Policy Context The Building Official has authority to permit alternative materials, methods of construction, or modifications to the code on a project-by-project basis when the applicant has demonstrated that, while their design may not be prescribed by the code, it still meets the minimum intent of the code. California Building Code Section 104.11 states the following: “Alternative materials, design and methods of construction and equipment. The provisions of this code are not intended to prevent the installation of any material or to prohibit any design or method of construction not specifically prescribed by this code, provided that any such alternative has been approved. An alternative material, design or method of construction shall be approved where the building official finds that the proposed alternative meets all of the following: 1. The alternative material, design or method of construction is satisfactory and complies with the intent of the provisions of this code, 2. The material, method or work offered is, for the purpose intended, not less than the equivalent of that prescribed in this code as it pertains to the following: 2.1.Quality. 2.2.Strength. 2.3.Effectiveness. 2.4.Fire resistance. 2.5.Durability. 2.6.Safety. Page 5 of 47 Item 5a Where the alternative material, design or method of construction is not approved, the building official shall respond in writing, stating the reasons why the alternative was not approved.” DISCUSSION Building Permit Number BLDG-2052-2022 (1322 Monterey Street) The Building and Safety Division received an application for the use of an alternative method of construction for a project located at 1322 Monterey Street (Attachment A). The project is described as “Converting existing office duplex to residential duplex; & site improvements.” The conversion of this building into a residential duplex requires unit separation that complies with the California Residential Code section R302.3. This section requires a fire-resistance-rated wall assembly that extends from the foundation to the underside of the roof sheathing. Section R302.3 reads as follows: “R302.3 Two-family dwellings. Dwelling units in two-family dwellings shall be separated from each other by wall and floor assemblies having not less than a 1-hour fire-resistance rating where tested in accordance with ASTM E119, UL 263 or Section 703.2.2 of the California Building Code. Such separation shall be provided regardless of whether a lot line exists between the two dwelling units or not. Fire-resistance-rated floor/ceiling and wall assemblies shall extend to and be tight against the exterior wall, and wall assemblies shall extend from the foundation to the underside of the roof sheathing.” The designer proposed an alternative method of construction to the provide the fire- resistance-rating within the crawl space between the dwelling units. The conversion from a B occupancy classification to an A occupancy classification required the installation of a NFPA 13D sprinkler system. NFPA 13D does not require sprinklers to be installed in crawl spaces. The designer provided a report (Attachment B) from a Fire Protection Engineer that demonstrated an equivalent level of protection was provided by extending the sprinkler system into the crawl space. The report also demonstrated that the floor was designed to support the fire-resistance-rated demising wall above, which is required by R302.3.1. This application was reviewed for compliance by the Chief Building Official and the Fire Marshal. Building Permit Number BLDG-1646-2023 (2125 Monterey Street) The Building and Safety Division received an application for a code modification for a project located at 2125 Monterey Street (Attachment C). The project is described as “28 ADDITIONAL HOTEL ROOMS & LOBBY/GYM/SPA/RESTUARANT BLDG; REVISION TO PLAN OF 55 HOTEL ROOM” Page 6 of 47 Item 5a Section 422.2 of the California Plumbing Code (CPC) requires the restrooms in the lobby to provide separate facilities for each sex. The applicant proposed a design which modifies the code to allow gender-neutral multi-user restrooms (Attachment D). The design demonstrated compliance with minimum fixture counts that are required for all genders. The design includes full length walls for each toilet compartment and a shared hand-washing area. There is also an additional family toilet facility. This additional toilet facility was provided