Thank you Dan, I was typing up the email below as you responded. I told Hal I would visit the site and send a follow up email. As I’ve noted in the email below and Ernie Ball Trust needs
assurances that either full completion of the overland escape or a temporary solution is completed so that they are not liable for damages to their basin or to Avila ranch property.

Thanks for the call, as discussed I stopped by the site this afternoon to take a closer look. As Jerry pointed out, it seems like adjacent Avila Ranch lot grade is high. My site visit
supported this. As you can see in the attached Photos there is a stake for the headwall with an elevation of 114.23 which coincidentally coincides with the elevation of the proposed
spillway which is 114.23 as well. As discussed during design the spillway elevation was dependent on the FL grade within Earthwood lane at the inlet.
Based on what I saw in the field it looks like Avila Ranch added a berm along the property line and graded down to a swale flow line and then back up to the Pad. The swale flowline seems
to be at or above the proposed elevation of the weir spillway and the berm along the property line is clearly 1.5-2ft above the spillway elevation. This is best represented in photo
3.
As we discussed on the phone this afternoon there are two concerns:
1. Ernie Ball constructs the weir and Avila Ranch’s grade adjacent to the weir is higher, therefore runoff may be able to enter the basin from Avila Ranch. If this causes damage to
the basin slope, the Ball Trust should not be held accountable for repairing the basin.
2. Ernie Ball constructs the weir and Avila Ranch hasn’t completed the overland escape swale to the west and then south. If we get a storm event that breaches the weir and damages
Avila Ranch property due to the overland escape not being fully constructed, Ernie Ball could be held liable for the damages.
To resolve the concerns the Ball Trust needs Avila Ranch to complete the overland escape so that their drainage swale can handle emergency overflow from the Ball basin and insure no
cross lot drainage from their subdivision can flow into the Ball Basin. You mentioned Avila Ranch has submitted a phase 2 Grading Plan designed by Wallace Group which didn’t account
for the overland escape and that was a comment on their plan.
Jerry, in the meantime Hal has asked what your schedule is for completed the weir construction, could you please let us know?

Hi Perry – Thanks for the email and the heads up on this issue. You are correct that we have been working toward a solution for the overland escape for the low spot in Earthwood Lane,
and that the adjacent lot would be utilized for that drainage route. Thus far, I have not seen plans from RRM or the Avila Ranch team addressing that need. That requirement was restated
to the new Wallace Group team as part of my review of the early grading plan for the remainder of the Avila Ranch Grading Plan which is currently being developed.
Regarding the lot drainage, I agree with your position that the lot should not be such that drainage enters your basin or otherwise flows from south to north. I will keep this as a priority
and will touch base with the Robert Camacho regarding a solution on the short and long term.

Hope all is well. This email is to follow up my voicemail.
The Ernie Ball team is looking to wrap up the basin construction and build the approved weir along the shared property line with Avila Ranch. Tony shared with me that he was told the
city has yet to receive a revised plan from the Avila Ranch team which shows the overland escape directing runoff from along the shared PL westerly to and then south along their western
property line. It has also been brought to my attention that currently the lot adjacent to our basin is graded 1.5-2ft higher than our designed weir and there is concern that it will
direct runoff from the Avila Ranch Subdivision into the Ball Trust’s basin. I haven’t had a chance to visit the site to take a look for myself, but I wanted to get the conversation
started ASAP.
This is very concerning, if runoff from the Avila Ranch property enters out basin and causes damage, we do not want the Ball Trust to be on the hook for repairing the damage. Given we
are still in the rainy season, it is imperative that this gets resolved ASAP. When GTA finished up the revised basin overflow design and the plans were approved we were under the impression
the city would work with Avila Ranch to resolve their redesign. GTA shared our revised approved Plans with RRM back in November. I’ve left a message for Robert Camacho to discuss further.
Please confirm if the city needs an revised plan from Avila Ranch or if they are reverting back to the original approved plans with overland escape.
Please advise on how the city can help expedite this so that when we go to build the overflow weir the adjacent lot will be graded to the correct finished grade.
