Santa Barbara, CA 93105 CERTIFIED, RETURN RECEIPT RE: NOTICE OF VIOLATION OF MUNICIPAL CODE You are hereby notified that this office has received citizen complaints that you have committed a violation of the City’s Municipal Code in the illegal removal of the California Oak tree on property at 1628 Nipomo street. _______________________________________________________________. No person shall willfully injure, disfigure, or intentionally destroy by any means any tree, except with permits described elsewhere in this chapter. [Violation of Section 12.24.150 (A3) of the City of San Luis Obispo Municipal Code]. The penalties for violating the above section are covered in the following section: Any person or contractor deemed responsible for damaging any tree in violation of this ordinance shall be liable for penalties to the city according to Chapter 12.24.170, Enforcement. (Section 12.24.150(E) of the City of San Luis Obispo Municipal Code) As you will notice in Section 12.24.170 (A1) you are liable for civil damages for the value of the trees that you removed, times two. The city arborist will compute the value of the tree using methods established by the International Society of Arboriculture. Please contact me by August 15th , 2021 so we can discuss this matter.
