RE: NOTICE OF VIOLATION OF MUNICIPAL CODE
You are hereby notified that this office has received citizen complaints that you have committed a violation of the City’s Municipal Code in the willfully disfigure 50-inch California
Sycamore Platanus racemosa tree on property at 234 Broad street.
No person shall willfully injure, disfigure, or intentionally destroy by any means any tree, except with permits described elsewhere in this chapter. [Violation of Section 12.24.150
(A3) of the City of San Luis Obispo Municipal Code].
The penalties for violating the above section are covered in the following section:
Any person or contractor deemed responsible for damaging any tree in violation of this ordinance shall be liable for penalties to the city according to Chapter 12.24.170, Enforcement.
(Section 12.24.150(E) of the City of San Luis Obispo Municipal Code)
As you will notice in Section 12.24.170 (A1) you are liable for civil damages for the value of the trees that you removed, times two. A calculation of the value of the tree using methods
established by the International Society of Arboriculture is enclosed with this notice.
