I’d try to find you in person but since I only work one day a week, that doesn’t seem a good option.  I’ve figured out the DRMO for the sights (all of the Aimpoint optics I’ve labeled DRMO) no answer needed here, just letting you know what I did.  Is there any other DRMO equipment that is assigned to officers that will need to be turned in when they leave other than the rifle optics? Please answer here.  Since there are three sets of duplicate Optic Serial Numbers on the list, are you both comfortable with me reaching out to the officers directly to find out which rifle and optic they actually have? Just let me know if it is okay to reach out to the officers myself or if you’d prefer to do that?  Amaya is on the list twice with two different rifles and optics. I can reach out to him too to find out which ones he actually has. Again, just let me know if you’d like me to deal directly with Favi.  Regarding the Bushmaster and the 2 Colts at the bottom of the sheet, what are they? Do they need to go into the inventory or are they just being used for spare parts? Please answer here. I think that is all I need. Please just answer after the question when you get a chance. On the front passenger door, the city logo has some damage/scratch leading to the front quarter panel. On the rear quarter panel on the passenger side is more white paint transfer. If you received this in error, please contact the sender and delete the material from any computer.  2 This the third recent incident I've seen that further lowers my opinion of not just the SLO city police's conduct, but of the  Major and city council's office as well. The first two incidents were the violent arrest of a homeless man last year, and  the follow‐up harassment of the observer that filmed the arrest. In each incident I've seen zero public comment from  the Mayor's office or the city council. Does the police chief not report to the mayor? I know a fellow citizen did follow up  with a city council member regarding the violent arrest of the homeless man, and was directly informed of the officer's  termination, but fail to understand why this information wasnt shared with the public directly. I also saw no follow‐up to  the allegations of harassment of the filming observer, after the police chief made flimsy claims that he was looking into  it, but believed the officers were on their way to a call, and eventually dismissed the charges as erroneous himself. Was  Officer Blake Etherton reprimanded at all for what appears to be quite blatant harassment?     For a city with such progressive leanings, and such broad support for a progressive mayor and council, I cannot  understand why there is such silence from you and the rest of the council regarding anything police related.  I  understand the police have a tough job and a critical role to play in our community. But they should not be immune to  criticism or investigation of their own.      Is there any feedback or comment you can provide to the community regarding this rash of incidents involving the SLO  police? Are we just to expect this sort of regular behavior from the SLO PD, and risk harassment and retribution if we as  citizens make such behaviour publicly known? The city deserves an answer from their elected representatives.      Regards  1 Taffe, McKenzie From:CityClerk Sent:Friday, March 24, 2023 8:28 AM To:squigley707@gmail.com Subject:cc Quigley (Police misconduct) Sean Quigley, Thank you for taking the time to contact the City Council on this issue. Realistically this gives us 6 certified FTO’s on patrol. B. Other non-certified FTO’s on Patrol include: 1-Inglehart 2-Etherton 3- Jessen – has expressed interest in not training, but is usually willing C. Other Non-certified FTO’s in special assignments include: 1-McCornack -SRO 2-Alexander -DET 3-JKoz – DET 4-Berrios – Motors 5-Walsh – Motors With Pelletier gone, , and Magana and Amaya going to special assignments, this essentially takes away 4 certified FTO’s on patrol that we previously had. We are anticipating two academy grads next month, one more CSO trainee soon, and likely 3-4 laterals within the next few months. There is a scenario where we end up with 7 trainees in the FTO program at the same time, in the next few months… in addition, we are expecting 4 entry level trainees from the academy in December. I have found that generally having twice as many FTO’s as trainees gives the program the room to train appropriately, given: vacations, unexpected leave, special assignment appointments, potentially a promotion or two, need for trainees to see nights and days, etc. I’m not necessarily suggesting we need 14 FTO’s (That would be great!) but I’m suggesting we start the conversation now about flying 2-3 spots (backfill Pelletier, Locarnini, Amaya, Magana). I think it would help the training program significantly; 2  Entry Level officers (2 next month, 4 in December) are a heavier lift for the program, and we need experienced FTO’s in place to train and evaluate them properly.  Lateral Officers (4 in the next few months) are often a great “first trainee” for a new FTO; the stakes are lower, and it is a good way to build successful experience.  