USE PERMIT REQUESTED: To amend conditional use permit allowing a sorority house. PROPERTY DESCRIPTION: On file in the office of Community Development, City Hall. GENERAL LOCATION: 1464 Foothill Boulevard GENERAL PLAN LAND USE ELEMENT: Medium -high density residential PRESENT ZONE: R-3 WHEREAS, said commission as a result of its inspections, investigations and studies made by itself, and in behalf and of testimonies offered at said hearing, has established existence of the following circumstances: 1. The proposed use, as conditioned, will not adversely affect the health, safety and welfare of persons living or working on the site or in the vicinity. 2. The use is appropriate at the proposed location and will be compatible with surrounding development. 3. The proposal conforms to the general plan and meets zoning ordinance requirements. 4. The proposed use is exempt from environmental review. Resolution No. 3071-87 Use Permit U1292 Page 2 NOW, THEREFORE, BE IT RESOLVED that application No. U1292 be approved subject to the following conditions: 1. Occupancy shall be limited to the Alpha Chi Omega sorority unless approved by the Planning Commission. 2. No more than eight people shall reside at the house at any time. 3. The applicant shall allow the city to verify occupancy of the house by allowing an inspection of the records or by a visual inspection of the premises. Any inspection shall be at a reasonable time and shall be preceded by a one -hour notice to the residents. 4. The site shall be maintained in a neat and orderly manner, to the satisfaction of the Community Development Director. All plant materials shall be maintained and replaced as needed. 5. If a reasonable complaint is received in writing by the Community Development Department, the process established by the City and the Interfraternity Council and Panhellenic Council shall be followed: * The complaint shall be forwarded to the Panhellenic Council within one week of receipt, for review and comment. The names of the people filing the complaint shall not be included without their consent. * The complaint, and the comments from the Panhellenic Council if received, shall be forwarded by the planning division to the Planning Commission for consideration at the commission's next available meeting. 6. The applicant shall install an enclosed trash area to the approval of the Architectural Review Commission. 7. The Chief Building Official and the Fire Marshal shall inspect the structure for code compliance. 8. No meetings, parties or other types of activities involving persons other than residents living on this site are allowed between the hours of 10 p.m. and 9 a.m., except as otherwise allowed by this use permit. 9. The applicant shall institute and maintain a neighborhood relations program similar to the attached Exhibit D. This plan shall include at least the following elements: Resolution No. 3071-87 Use Permit U1292 Page 3 * Annual training of all members in community relations. * A program to inform neighbors of upcoming events at the sorority house. * Submission of names and telephone numbers of responsible persons to the Community Development Department and to the neighbors within two blocks of the house. Responsible persons shall be available during all events and at reasonable hours otherwise, to receive and handle complaints. Evidence of implementation of said plan shall be submitted to the director for review each year. Failure to implement said plan may be grounds for revocation of this permit. 10. Events, including meetings, parties, or any other gathering of more than 16 persons on site, shall be limited to one per month, and shall be listed on a meeting and activities schedule, submitted to and approved by the Community Development Director in the fall of each year. Exceptions to this schedule must be approved by the Community Development Director. If the Director determines the change is significant and may have an adverse impact on the neighborhood, then it will be referred to the Planning Commission for consideration. 11. All activities held between the hours of 8:00 p.m. and 8:00 a.m., involving more than sixteen persons, shall be conducted entirely indoors. 12. Failure to comply with any of the above conditions, parking, or code requirements, or the conduct of the use so as to constitute a public nuisance or parking problem or so as to cause adverse impacts on the health, safety, or welfare of persons in the vicinity of this use is prohibited and shall constitute grounds for revocation of this permit. 13. Parking in the fire lane by sorority members or guests shall be grounds for use permit revocation. 14. The applicant shall submit a parking management plan to address parking for large gatherings, to the approval of Community Development Department staff. Failure of members of the sorority and invited guests to adhere to the approved plan shall be grounds for use permit revocation. All group gatherings involving more than 16 persons shall be held offsite until the parking management plan is in effect and submitted to and approved by the Community Development Director. Resolution No. 3071-87 Use Permit U1292 Page 4 15. A maximum of 100 persons or the maximum permitted by the building or fire code, whichever is less, may occupy the site at any one time. This occupancy limit shall be posted in the building at a satisfactory location, to the approval of Community Development Department staff. 16. This use permit shall be annually or if parking arrangements are significantly changed as determined by the Community Development Director. At that time, conditions may be added or modified, or the use permit may be revoked. 17. Greek letters shall be allowed on the building or fence in accordance with the Sign Regulations. The foregoing resolution was adopted by the Planning Commission of the City of San Luis Obispo, upon the motion of Commr. Duerk, seconded by Commr.
