Is a categorical exemption correct ?
Discussion : This section describes the class of projects wherein the proposed activity will involve negligible or n o
expansion of the use existing at the time the exemption is granted . Application of this exemption, as all categorica l
exemptions, is limited by the factors described in section 15300 .2 . Accordingly, a project with significant
cumulative impacts or which otherwise has a reasonable possibility of resulting in a significant effect does no t
qualify for a Class 1 exemption .
My overall opinion: approve with new conditions and bring back November 20 if possible .
--will the new facility have a new liquor license? Or, will it be transferred from SLO Brew ?
--expansion of capacity? Or maintain the same capacity as Garden Street location ?
--If same capacity, include retail on street level and office upstairs ?
--Rooftop use? If yes, location of tables on rooftop? If yes, amplified music ?
--Amplified music on patio? If yes, same hours as Creeky Tiki ?
--Hours of operation of events, restaurant, bar, rooftop ?
-- 6am opening on special days, St Patrick's etc ?
--Serving alcohol at concert stops one hour before end of last show ?
--Are vibrations and noise from low bass contained within auditorium ?
--Tree replacement, 3 to 1 on site or Downtown ?
--Railing to prevent falling into creek and to shield creek itself from light ?
--Patio lighting not to effect creek itself or pollute night sky .
--Parking in lieu fees correct, given increased capacity??
--Queuing through mission plaza (shuttles from parking structure?)
--Coordination with events scheduled at Mission Plaza like the Network ?
--Indemnification re bridge use ?
--one year review by Planning Commission?
