FROM : Derek Johnson, Community Development Directo r BY : Marcus Carloni, Assistant Planne r SUBJECT : Public Hearing Item No . 1 ; Appeal of the SLO Brewing Company relocatio n project at 736/738 Higuera Street (A 57-12) This memo responds to several questions related to the SLO Brewing Company appeal . Who owns the proposed location for SLO Brewing Company 736/738 Higuer a Street? The 736/738 Higuera Street location is owned by Hamish Marshall and Todd Newman under a limited liability company known as San Luis Downtown Management . Was there an Environmental Impact Report prepared for this project ? An Environmental Impact Report was not prepared for this project . The project i s categorically exempt from environmental review under Class 1, Existing Facilities , Section 15301 of the California Environmental Quality Act Guidelines because th e project proposes the relocation of a business into an existing building with no overal l increase in floor area. The project includes modifications to an existing master-liste d building and staff is working with the applicant to ensure these modifications ar e consistent with City policy and the Secretary of Interior's Standards for the Treatment o f Historic Properties . If the appeal is denied and the Use Permit is approved, the propose d modifications to the Carrisa Building will be reviewed by the CHC and ARC . If the CH C and ARC determine the project consistent with City policy and the Secretary of th e Interior's Standards, an Environmental Impact Report will not be required . Was there any requirement for loss of housing or office space to be mitigated by th e applicant ? The 736/738 Higuera Street location contains ground level retail space and second leve l office space proposed to be converted to a ground level restaurant with late-night alcoho l service and a second level nightclub ; both are conditionally allowed uses in th e downtown commercial zone . The applicant was not required to provide mitigation fo r removal of the second level offices because the City does not have a policy fo r preservation of office space . No housing exists at the subject location . Council Memo – SLO Brew Appeal (PH-1 ) Page 2 of 2 Did the noise analysis include noise from the roof level patio and impact to Missio n Plaza ? The sound level assessment prepared by the applicant's noise consultant includes a n analysis of the roof level patio and the potential noise impact across San Luis Obisp o Creek and into Mission Plaza . Figure 5 of the Distance Study Addendum on page PH1-5 0 of the Council Agenda Report (Attachment 5) compares : 1) rooftop operation assumin g no persons present at the rooftop or on the subject property, and 2) roof level operatio n assuming patron voices, recorded music and patrons queued on the subject property .A comparison of these two acoustic simulations illustrates no noise effect on ambient nois e levels at the Mission Plaza, and a 1 decibel increase to ambient noise along the creek - walk . As shown by the applicant's sound level assessment, the roof level patio wil l comply with the City's Noise Ordinance . The noise increase along the creek walk also complies with the City's Noise Ordinance . An evaluation of noise is provided under th e Noise section of the Council Agenda Report pages PH1-5 and PH1-6 . Were the neighboring businesses consulted ? For the July 11, 2012 Planning Commission hearing Community Developmen t Department staff posted a legal ad in the SLO Tribune and mailed postcards to a 300 foo t radius of property owners and tenants from the subject location and posted a publi c notification poster on the storefront window of the subject location . The City Clerk's office posted public notification for the September 25, 2012 City Council hearing . The applicant provided outreach to the neighboring businesses and residents as follows : July 3, 2012 – Applicant public outreach meeting at SLO Brewing Company (111 9 Garden Street) to neighboring businesses along both sides of Higuera from Broad Stree t to Chorro Street . July 10, 2012 – Applicant presentation at Downtown Association Board Meetin g July 13, 2012 – Applicant communication to neighboring residents who spoke at th e Planning Commission hearing held July 11, 2012 . Were alternative locations for the SLO Brewing Company relocation considered ? Alternative locations for the SLO Brewing Company relocation were not presented t o staff by the applicant .
