Contractor accepts the terms and conditions stated above as full and final settlement of any and all claims arising out of or related to the
subject of this Change Order and acknowledges that the compensation (time and cost) set forth herein comprises the total compensation
due for the work or change defined in the Change Order, including all impact on any unchanged work.
By signing this Change Order, the Contractor acknowledges and agrees that the adjustment to the Contract Time and Contract Price
includes full compensation for all Work required by the Change Order, including compensation for any acceleration or interruption of
schedules, extended overhead costs, delay, and all impact or cumulative impact on the Project. The Contractor hereby releases and agrees
to waive all rights of any kind whatsoever to file any further claim or request for equitable or contractual adjustment of any type, for any cause
that may arise out of, or as a result of, this Change Order and/or its impact on the remainder of the Project.

Contractor Change Proposal 259
PCL requested a time extension due to the extraordinary circumstances of the past two and a half
years. Unforeseeable conditions that have had widespread effects throughout the economy created a
difficult environment for construction. In particular, the remarkable inflation, widespread supply-chain
interruptions, and shortages of skilled labor affected the project profoundly.
The Contract does allow for an equitable adjustment of time for unanticipated causes beyond the
control of the Contractor [General Conditions Paragraph 4.05 C.]. While it is difficult, if not impossible,
to precisely quantify the delays due to these unprecedented events, the City recognizes undeniable
impacts and agrees to non-compensable extensions to the Contract Times as follows:
This change resolves all time-related impacts from the start of construction to the executed date of this
Change Order, with the exception of possible delays related to removal of contaminated soil at
Structures 72, 73 and 83 and programming changes affecting PLC-53. These issues will be evaluated
further.
This time extension shall be the sole remedy for these delays.