to ensure there was no reduction in Access since there would otherwise be two wheelchair accessible stalls when separate facilities are provided. Furthermore, the July 1, 2024 Supplemental code changes provides a new exception to section 422.2 of the CPC. Exception 4, which becomes effective on July 1, reads as follows: “(4) Separate facilities shall not be required where rooms have fixtures designed for use by all genders and the water closets are installed in privacy compartments. Urinals, when installed, shall be located in a privacy compartment or separate private area. Each compartment door shall be lockable from the inside of the compartment, with a door locking device that is readily distinguishable as locked from the outside of the compartment. The approved plans for the project call for the 1-hour fire rated separation wall between the two apartments to extend from the foundation to the underside of the roof sheathing as required by CBC Section 708.4, which states, in part: 708.4 Continuity. Fire partitions shall extend from the top of the foundation or floor/ceiling assembly below and be securely attached to one of the following: 1. The underside of the floor or roof sheathing, deck or slab above. 2. The underside of a floor/ceiling or roof/ceiling assembly having a fire-resistance rating that is not less than the fire-resistance rating of the fire partition. Exceptions: 1. Fire partitions shall not be required to extend into a crawl space below where the floor above the crawl space has a minimum 1-hour fire-resistance rating. Fire rated floor assemblies are required to meet CBC 420.3, specifically the following: 420.3 Horizontal separation. Floor assemblies separating dwelling units in the same buildings, floor assemblies separating sleeping units in the same building and floor assemblies separating dwelling or sleeping units from other occupancies contiguous to them in the same building shall be constructed as horizontal assemblies in accordance with Section 711. Further, CBC 711.2.4.3 Dwelling units and sleeping units requires:. Horizontal assemblies serving as dwelling or sleeping unit separations in accordance with Section 420.3 shall be not less than 1-hour fire-resistance-rated construction. Exception: Horizontal assemblies separating dwelling units and sleeping units shall be not less than 1/2-hour fire-resistance-rated construction in a building of Types IIB, IIIB and VB construction, where the building is equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1.1. Then CBC 711.2.6 Unusable space, requires: In 1-hour fire-resistance-rated floor/ceiling assemblies, the ceiling membrane is not required to be installed over unusable crawl spaces. In 1-hour fire-resistance-rated roof assemblies, the floor membrane is not required to be installed where unusable attic space occurs above. The horizontal assembly is required to meet the requirements for a 1 -hour fire-resistance-rated assembly as the installed fire sprinkler system meets the requirements for a n NFPA 13D Residential system not an NFPA 13 system as detailed in CBC Section 903.3.1.1. Page 13 of 47 1322 MORRO STREET DUPLEX CRAWL SPACE FIRE PROTECTION STUDIO DESIGN GROUP Project No. C-0823-71 September 2023 Collings and Associates LLC Page 4 As a cross reference the California Residential Code (CRC) provides similar direction for the fire resistive constuction of horizontal assembiles separating dwelling units: CRC R302.3 Two-family dwellings. Dwelling units in two-family dwellings shall be separated from each other by wall and floor assemblies having not less than a 1-hour fire-resistance rating where tested in accordance with ASTM E119, UL 263 or Section 703.3 of the California Building Code. Fire-resistance-rated floor/ceiling and wall assemblies shall extend to and be tight against the exterior wall, and wall assemblies shall extend from the foundation to the underside of the roof sheathing. Exceptions: 1. A fire-resistance rating of 1/2 hour shall be permitted in buildings equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13. As noted above, the horizontal assembly is required to meet the requirements for a 1 -hour fire- resistance-rated assembly as the installed fire sprinkler system does not meet all of the requriements of an NFPA 13 system. The approved plans for the project call for the 1-hour fire rated separation wall between the two apartments to extend