RESOLUTION NO. 4048 (1979 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO AUTHORIZING QUITCLAIM OF CITY CREEK ACCESS
EASEMENT
WHEREAS, staff has recommended that the City quitclaim to the underlying
property owners at 2900 and 2930 McMillan Avenue, a certain 12 foot wide creek
access easement;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of .San Luis Obispo
'as follows:
SECTION 1. That City interest described in the attached quitclaim deeds be
conveyed to the parties named in those deeds and that the mayor be authorized to
execute the deeds on behalf of the City.
SECTION 2. The City Clerk is hereby directed to record the originals of these
quitclaim deeds with the Office/ of the County Recorder.
On motion of Councilman Dunin seconded by Councilman Bond
and on.the following roll call vote:
AYES: Councilmembers Dunin., Bond, Billig, Jorgensen and Mayor Cooper
NOES: None
ABSENT: None .
the foregoing Resolution was passed and adopted this 4th 'day of December, 1979.

SUBJECT: Quitclaim of Creek Access Easements
2900 & 2930 McMillan Avenue
We received a request from Mike Emmons property owner at 2930
McMillan Avenue.,to quitclaim an existing creek access easement
which no longer serves a useful purpose (see attached sketch).
The adjacent property owner was allowed to construct storage
buildings over the easement within his parcel in exchange.for
a 12 -foot wide easement utilizing the driveway between the
buildings. Since the original easement straddled the.property
lines (6 ft on each side) the remaining "clear" easement has
been rendered useless.
.Therefore, .I RECOMMEND that the Council quitclaim the original
access,..easement. The creek easement at the rear will still
remain.

In the Initial,minor subdivision,'my parcel A, and my neighbor's
.parcel L., both Granted the city a six fool creek access
ease.r.ent. Subsequently, parcel B has built in their six foot
;ase7ient,. and given the city the full 12' access through the
middle of -their parcel. The remaining six foot easement on my
parcel fl has no functional purpose.
Please inform me of anv additional action that must be undertaken
to remove the six foot, easement .
