Zachary Moody 667 Howard St San Luis Obispo, CA 93401 619-886-0114 moodyze@gmail.com May 16, 2023 Michael Codron Director, Community Development Department City of San Luis Obispo 919 Palm Street San Luis Obispo, CA 93406 Dear Mr. Codron, First, I am writing to request a director's review concerning the Notice to Correct Code Violation (Courtesy Warning), dated May 12, CODE-000085-2023 that my wife, Megan Roberson, and I received last night on May 15th. As this was the first time anyone has brought up this issue with us, we are very confused. Currently, our one shed is well within the 5-ft setback requirements from both northern and western property boundaries (please see included pictures that I took this morning with a tape measure). Maybe there is some confusion because no one from your code enforcement department (neither Nick Buckley, Steve Sheats, or anyone else) has contacted us to request access to measure. Unless your staff is going off of an untrustworthy neighbor hearsay, or someone trespassed and took measurements while the shed was still being constructed or moved due to landscaping, this makes no sense. Do your officers typically operate by giving out violation notices without contacting the property owners first? This could have been easily cleared up within a few minutes. Again, please see the pictures that clearly show our shed is more approximated 57' from each property boundary. Any of your staff is welcome to contact me and coordinate a time to stop by and measure for themselves. We own a 6" retaining wall and 4" of air/ dirt on the outside of the retaining wall. A current survey is on file with your department. Let me know if you have any further questions on this or need any further information. Please clear this violation from the system and any pertaining administrative matters as it does not apply. Second, I would like to address what appears to be very unfair treatment from your staff. Both my wife and I have written you in the past several times on this topic. We are collecting many examples of your staff making mistakes against us. We exchanged several emails about the last courtesy warning that became a violation fine even though the issue was corrected right away, your officers did not post a secondary warning as they stated, and your department tried to add on excessive fees to my building permit (which I was refunded). Now, we receive a haphazard notice for this non-existent issue, and in the letter it doesn't have our address correct (states 681 vice 667), nor does it have our zoning correct (states R-1 vice R-2). Additionally, we have seen zero progress with correction violations on our neighbors side (657/659 Howard St) that were reported Dec 15, 2022 (six months ago). Our neighbor continues to store items on the roofs of his sheds, of which 3 sheds are clearly not meeting the setbacks and appear less than 2 ft away (you can also see this in the pictures from my yard). So, instead of enforcing the code on our untrustworthy neighbor, your staff is spending time and effort to needlessly send us warning notices. I don't know what's going on over there or if my neighbor happens to be friends with one of your staff but it sure looks more and more like we are being treated completely unfairly. We feel we are being attacked because we got our new property surveyed last year and our neighbor doesn't like that he can't encroach on our property any longer. Just because someone has been here 30+ years doesn't mean that your staff should give him preferential treatment over new SLO residents that are just trying to fix up their newly bought property. We would appreciate it if you have a talk with your team and pull the string on what is really happening here. Please let me know if you have any questions.
