WALTER BROTHERS CONSTRUCTION COMPANY, INC., a corporation, as Grantor,.
hereby grants to the CITY OF SAN LUIS OBISPO, a chartered municipal corpor-
ation, as Grantee, the following easement in the City of San Luis Obispo,
APN #53= 041 -28
County of'San Luis Obispo, State of California, to wit: 53- 041 -29
A permanent easement to maintain, repair, and improve the creek.
channel on that portion of Parcels 1 and 2. of Parcel Map SLO-
71 -111 as shown in Book 7, page 35 of Parcel Maps in the Office
of the County Recorder of San Luis Obispo County, State of
California, lying westerly of the following described line:
Beginning at -the most northerly corner of lot 21 of the San Luis
Obispo Suburban Tract; thence South 640 33' East along the line
between lots 21 and 22 a distance of 137.18 feet to the True
Point of Beginning; thence North 670 3' East, 181.40 feet, thence
North 360 27' East 69.00 feet more or less to the most northerly
line of Parcel 3 of Parcel Map SLO -71 -111 as recorded in Book 7,
Page 35 in the office of the County Recorder; thence North 1$° 27'
East, 147.19 feet more or less to the most northerly line of Parcel
2 of Parcel Map SLO -71 -111.
PROVIDED, 'HOWEVER, that this easement does not allow enlargement of,
or major improvements to, the creek channel within the easterly 15 feet of
said easement for its full distance; and
PROVIDED, FURTHER, that this easement does not grant public access to
the easement area.
Easement to be irrevocable by the party of the first part and their
heirs, executors, administrators, agents or assigns and shall include the
general right of access, via paved driveways and parking areas on said
property, from public streets to the subject easement as required to properly
maintain the creek and creek banks.