If we added a few FTO’s now, we could utilize the incoming laterals in the next few months to build the new FTOs’ experience, and we would have a stronger training staff come December, when we get 4 entry level officers. I share the same concerns regarding the traffic stop and the stated interpretation of the California Vehicle Code with regard to this specific intersection and the lawful traffic flow. The issuance of this citation is currently under review by my office, and I hope to have this resolved with the gentlemen cited by Monday. I have solicited a complaint from the parties involved regarding any allegation of police misconduct and if that were proven to be the case is not tolerated and would be delt with in the most swiftest of terms. What I can share at this time and what the video does not explain, is that it appears that “SLO Observer” was scanning police calls, was enroute to the same police call as our officers, traveling on a single lane roadway and headed to the same location. The vehicle appears to be speeding and an effort is made to pace (follow) the vehicle to determine its speed and then they arrive at a red traffic signal together. A stop is made thereafter for what was thought to be a moving violation, which appears to be incorrect. This does not appear to be a case where a community member was just driving and we choose to follow him, the facts thus far tend to support they were in fact both driving to the very same location. Lastly, my staff and I absolutely support transparency, which is at the core of public trust. I have no issues at all with any community members filming or otherwise recording the actions and interactions with their police officers. Our officers have tens of thousands of interactions each year and most all are highly professional and highlight positive interactions. I welcome this level of accountability and in instances where we get it wrong, we will work immediately to resolve. I am happy to continue this dialogue with you so please feel free to call or email with any additional questions or concerns you might have around this issue. My apologies that in your elected positions, these matters come to your attention with regularity. From the very first video I have been 100% transparent with you and Council on the veracity of these videos as well as my high expectations of staff. We are not perfect and sometimes certainly find things that can be done better or minor errors in policy. However, you are correct this is an unrelenting campaign against the department to enflame and outrage people and profit from the anti-police sentiment which is alive and well on YouTube. This is why most all of his videos begin with “Tyrant cop” as this is the well understood dog whistle of 1st amendment extremists who pay lots of money to support this type of content. Of the dozens and dozens of videos he has posted on SLOPD, the only personnel complaint we have ever received is from the camera person himself. Even still, he filmed himself making the complaint to get views and subscriber income and he managed to successfully turn that encounter in to an unnecessary confrontation. Regardless of what we think is afoot here, I take each one of these extremely serious and I look into each for my own edification as I will with this one. However, I am already suspicious for a couple of reasons. One of the officers in the video had left our department several months ago. Next, this was a portion of police “body camera” footage supplied, I’m guessing, by the suspect himself. Lastly, the DA has thoroughly reviewed this incident and made the lawful determination the (minor) force against the resisting person and subsequent charges were legal as evidenced by him being remanded to jail for two weeks and thusly arraigned by a judge. Any use of force justified or otherwise is always disturbing to watch as it should be. What is even more troublesome are people selectively editing videoed incidents to promote unjustified alarm and concern. Given this person below in this email identified their self as a SLO resident, I never mind taking the time to send a personal response, but I am very hesitant to engage in this narrative nor continue to conduct exhaustive and damaging investigations based on highly biased and coordinated antigovernment efforts. Magana arrived at the station with his 10-15’s x 3 to complete the online pre- booking through ATIMS  With my assistance (so both of us doing the data entry on 8 total local warrants and fresh charges x 2), it took approximately one hour to complete the pre-booking through ATIMS  Officer Etherton and I then left the station for CJ at 1813 hours  We arrived at CJ ats 1822 hours  There was no one ahead of us in the sally port when we arrived at the jail (there also did not appear to be any other agencies inside the IRC waiting/finishing the booking process)  We then waited over an hour in the sally port with only one deputy coming out about 25 minutes into the wait to let us know they were working on it; other than the nurse who was sitting at his station inside the IRC; there did not appear to be anyone inside the IRC other than one tech visible at the front desk  At 1929 hours, the jail staff came out to start processing our 10-15’s  I believe you had called the jail and were told they did not have a nurse available at the time – for info, the nurse who ended up coming out was the same nurse we saw sitting at the nurses station in the IRC for the last 45 minutes we were waiting  In total from start to finish, the process meant we had three arrestees sitting in handcuffs in the back of patrol vehicles for over two hours; two of them started complaining of pain and medical issues due to the long wait Thanks again for your help…let me know if there is anything else I should pass along! Dickel, On 2/6/23 around 1830 hours, I arrived at the jail and contacted the staff through the intercom. I was advised