from the foundation to the underside of the roof sheathing as indicated below: Sheet A3.0 Reference Note #1 Page 14 of 47 1322 MORRO STREET DUPLEX CRAWL SPACE FIRE PROTECTION STUDIO DESIGN GROUP Project No. C-0823-71 September 2023 Collings and Associates LLC Page 5 The existing horizontal assembly doesn’t meet the requirements for a one-hour assembly, therefore the required fire rated partion is required to extend into the crawl space. The existing conditions are not suitable for the installation of a one-hour assembly within the crawl space so this report proposes an alternate method of construction as allowed by CBC 703.3 for calculating fire resistance and an alternate method of protection as allowed by CBC 104.11. Page 15 of 47 1322 MORRO STREET DUPLEX CRAWL SPACE FIRE PROTECTION STUDIO DESIGN GROUP Project No. C-0823-71 September 2023 Collings and Associates LLC Page 6 2 PROPOSED SEPARATION METHOD Because of the difficulty constructing the fire-rated wall in the crawl space below the raised floor we are proposing to terminate the fire rated wall at the floor as follows: CBC 703.2.2.3 Calculations in accordance with CBC 722 • 722.6 Wood Assemblies • 722.6.2 Walls, floors and roofs • 722.6.2.2 Table 722.6.2(1) indicates the time assigned to membranes on the fire exposed side. • 722.6.2.4 provides only for testing for the fire exposure from below. CBC 722.6.2.1 Fire resistant rating of wood frame assembly is equal to the sum of the fire-resistance time assigned to membranes: Table 722.6.2(1) 15/32-inch wood structural panel bonded with exterior glue is assigned a fire- resistance time of 10 minutes. The actual flooring assembly is 1/2” plywood over 3/4” T&G Oak flooring over 1x6 diagonal sheathing over 2x floor joists @ 16” o.c. (This is not the exact wood panel but the wood thickness is 2” total instead of required 15/32”). Table 722.6.2(2) wood floor joists at 16” o.c. is assigned a fire-resistance time of 15 minutes. Table 722.6.2(5) R-19 glass fiber mineral wool batt insulation is assigned a fire-resistance time of 15 minutes. For reference, CBC Table 721.1(3) Item 13 -1.4 provides a time of 1/2 hour for a double wood floor over joists spaced 16” o.c. Footnote “n” eliminates the drywall ceiling over the unusable crawl space. Footnote “m” (a) defines a double wood floor. The existing flooring meets the definition except there is no asbestos paper. However, there is an additional layer of 1/2” plywood instead. (Note: The 2016 CBC is based upon the 2015 IBC. Accordingly, we feel the rel evance of this crawl space description is applicable to this project.) Our proposed fire rated wall and floor assemblies are as indicated in Section ‘A’ and Section ‘B’ below: Page 18 of 47 1322 MORRO STREET DUPLEX CRAWL SPACE FIRE PROTECTION STUDIO DESIGN GROUP Project No. C-0823-71 September 2023 Collings and Associates LLC Page 9 The calculated fire resistance of the existing floor assembly is 35 minutes. Our alternative method of protection is based upon the the installation of fire sprinklers within the crawl space and 1-hour fire-resistive-construction equivalency noted as follows: CBC Section 413.2 Attic, under-floor and concealed spaces. Attic, under-floor and concealed spaces used for storage of combustible materials shall be protected on the storage side as required for 1-hour fire-resistance-rated construction. Openings shall be protected by assemblies that are self-closing and are of noncombustible construction or solid wood core not less than 1 3/4 inch (45 mm) in thickness. Exception: Neither fire-resistance-rated construction nor opening protectives are required in any of the following locations: 1. Areas protected by approved automatic sprinkler systems. 2. Group R-3 and U occupancies. This section does not specify NFPA 13 or CBC 903.1.1.1. Without the specific references for sprinkler criteria, it is therefore, reasonable to assert that the automatic fire sprinkler system can be designed and installed in accordacne with either NFPA 13, 13R, or 13D. The combination of the existing floor calculated fire-resistance of 35-minutes and the equivalent fire-resistance of 1-hour provided by the automatic sprinkler system exceeds the requirement of a one-hour horizontal assembly. Therefore, the required fire partition wall does not need to be extended through the crawl space. Supporting hydraulic calculations and the fire sprinkler technical data sheet are