California". as approved by the City Council# on the 15th day of 3eptenbers 1958,
subject to approval of all engineering plans and specifications by the City Engineer.
WHEREAS. the Subdivider desires that said Subdivision Map of avid Tract No.
120 be accepted and approved an a final nap pursuant to the Subdivision Regulations
and Ordinances of the City of San Luis Obispo. and
WREI?IAS. it is a condition of said regulations and ordinances that the Sub-
divider agrees to install the street improvenente and utility lines and facilities
as set forth on the plans therefor.

agree to construct and install the follwinp subdivision improvements in accordance
with said subdivision ordinances and regulations, and in accordance with approved
plane and specifications on file in the office et' the City Engineer, City of San
Luis Obispo# to wits
1. CURBS. CUTTERS and SIDbULES
2. STREET BASE and SURFACING
3. WATER MAINS and SEWER MAINS# including sewer laterals to the property
line sod water services to the curb atop.
4. CONCRETE CROSS PUTTERS
5. ORNAMENTAL ".ETAL STREET LIGHTS
6. LIGHT and GAS EACILITM: A letter from each public utility to the City
Engineer# stating that such services will be provideds is considered to
be satisfactory compliance with said ordinances and regulations.
7. ANY and ALL 07NcH IMMI.LN VENTS shown on plans or required by City regulations.
All the above facilities shall be installed in the locations designated and to
v e plans and speciricstions on file and approved by said City Lngineer.

The lines and grades for all of said improvements shall be established by the
Subdivider in accordance with said approved plans and specifications.
The Subdivider agrees that the work of installing the above improvements &hall
begin itthin thirty (30) diVa from the date of recording of the final rap, and that
the work shall he completed within twenty-four ( 24 ) months of said
recording date, provided that if completion of said work is delayed by acts of red,
strikes or other factors or elements beyond the control of the Subdivider, Subdivider
shall have an additional period of time equivalent to ouch period of delay in which
to complete such work.
The Subdivider does also agree to comply with the following conditions established
by the Planning Commission and/or the City Council:
1. Grant lot depth exceptions on Lots 2 - % L•lock C and Lots 1 and 2, block F'.
2. Grant grade exception of 10% plus, .!here needed.
3. Minor drainage wit:in the subdivision shall be placed underground or
carried in the streets.
4. Prior to final acceptance of the subdivision all lot corners shall be
monumented.
5. A hillside street section will be permitted at the westerly licit of
Highland Drive, on 0skrid;..e Drive, and on the northerly portion of
Al -Hill Drive.
E. All lots which do not drain to the street shall have a concrete channel
at the lower portion to provide positive drainal*e to the street.
7. As provided in the San Luis Obispo Municipal Code, Section 7500, Chapter 5,
the Subdivider shall deposit with the City the awn of $1470 based upon a
charge of $35 per sanitary sewer service connection, as payment for use
of existing sanitary sewer transmission facilities.
8. The city agrees to accept maintenance of the eight inch (8") water line
running up Highland Drive to the concrete tank, and also agrees that the
tentative grade established for this portion of Highland Drive is satis-
factoryv and that the tentative alignment is satisfactory. f--%4x
). Reference 1s hereby made to that certain Agreement between the parties
hereto, dated July 21, 1958, which is hereby incorporated by referenes.
In accordance with that certain agreenent dated June 12, 1956, the subdivider
shall reiibuurse the City .679.51 for the encase capacity of water ILies previously
paid for by the City for the benefit of future subdivisions.

