OFFER TO DEDICATE
THIS OFFER TO DEDICATE, made the 10th day of May 19 85 , by
OWEN.F. BETTS & CHRISTINE'& BETTS of the County of
San Luis Obispo , State of California, hereinafter termed Offeror:
WHEREAS, said Offeror desires to make an offer to dedicate, irrevocably,
to the public, an easement .for public road purposes, which offer may be
accepted at any time by the City of San Luis Obispo or entity which has the
power to establish, construct., and maintain roads as prescribed herein:
NOW, THEREFORE, said Offeror covenants and promises as follows:
1. That said Offeror is the owner of the following interest described
below:
That portion.of Lot 119 of the San Luis Obispo Suburban Tract, in
the City of San Luis Obispo, County of San Luis Obispo, State of
California, according to map recorded February 7, 1906 in Book 1,
Page 92 of .Record of Surveys.in the office of the County Recorder
of said County, described as follows:
Commencing at the Northeast corner of said-, lot; thence South 89° 38'
West along the. North line of said lot, 70, feet;
Thence South 00 22' East to the northerly line ofthe land described
in the deed to L. G. Bell, recorded June 9, 1945 in Book 383, Page 321 .
of official records;
Thence North 56° 30' East along the northerly line of said land, 83.59
feet to the easterly line of said Lot 119;
Thence. North 00,22' West 165.46 feet along said easterly line to the
Point of Beginning.
Except therefrom that portion of said land described in the deed to
the City of San Luis Obispo, a municipal corporation., recorded
November 30, 1966 in Book 1417, Page 722 of official records.
2. That said Offeror does hereby irrevocably and in perpetuity,
offer to the City of San Luis Obispo, dedication of a public right -of -way
for road purposes and incidental uses within the above- described property
as shown on the Attached.Exhibit A, and described as follows:
A portion of said Lot 1.19 described as follows:
Beginning at the Northeast corner of said property, thence South
890 38' West 70.00 feet + to the westerly boundary of the land
deeded to Owen F. Betts and Christine B. Betts on September 28,
1978; thence South 00 22' East 14.0 feet; thence to the Point of
Beginning.

3. That at such time as the City modifies the present alignment and /or
grade of Orcutt Road in conjunction with a proposed railroad separation, the
Offeror agrees to modify the onsite driveway access., if required by City
design, pursuant to installation of the driveway ramp by City. The driveway
modification shall be in accordance with City "Parking and Driveway"
standards and shall provide for the minimum number of parking spaces per the
current zoning ordinance.
4. That said Offeror agrees that said offer of dedication shall be
irrevocable and that such a .government entity may, at any time in the future
accept said offer of dedication of the public right -of -way..
5. That said Offeror agrees that this irrevocable and perpetual Offer
to Dedicate is and shall be binding on his heirs, legatees and assignees.
IN WITNESS WHEREOF, this Offer to Dedicate is hereby executed by the
said Offeror on the day and year first above written.
