-18.07 are too high and could
probably be successfully attacked. I would recommend a $10 appli-
cation fee, $2 yearly renewal fee based upon no change in the original
application, and a business license fee of $25 per year.
The Police Chief should be permitted at least ten (10) days for the in-
vestigation, and some appeal provision to the Council for refusal or
revocation of the permit should be added.

City of San Luis Obispo
Gentlemen:
Attached for your information are copies of Ordinances
from the cities of 91 Cerrito, Beverly Hills and Pleasant Hill
dealing with control of solicitors, canvassers and other door
to door salesmen. The attached Ordinances allow this type of operation
under various controls.
According to the letter from the League, more cities
prohibit door to door solicitation than allow it, all with Ordinances
similar to the Ordinance presently enacted in San Luis Obispo.
I have also sent for copies of the city of Fillmore's
Ordinance dealing with control of this type of operation, as it
is apparently the only city in our general area allowing door to
door solicitation under strict control.
I have given Mr. Houser and Mr. R. D. Miller a copy of
this letter and attachments and if you wish, I will make arrange-
ments for a meeting date and time at your convenience.
Respectfully,
J. H. FITZPATRICK
CITY CLERK

THE CITY COUNCIL OF THE CITY OF PLEASANT HILL DOES ORDAIN AS FOLLOWS
SECTION 1. FINDINGS AND PURPOSE.
The City Council finds that the unreg%a ated practice of
solicitation, canvassing, and peddling is a nuisance in
rhat:
(11 The activity is often carried on at night causing
annoyance to residerrs and intruding into their
privacy,
(2) The -e—ods :sed nv se-e of those engaged in the
act -y cai,se apprehension;
(3) The ac• •n cne wric can be used as a front
or cover fo- ga.,.l-q access to prem, ses for the
perpose of e^.gaa:-q in criminal activity; and
(4) the ma:.:re of -me activi•y pewits those to engage
.n it and leave t-e City before they become widely
known and a-ables 'her, TO avoid complying with the
Ia.,
(5) Persons engaged in this activity may be non-
residents and with no fixed or permanent place
of business and the regulation of them through
the licensing for business does not give the City
sufficient control to correct the abuses in this
activity.
Based upon these findings, the City Council concludes
that the unregulated and uncontrolled activity of
solicitation, canvassing and peddling, affects the
welfare of the City and is a public nuisance. It is
the purpose of this ordinance to define the activity
sought to be regulated to impose upon those seeking
to engage in it, conditions and requirements which
will permit the City to protect the welfare of its
citizens. and prevent irtrusion into their privacy,
and to regulate he act;vity to prevent abuses of it.

Dear Fitz:
I was somewhat embarrassed to discover today a note
to myself that I had written at the time we talked
about a month ago. It was supposed to remind me to
send you a copy of the section of the Santa Barbara
business license ordinance taxing for -hire trucking.
Here it is, with my apologies for tardiness.
I caught a fleeting glimpse of you at the Biltmore
entering an elevator during the League Convention,
but I was unable to close the gap in order to say
hello. I hope all is going well with you. Alan
Anderson sends his regards.
You" sincerely,