The Subdivider hereby attaches hereto, and as an integral part hereof, and
as security for the performance of this agreement, a good and sufficient bond
sipped and executed by the Subdivider and owner of the lard, as principals and
by his surety, in favor of the City of San Luis Dbispo, and conditional upon the
faithful performance of this agreements which said bond is in the amount of
S80s000 and which is in the amount of the estimated cost of said improvements.
Said Subdivider shall deposit with the City the am of a1200s free which
deposit the City will pay the salary and expenses of on inspector or inspectors
to inspect installation of off site improvements and certify th..t they lave been
completed in accordance with the plans and speci Ycations. Any unexpended monies
will be returned to the Subdivider. In the event the inspection fees exceed the
sum of .1200, the difference is to be paid by the Subdivider up to a maximum of
,2400. The City reserves the sole discretion in determing the amounts to be paid
for salary and expenses of said inspector or inspectors.
Article 9, Chapter I of the ben Luis Obispo Municipal Code, entitled "Sub-
division" - All plans and specifications on file with said City Sngineer as a ,art
of said Subdivision 199p, and all other documenta filed with the City by the Sub-
divider are hereby referred to for further particulars in interpreting end defining
the obligations of the Subdivider under this agreement.
In the event that the City desires to modifys enlarge, or eaterd my of the
improvements herein referred to$ or shown on the approved plans, end if :.aid modifi-
cations, enlargements or extensions are in excess of those required and as approved
by the Uif�ineer, it is expresel,y agreed that the City will pay the sctu,l additional
cost of said modifications enLiqrgements or extensions.

It is agreed that the Contractor will furnish copies of the successful bidder's
contract unit prices and total bid prices for all of the improcesents herein referred
to.

California, has considered the final map for Ferrini Heights No. 3
of the San Iuis Obispo Municipal Code; and
WHEREAS, the said Planning Commission finds that the final map
has been prepared in conformance with the tentative map as approved;
NOW THEREFORE be it
RFSOLVED, that said Planning Commission hereby recommends the
approval of said final map, subject to the approval of the City

Gentlemen;
I have discussed with Mr. Ferrini, the matter of
your letter of March 18, 1958, and he has indicated that
by way of compromise, they would be willing to do the
following things:
1. They will dedicate the existing concrete tank
together with an easement for the location of the same
to the City for use by the City in its water system.
Both the tank and the site shall be subject to reversion,
in the event the City ceases to use them as part of its
water system. In addition thereto, they will agree to
provide another site, at a higher location, in the event
the City ceases use of the present tank and site. This
further site would, of course, be subject to the same
reversionary clause as the present site will be.
2. They will grant to the City a site for a pump-
ing station in the vicinity of Patricia Drive and Al -Hill
koad or Felmar Road, which site shall be large enough to
accommodate a pumping station which may be constructed
by the City.
3. They will deed all other necessary easements for
running pipe lines from the pumping station to the tank,
subject only to the negotiation of a mutual agreement
relative to the location of said lines.
Mr. Ferrini has advised me that he does not feel that
he is financially able to assume the obligation of instal-
lation of any 8 inch line from the No. 3 subdivision
to the 33,000 gallon concrete tank. He recognizes the
fact that the City may find itself presently in some
difficulty with respect to the acquisition of funds,
and he has advised me that they would be willing to ad-
vance up to $7,000.00 for the purposes of aiding in the
installation of a line, provided that, some mutual,

agreeable method of reimbursement can be settled upon.
Merely by way of suggestion, it is possible that a "hook-
up" fee could be charged which could be used to pay off
the moneys advanced by Mr. Ferrini.
Your letter of March 18, mentioned the matter of
two alternative suggestions, one involving a smaller
pumping station without fire fighting requirements
being guaranteed. The other involving a larger Station
which would guarantee fire protection. Mr. Ferrini
naturally is interested in receiving all possible fire
protection and, as a consequence, he is hopeful that the
City, under the circumstances, will install the larger
station.
Your letter also mentioned the matter of meeting
other conditions relative to the establishment of the
subdivision, namely, solution of the sewer problem. It
is my understanding, that the City proposes to make a
condition of the acceptance of this subdivision, the
requirement that the subdivider pay for the installation
of a larger sewer line in an area not located within the
proposed subdivision but located at some distance there-
from. It is my understanding that this line was origin-
ally paid for by Mr. Ferrini, Sr., and that it is now
the position of the City that the line is no longer
sufficiently large enough to adequately provide for other
users at a point beyond the outside of the subdivision
in which this line was originally installed.
It is Mr. Ferrini's feeling that the line installed
in accordance with the recommendations of the then City
Engineer and should certainly have been designed by him
to take care of all foreseeable future improvements in
the area beyond that being serviced by the line. Had
this been done, a slightly larger cost would have been
paid by Mr. Ferrini. However, the circumstances which
would require the Ferrinis to pay for the installation
of a newer larger line, at this time, do not seem to be
fair, in view of the fact, that the error in the compu-
tation was that of the City's employee at the outset.

