All the above facilities shall be installed in the locations designated and to v e plans and speciricstions on file and approved by said City Lngineer. -1- The lines and grades for all of said improvements shall be established by the Subdivider in accordance with said approved plans and specifications. The Subdivider agrees that the work of installing the above improvements &hall begin itthin thirty (30) diVa from the date of recording of the final rap, and that the work shall he completed within twenty-four ( 24 ) months of said recording date, provided that if completion of said work is delayed by acts of red, strikes or other factors or elements beyond the control of the Subdivider, Subdivider shall have an additional period of time equivalent to ouch period of delay in which to complete such work. The Subdivider does also agree to comply with the following conditions established by the Planning Commission and/or the City Council: 1. Grant lot depth exceptions on Lots 2 - % L•lock C and Lots 1 and 2, block F'. 2. Grant grade exception of 10% plus, .!here needed. 3. Minor drainage wit:in the subdivision shall be placed underground or carried in the streets. 4. Prior to final acceptance of the subdivision all lot corners shall be monumented. 5. A hillside street section will be permitted at the westerly licit of Highland Drive, on 0skrid;..e Drive, and on the northerly portion of Al -Hill Drive. E. All lots which do not drain to the street shall have a concrete channel at the lower portion to provide positive drainal*e to the street. 7. As provided in the San Luis Obispo Municipal Code, Section 7500, Chapter 5, the Subdivider shall deposit with the City the awn of $1470 based upon a charge of $35 per sanitary sewer service connection, as payment for use of existing sanitary sewer transmission facilities. 8. The city agrees to accept maintenance of the eight inch (8") water line running up Highland Drive to the concrete tank, and also agrees that the tentative grade established for this portion of Highland Drive is satis- factoryv and that the tentative alignment is satisfactory. f--%4x ). Reference 1s hereby made to that certain Agreement between the parties hereto, dated July 21, 1958, which is hereby incorporated by referenes. They will dedicate the existing concrete tank together with an easement for the location of the same to the City for use by the City in its water system. Both the tank and the site shall be subject to reversion, in the event the City ceases to use them as part of its water system. In addition thereto, they will agree to provide another site, at a higher location, in the event the City ceases use of the present tank and site. This further site would, of course, be subject to the same reversionary clause as the present site will be. 2. They will grant to the City a site for a pump- ing station in the vicinity of Patricia Drive and Al -Hill koad or Felmar Road, which site shall be large enough to accommodate a pumping station which may be constructed by the City. 3. They will deed all other necessary easements for running pipe lines from the pumping station to the tank, subject only to the negotiation of a mutual agreement relative to the location of said lines. Mr. Ferrini has advised me that he does not feel that he is financially able to assume the obligation of instal- lation of any 8 inch line from the No. 3 subdivision to the 33,000 gallon concrete tank. He recognizes the fact that the City may find itself presently in some difficulty with respect to the acquisition of funds, and he has advised me that they would be willing to ad- vance up to $7,000.00 for the purposes of aiding in the installation of a line, provided that, some mutual, San Luis Obispo City Council - 2 - April 7, 1958 agreeable method of reimbursement can be settled upon. Merely by way of suggestion, it is possible that a "hook- up" fee could be charged which could be used to pay off the moneys advanced by Mr. Ferrini. Your letter of March 18, mentioned the matter of two alternative suggestions, one involving a smaller pumping station without fire fighting requirements being guaranteed. The other involving a larger Station which would guarantee fire protection. Mr. Ferrini naturally is interested in receiving all possible fire protection and, as a consequence, he is hopeful that the City, under the circumstances, will install the larger station. Your letter also mentioned the matter of meeting other conditions relative to the establishment of the subdivision, namely, solution of the sewer problem. It is my understanding, that the City proposes to make a condition of the acceptance of this subdivision, the requirement that the subdivider pay for the installation of a larger sewer line in an area not located within the proposed subdivision but located at some distance there- from. It is my understanding that this line was origin- ally paid for by Mr. Ferrini, Sr., and that it is now the position of the City that the line is no longer sufficiently large enough to adequately provide for other users at a point beyond the outside of the subdivision in which this line was originally installed. It is Mr. Ferrini's feeling that the line installed in accordance with the recommendations of the then City Engineer and should certainly have been designed by him to take care of all foreseeable future improvements in the area beyond that being serviced by the line. Had this been done, a slightly larger cost would have been paid by Mr. Ferrini. However, the circumstances which would require the Ferrinis to pay for the installation of a newer larger line, at this time, do not seem to be fair, in view of the fact, that the error in the compu- tation was that of the City's employee at the outset. San Luis Obispo City Council - 3 - April 7, 1958 Accordingly, Mr. Ferrini has indicated that he does not feel that he can economically meet the obligation which would be imposed on him, if he were required to pay for the installation of the new larger line, and still dispose of the lots in the proposed subdivision. If there is any basis for agreement in the face of the above suggestions, we would be happy to sit down with the legal department of the City and attempt to work out a mutually satisfactory agreement covering the various details which are not herein set forth in full. L. Ferrini, has raised the question of who shall bear the cost of pumping and storage facilities that will be necessary to supply water to subdivisions which are to be located at elevations which cannot be served water without the installation of pumping and storage works, General Discussion of the Problem. In order to keep this discussion within reasonable limits, it is necessary to omit a great many details that might be logically included. However, there are general trends in the economic situation presently facing the Water Department that must be borne in mind while a decision is being reachedn 1. A large (art of future water revenues will be used to finance the itlhale Rock Project, 2„ The distribution system has been expanded until, today, the system made expensive new transmission and feeder main facilities --non revenue producing --to be firanced from revenues., 3. An appreciable part of the old existing system requires large capital outlays to replace substandard and worn out mains if adequate domestic and fire service standards are to be reached and maintained„ 4. The public is demanding a better water service without demonstrating a willinpnass to pay more for the product, therefore, the department will be called upon to extend mains for distances which cannot be afforded at today's rates and expensea, 5. Filtration capacity will have to be increased In the not se distant future, Consideration of the foregoing and bearing in mind that a water distribution system must be an integrated entity, and not a series of independent units designed and constructed without regard to the ultimate form and balance of an integrated system, it is apparent that each new extension must stand on its own merits.