attached to this report. Fire sprinklers are proposed in the crawl space under each of the two apartments to provide equivalent protection of an additional 25 minutes to meet the one-hour fire separation required between apartments. Based upon the existing double wood floor over joists spaced 16-inches on center with 2-inches of flooring on the surface, and the active fire suppression system, we believe the level of fire protection meets or exceeds the perscriptive code requirements of CBC Chapter 7. For fire to burn from one apartment to the other it has to burn through one floor assembly from above and then encounters fire suppression from fire sprinklers and a 35-min. rated floor assembly between the crawl space and the second apartment. The habitable spaces in the apartments are also fire sprinkler protected per NFPA 13R. We appreciate the opportunity to provide this fire protection analysis of the 1322 Morro Street project. They are durable and fast responding. The Model FR-RES is designed for residential occupancies and is perfect for use in homes, hotels and other living quarters. The Model FR-RES is to be used in wet pipe residential sprinkler systems for One- and Two- Family Dwellings and Manufactured Homes per NFPA 13D; wet pipe residential sprinkler systems for Residential Occupancies up to and Including Four Stories in Height per NFPA 13R; or, wet pipe sprinkler systems for the residential portions of any occupancies per NFPA 13. The Model FR-RES has a 4.9 (70.6 LPM/bar1/2) K-factor that meets the required residential flow rates with minimal residual pressure, which allows for smaller pipe sizes and water supply requirements. DESIGN CRITERIA Notes Residential Fire Sprinkler Systems should only be designed and installed by individuals who are completely familiar with automatic sprinkler system design, installation procedures, and techniques. Several criteria may apply to the installation and usage of each sprinkler. Consequently, it is recommended that the sprinkler system designer review and develop a working understanding of the complete list of criteria prior to initiating the design of the sprinkler system. Questions concerning sprinkler installation and usage criteria, which are not covered by the following instructions, should be submitted to your contracted company. Include sketches and technical details, as appropriate. In some instances, the requirements of this document may concern specifications which are more stringent, and which take precedence over those specified in NFPA 13, 13D, 13R or by the authority having jurisdiction. The spray from the sprinkler is distributed radially outward and downward from the sprinkler deflector. Consequently, the sprinklers must be located such that there will be no blind spaces shielded from spray by partitions, room dividers, overhangs or other parts of the dwelling structure. The number of sprinklers within each compartment (as defined by NFPA 13D, 13R, or 13) must be kept as few as possible while observing all guidelines relating to obstructions and spacing. The sprinkler must be secured in place by firmly fastening the sprinkler system piping to the structure. If the sprinkler is not properly secured in position, reaction forces resulting from sprinkler operation could alter its orientation and its water distribution pattern. Obstruction to Water Distribution Locations of sprinklers must follow the obstruction rules of NFPA 13, 13D and 13R for Residential Sprinklers. General Service Conditions The Model FR-RES must only be utilized in WET PIPE sprinkler systems. Chlorine ion and Chloride environment Stress corrosion cracking may be caused by exposure to environments with Chlorine ion and Chloride. Exposure to this environment may result in sprinklers operating under Non-Fire conditions or Not Operating when exposed to an actual fire. 2. Sprinkler system piping with Copper Sprinkler systems should be constructed in compliance with the applicable standards and the requirements for copper piping when copper piping is used in the sprinkler system. (Reference standards NFPA 13, ASTM B813, B828, and CDA (Copper Development Association) – Solder Joint) All residual flux must be removed from the interior and exterior of the copper piping by thoroughly flushing before installation of the Sprinkler Heads. Otherwise, residues of flux may cause corrosion and/or leakage in the sprinkler system. Hydraulic