RESOLUTION NO. 1872-82
WHEREAS the Planning Commission of the City of San Luis Obispo did con-
duct a public hearing in the City Council Chambers of the San Luis Obispo City
Hall, San Luis Obispo, California, on August 11,, 1982, pursuant to a proceeding
instituted under application No. U1048 by Sigma Kappa House Corporation.

To expand the Sigma Kappa Sorority House

WHEREAS said commission as a result of its inspections, investigations and
studies made by itself and in its behalf and of testimonies offered at said
hearing, has established the existence of the following circumstances:
1. The proposed project will not be detrimental to the health, safety and welfare
of persons living or working in the area.
2. The project is appropriate at the proposed location and will be compatible
with surrounding land uses.
3. The proposed project conforms to the general plan.
4. The proposed project meets zoning ordinance requirements.
S. The proposed project is categorically exempt from environmental determination.
6. A reduced street yard setback for parking lot along Wilson Street is determined
by the commission to allow for proper site distance for automobiles exiting
the driveway and is compatible with the neighborhood.

NOW, THEREFORE, BE IT RESOLVED that application No. U1048 be approved
subject to the following conditions:
1. No more than ten (10) persons shall reside at the house at any time.
2. A minimum of seven (7) on -site parking spaces and five (5) bicycle spaces to
city standards shall be provided and maintained at all times for intended
use.
3. Existing hedge along Wilson Street frontage shall be trimmed within 30 feet
of the intersection or removed to the approval of the Public Services
Department to meet hedge and fence height regulations.
4. The property shall be maintained in a clean and orderly manner. All plant
materials shall be maintained and replaced as necessary.
5. Use permit shall be reviewed by the Planning Commission at any time, if any
reasonable written citizen or Police Department complaints are received
by the city. In review of the use permit, the Planning Commission may
add, delete or modify conditions of approval or may revoke the use permit.
6. Greek letter sign shall be allowed on the building face or fence in accordance
with sign ordinance regulations. Free-standing signs are prohibited. Variation
to this condition may be considered if requested, reviewed and approved by
the Architectural Review Commission.
7. Applicant shall install an enclosed trash area to the approval of the
Architectural Review Commission.
8. The structure shall be inspected by the Chief Building Official and Fire
Marshal for code compliance pursuant to an application for inspection and
establishment of a maximum capacity by the Fire Marshal for the safety
of persons living in the building, and the posting of said occupancy limit
within the building, to the satisfaction of the city Fire Marshal.
9. Smoke detectors and fire extinguishers shall be installed to the approval
of the Fire Department.
10. Use as a sorority shall be limited solely to the Sigma Kappa Sorority. Any
other occupancy would require approval of the Planning Commission of an
amended use permit.
11. No meetings, parties or other types of activities involving persons other
than residents living on the site shall be allowed between the hours of
10:00 p.m. and 9:00 a.m.
12. Applicant shall allow the city, at any reasonable time, to verify that occupancy
of the house is limited to the residents, either by allowing an inspection of
the records or visual inspection of the premises, provided that said
inspection shall be preceded by notice to the residents of not less than one
hour.
13. All reasonable written citizen or Police Department complaints received by
the Community Development Department shall be forwarded to the representative

of the Interfraternity Council and Panhellenic Council for their review
and comment prior to review by the Planning Commission in accordance with
a complaint review process established between the city and the Interfraternity
Council and Panhellenic Council. Said review by representatives of the
Interfraternity Council and Panhellenic Council shall not include the
names of the -complaining parties unless said complaining parties consent
to the use of their names.
The foregoing resolution was adopted by the Planning Commission of the City
of San Luis Obispo upon the motion of Commr. Bullock, seconded by Commr.
Howard, and on the following roll call vote:
