After careful consideration I have approved the application, based on the following findings and subject to the following conditions: Findines• 1. As conditioned, the proposed modification will not be detrimental to health, safety, or welfare of persons working or living at the site or within the vicinity. The wireless telecommunications facility must comply with standards for limiting public exposure to radio frequency radiation. A radio frequency report submitted with this application demonstrates that estimated levels of public exposure are in compliance with these standards. A condition of approval (Condition 2) requires preparation and submittal of a post -construction radio frequency report that verifies that actual levels of exposure conform to these standards prior to finalization of construction permits to install the modified equipment. 2. As conditioned, the proposed facility complies with the site development and performance standards set out in Zoning Regulations § 17.86.290 (Wireless Telecommunications Facilities). 3. As conditioned, the modified wireless telecommunications facility is effectively camouflaged. The proposed replacement antennas and new radios are mounted in the same location on the existing facility, partly disguised to be less noticeable by their location on a light pole serving a ball field in Santa Rosa Park, and associated equipment is contained within an equipment shelter near the pole. 4. The project is exempt from the provisions of the California Environmental Quality Act (CEQA). It is limited to minor modifications of an existing facility, as described by CEQA Guidelines § 15301 (Existing Facilities). DIR-0464-2020 (190 Santa Rosa) Page 2 Conditions: Please note the project conditions of approval do not include mandatory code requirements. Code compliance will be verified during the plan check process, which may include additional requirements applicable to your project. Planning 1. Conformance to a raved plans and conditions. Final plans submitted for construction permits shall be in substantial compliance with the plans approved by this application. All conditions of approval for this project shall be listed on their own sheet within final plans (typically as Shcct 2 of plans). Reference shall be made in the margin of listed items as to where in plans each condition is addressed. Any change to the approved design, including any additional antennas, equipment, cabling and wiring, or other visible elements, changes to the location or orientation in which equipment is installed shall be subject to the review and approval of the Community Development Director, or Planning Commission, as deemed appropriate. 2. Radio Frequency Radiation Re ort Post Construction. Prior to final occupancy of the facility, the applicant shall submit to the Community Development Department a post - construction Radio Frequency Report which verifies that the actual levels of radio frequency radiation emitted by the facility substantially conform to the pre -approval Radio Frequency Report submitted with this application, and do not exceed current standards for permissible human exposure to radio frequency radiation as adopted by the Federal Communications Commission (FCC), as provided in Zoning Regulations § 17.86.290 (E) (14). 3. Camouflage and screening. Placement of the wireless telecommunications equipment installed at this facility as part of this project shall be limited to the locations on the light pole and in the equipment shelter comprising this facility, as depicted in approved project plans. The visible antennas and associated hardware shall be of a color consistent with the light pole on which they are mounted, muted and neutral in finish so as to be as unnoticeable as feasible, and shall be refreshed as necessary in response to weathering, fading, or other changes in color or appearance, to maintain consistency in color and general appearance with partly camouflaged design of the facility, to the satisfaction of the Community Development Director. 4. Signs, decals, and badges. Signage shall be limited to required safety and RF warning signage. The fewest number of the smallest permitted signs shall be used, of subdued colors and contrasts, and matte surfaces. Bright colors, highly contrasting colors, and reflective surfaces shall be avoided. Decals and badges on equipment shall be inconspicuous, or be painted over or removed entirely. Plans and drawings prepared for construction permits for this facility will include details about the type and location of required explanatory warning signs, and about decals and badges on equipment, sufficient to determine compliance with this condition and with applicable conventions and standards. Indemnification 5. The Owner and Applicant shall defend, indemnify and hold harmless the City or its DIR-0464-2020 (190 Santa Rosa) Page 3 agents or officers and employees from any claim, action or proceeding against the City or its agents, officers or employees, to attack, set aside, void, or annul, in whole or in part, the City's approval of this project. In the event that the City fails to promptly notify the Owner and Applicant of any such claim, action or proceeding, or that the City fails to cooperate fully in the defense of said claim, this condition shall thereafter be of no further force or effect. My action is final unless appealed within 10 calendar days of the date of the decision. Anyone may appeal the action by submitting a letter to the Community Development Department within the time specified. The appropriate appeal fee must accompany the appeal documentation. Appeals will be scheduled for the first available Planning Commission meeting date. If an appeal is filed, you will be notified by mail of the dale and time of the hearing. The Community Development Director's approval of this project expires after one year. On request, the Community Development Director may grant a single, one-year extension.
