ZIMARIK / COUNTY RECORDER DIME I — -- 1 1 •30AM COVENANT TO INSTALL PUBLIC IMPROVEMENTS'UPON REQUEST OF CITY A.P,.N. 5.3- 193 -09 Whereas, the undersigned own certain real property commonly known as 2900 Broad Street, and Whereas, the undersigned have requested temporary exception by the City Planning Dit4 of installing certain public improvements on upon execution of a covenant by the property said improvements at such time in the future same. and been granted a !cto.r ;. from the requirement said property conditioned owner agreeing to install as the City may request NOW THEREFORE, in consideration of the granting of permission to temporarily defer installation of certain- public improvements consisting of: 150 feet of curb, gutter, 6 foot sidewalk, and one half street paving along the southerly right -of -way of Mutsuhito Avenue from the intersection of Broad Street and Mutsuhito Avenue 150 feet northeasterly along the southerly right -of -way of Mutsuhito Avenue. the undersigned owner(s) of property hereinafter described hereby covenant with the City of San Luis Obispo to install all of said public improvements without cost to City upon thirty (30) days written notice from the City of San Luis Obispo requesting that said improvements be installed. Said 'property is located in the City of San Luis Obispo, County of San Luis Obispo, State of California, and is described.as follows: 1. Legal Description Parcel number 1 of Tract number 365; recorded in Book 7 of Maps at Page 25 in the office of the San Luis Obispo County Recorder, -San Luis Obispo, California. EXCEPT: That portion acquired for Broad Street widening by the State of California, as recorded in Book 1806 of Deed at Page 727 in the office of said County Recorder. This covenant shall run with the land and shall .be binding. upon the undersigned owners, their.heirs, executors, administrators, and assigns.
