Walter, as Grantors, hereby grant to the CITY OF SAN LUIS OBISPO, a chartered municipal 'corporation, as Grantee, the following easement in the City of San Luis Obispo, County of San Luis Obispo, State of California, to wit: APN #53- 041 -23 A permanent easement to maintain, repair, and improve the creek channel on a portion of Lot 21 of the San Luis Obispo Suburban Tract, in the County of San Luis Obispo, State of California, according to the map thereof recorded February 7, 1906, in Book 1, page 92 of Records of Surveys,.in the office of the County Recorder of said County, and as conveyed on January 13, 1978 by the deed recorded in volume 2040 of Official-Records at page 719 in the office of the County Recorder of said County described as follows: Beginning at the most northerly corner of said lot 21; thence South 26° 35' West, 379.91 feet; thence South 28° 40' East, 98.37 feet; thence North 74° 44' 10" East, 202.00 feet; thence North 20 5' West, 194.00 feet, thence North 26° 35' East, 138.00 feet more or less to the northeasterly line of lot 21; thence along said northeasterly line north 64° 33' West, 134.00 feet more or less to the point of beginning. PROVIDED, FURTHER, that this easement does not allow enlargement of, or major improvements to, the creek channel within the easterly 15 feet of said easement for its full distance; and PROVIDED, FURTHER, that this easement does not grant public access to the easement area. Easement to be irrevocable by the party of the first part and their heirs, executors, administrators,.agents or assigns and shall include the general right of access, via paved driveways and parking areas on said property, from public streets to the .subject easement as required to properly maintain the creek and creek banks.