Accordingly, Mr. Ferrini has indicated that he does
not feel that he can economically meet the obligation
which would be imposed on him, if he were required to
pay for the installation of the new larger line, and
still dispose of the lots in the proposed subdivision.
If there is any basis for agreement in the face
of the above suggestions, we would be happy to sit down
with the legal department of the City and attempt to
work out a mutually satisfactory agreement covering
the various details which are not herein set forth in
full.

Dear Mr. Harris:
As a compromise settlement to the questions
arising in connection with the approval of Nerrini Heights
No. 3 subdivision by the city, the Council Las instructed me
to write you and make the following proposal: The city will
approve the tentative sap of the su'adivision, other oondi-
tions being met including satiaf;.ctory solution to the sower
problem, ate., provided that:
(1) Tou dedicate your existing 33,000 gallon
concrete tank together with an easement for location of same
to the city for use ir; its water system, both the tank and
site sub cat to reveralon if the city ceases to use them as
part of its water system.
(2) That you will agree to install an eight
inch lint from your No. 3 subdivision to said tank (without
necessarily receiving any rights to tap off said tight inch
line without further approval of future subdivision).

Road or Fel Mar load, which site shall be large enough to

Heights No. 3 subdivision but will not guarantee full fire flow
requirements for fire fighting purposes at this time.
As an alternate to the above, wa offer y ou the
opportunityof sharing with the city in the installation of '
larger pumping station which would come closer to providing _
required fire flows immediately. Your share would be approxi-
mately $7 000. All other conditions would remain the same,
but your iot purchasers would be receiving the benefits of a
first class system to begin with, and the city would be partici-
pating now instead of at some later date when finances and bui]►
up conditions warrant.
The Council favors the second alternate even
though it means additional expense to the city at this time.

The Problem
The necessity of providing pumping and storage facilities to serve Tract
No, 1200 a subdivision proposed by Mr. A. L. Ferrini, has raised the question of
who shall bear the cost of pumping and storage facilities that will be necessary
to supply water to subdivisions which are to be located at elevations which cannot
be served water without the installation of pumping and storage works,
General Discussion of the Problem.
In order to keep this discussion within reasonable limits, it is necessary
to omit a great many details that might be logically included. However, there are
general trends in the economic situation presently facing the Water Department
that must be borne in mind while a decision is being reachedn
1. A large (art of future water revenues will be used to finance the itlhale Rock
Project,
2„ The distribution system has been expanded until, today, the system made expensive
new transmission and feeder main facilities --non revenue producing --to be firanced
from revenues.,
3. An appreciable part of the old existing system requires large capital outlays
to replace substandard and worn out mains if adequate domestic and fire service
standards are to be reached and maintained„
4. The public is demanding a better water service without demonstrating a willinpnass
to pay more for the product, therefore, the department will be called upon to extend
mains for distances which cannot be afforded at today's rates and expensea,
5. Filtration capacity will have to be increased In the not se distant future,
Consideration of the foregoing and bearing in mind that a water distribution
system must be an integrated entity, and not a series of independent units designed
and constructed without regard to the ultimate form and balance of an integrated
system, it is apparent that each new extension must stand on its own merits.

not required to pay the cost, then an additional burden is thrust upon the old and
existing consumers„
Recommendation
The expense of water service, including the expense not only of facilities
fronting property, but also that portion of the entire system that pumps, carries
and stores an adequate supply of water for the property should be directed to
and be borne by the proper individual-- the property owner --who receives a direct
benefit.