there was quite a line up of vehicles in the sally port with no room for me. I sat outside the entrance gate for about 30 minutes. I did not see anyone leave the jail facility before I was let in. Once I was inside the sally port I noticed probation, Pismo PD and an inmate transfer van in the sally port. I spoke with probation who stated they had been inside the sally port for at least 2 hours. They had not seen anyone else being booked in at that time. The transport van stated they had been in there even longer than probation. Probation was told the jail nurse was too busy doing paperwork to book people into the jail. The transport van had 2 individual’s one of whom had thrown up several times, most likely for detoxing. The 2nd individual was complaining he needed to use the restroom. My 10-15 told me he needed to use the restroom and I advised the jail staff. The jail staff only let one of the 4 arrestee’s into the holding cell, in the interlock booking area. My 10-15 kept complaining and was becoming very agitated. He started to violently kick the rear passenger door, I was afraid he was going to break the door. I was able to get the 10-15 to stop kicking the door and I reassured him that I asked the jail staff to let him use the restroom. Eventually, the jail staff stated I could bring him in to use the restroom. However, it was too late because he urinated on himself. My 10-15 kept complaining about the lack of access to a restroom. He was threatening to sue for a lack of access to a restroom. He felt discriminated against as he was a disabled veteran. I was able to help keep him calm and I did my best to explain the situation. During the conversation it seemed his anger was geared more towards the jail. I left the jail around 2045 hours. Due to the excessive time I spent at the jail, I accumulated about 2.5 hours of overtime. I have been collecting information on the issues going on with the jails. These are all recent with the changes in their booking process and system. Here is a list of the common issues. On average officers take approximately 2 hours to book arrestees and at times 3 hours Long wait times to be let in the sallyport create issues o Jail staff refuse to let arrestees use the restroom while waiting in the sally port Arrestees have urinated and defecated in the back seats of our patrol vehicles o Potential law suite when an injury occurs to an arrestee who has had to sit in the back of a police car handcuffed for hours o Arrestees become combative due to being locked in the back seat of vehicles In one incident jail staff would not even answer the intercom when our officer needed assistance with his arrestee becoming combative. The officer had to call our dispatch to have them call the jail to get help with the combative arrestee. o Average 1 hour or more per arrestee to process once in the facility o Shift change/ count creates even bigger wait times between the hours of 1600-1900 Some officers have waited the 3 hours and then get turned around for med clearance Paperwork that was previously completed by jail clerks is now being filled out by officers which takes, depending on complexity, 30min to over an hour. For each warrant, it requires a warrant issue date, issuing agency, and reason for a warrant (these were all probation violations) so the primary charge was 1203.2. in the description, they require all the listing charges which caused the probation violation for each ex. 11377(a), 11364(a). This was required on each warrant and each one requires its own charge. During the process, I had to request a second unit so one 10-15 could use the restroom and the second stood outside my car in view due to her having asthma which flared up due to sitting in the back of the patrol car for so long. Once at the county, they had to sit in the vehicle for approximately 15 more minutes before being taken into the custody area and I was the only vehicle there upon arrival. The overall time once at the county jail was an hour and ten minutes to book two people. Issues I have seen recently are where there are multiple agencies with arrestees. Two weeks ago, I took a suspect in for a felony arrest and there were 6 other people in front of me. I believe we were in waiting for approximately 2.5 hours. During this time neither one of us had access to a restroom. Luckily my 10-15 was compliant, so I was able to open his door so he could at least stretch his legs. Also as Johansen mentioned. Wait times can be prolonged due to shift change and staggered shift change from nurses to correctional deputies. This usually occurs at the end of the shift which results in delayed wait times at EOW and even longer OT times if the arrest is made on a weekday and a report is due before going home. I have planned on speaking with the other cities to see how their process has been going, but it has been very difficult for our team. So much so we are having discussions about having to hire custody officers or make some difficult decisions about what we arrest for, this won’t be popular with our community members. My fear is that some of these issues could expose our agency and possibility the SO to civil liability issues. We are having arrestees urinate and defecate in our vehicle because they are not being permitted to use the restroom at the SO. I am not sure if you were hearing any of these same concerns internally, but I wanted to let you know what some of the challenges have been from our perspective. Do you anticipate any changes to the rollout or see any areas of relief coming?
