Mr. Combs, in his presentation to the Committee, seems to be making the case that prior plantings are acceptable as mitigation, and in lieu of fines. He states that this sends a message to future individuals. The only message that this sends is that if you don't like a permit denial, plant a few trees and remove the tree anyway and the City will consider the loss mitigated. Meaningful mitigation would have been a fine, planting of a large specimen in the backyard, or planting other trees throughout the neighborhood in an attempt to restore some of the lost canopy. This tree was 100 feet tall and over 36 inches in diameter. This lack of action by staff and the Committee deafly demonstrates that even the most egregious and repetitive examples of ignoring the MC will be tolerated.
