Subject: Status of fraternity at 280 California Blvd.
As we discussed today:
1. The property at 280 California Boulevard may be occupied by any fraternity, so
long as all conditions of the enclosed City Council Resolution No, 5189
(concerning Use Permit U1099) are met. City approval for occupancy by a
fraternity other than Alpha Epsilon Pi (Condition #10) is not required. The City
Attorney's office has advised that this condition is not valid under Anza Parking
CorporgAlon vs. City of Burlin ame 1987 241 Cal. R tr. 175, 178.
2. The Greek letter sign (Condition #6) may be changed by the replacement of
existing, approved letters with letters of the new occupant, so long as the location,
type, and area of the sign do not change. No City approval is required for this
change of copy (SLOMC Chapter 15.40):
3. This department is obligated to investigate and make a recommendation to the
Planning Commission in response to any reasonable, written complaint concerning
the fraternity (Condition #5). Violation of any condition can be the basis for
revoking the use permit.
4. You should discuss with our Fire Department the issue of code compliance for
kitchen hood venting, which is independent of subletting the property (John
Madden, 781-7379).
5. The City's regulations concerning noise, other nuisances, or parking, and State
laws concerning behavior, are enforced independently of the occupancy by a
fraternity.