Design Criteria The minimum required sprinkler flow rates for systems designed to NFPA 13D or 13R are given in Table A as a function of temperature rating and the maximum allowable coverage area. The sprinkler flow rate is the minimum required discharge from the most hydraulically demanding sprinkler from each of the total number of “design sprinklers” as specified in NFPA 13D or 13R. For systems designed to NFPA 13, the number of designed sprinklers is to be the four most hydraulically demanding sprinklers. The minimum required discharge from each of the four sprinklers is to be the greater of the following: • The flow rates given in Table A for NFPA 13D and 13R as a function of temperature rating and maximum allowable coverage area. • A minimum discharge of 0.1GPM/sq.ft. Do not use any sprinklers which show deformation or cracking in either the Sprinkler or the Protective Cap. Prior to installation, sprinklers should be maintained in the original cartons and packaging until used to minimize the potential for damage to the sprinklers that could cause improper operation or non-operation. The Protective Cap must remain on the sprinkler during installation. After the installation is completed, the Protective Cap must be removed to place the sprinkler in service. Use a torque of 7 to 14 ft·lbs (9.5 to 19.0 N·m) to achieve a 1/2 inch NPT sprinkler joint. If you exceed the recommended maximum torque, this could result in damage to the sprinkler inlet, which may lead to leakage from the sprinkler. Use only Spanner FR-S or Socket FR-H (or FR-H II) for installation of Model FR-RES sprinklers. Use of any other wrench or socket is prohibited and may cause damage to the sprinkler. Do not over or under tighten the sprinkler due to an inadequate adjustment of the D1 or D3 Recessed Escutcheon. Re-adjust the sprinkler fitting to correct the position. Sprinkler Spacing Criteria The minimum spacing between sprinklers is 8 feet (2.4m). The maximum spacing between sprinklers cannot go beyond the coverage area calculated by using the specific hydraulic factors. (Ref. Table A) Installation Steps Install Model FR-RES sprinklers by the steps and figures shown below. Use only D1 or D3 Recessed Escutcheons with Model FR-RES sprinklers. (D1 Recessed Escutcheons are not listed for use with the 205°F heads. D3 Recessed Escutcheons are required for the 205°F heads.) Use of any other recessed escutcheon is prohibited and may void the warranty and approvals. Model FR-RES sprinklers are only to be installed in the pendent position with the waterway perpendicular to the ceiling. Step 1: Install the Inner Ring of the D1 or D3 Recessed Escutcheon over the sprinkler threads, as applicable. (Ref. Figure 3 and 4) Step 2: Apply pipe-thread sealant to the threads. Begin hand-tightening the sprinkler into the sprinkler fitting in the pendent position. Step 3: Using the Socket FR-H (or FR-H II) or Spanner FR-S, tighten the sprinkler into the sprinkler fitting with a torque of 7 to 14 ft·lbs (9.5 to 19.0 N·m). (Ref. Figure 5) A 1/2″ drive ratchet (not included) is required for use with the Socket FR-H (or FR-H II). Step 4: Remove the Protector by hand. (Ref. Figure 6) Slide on the Outer Ring of the D1 or D3 Recessed Escutcheon over the Sprinkler and push the Outer Ring over the Inner Ring until its flange comes in contact with the ceiling. (Ref. Notes Wet pipe sprinkler systems must be maintained at a minimum temperature of 40°F / 4°C to prevent freezing and bursting of the pipe and/or sprinklers. Automatic sprinklers are not to be tested with a heat source. Operation of the heat responsive element can result. Absence of the Outer Ring from the D1 or D3 Recessed Escutcheon, which is used to cover the clearance hole, can delay sprinkler operation in a fire situation. In preparation for maintenance of the fire protection system, permission to close the main control valve must be obtained from the proper authorities, and all affected parties by this action, and must be informed before the maintenance session can commence. Do NOT enclose any sprinklers within drapes, curtains, or valances. Do NOT hang anything from the sprinklers. Do NOT clean the sprinklers with soap and/or water, detergents, ammonia, cleaning fluids, or other chemicals. Remove dust, lint, cobwebs, cocoons, insects, and larvae by gently brushing with a feather duster or gently vacuuming with a soft bristle (i.e., dusting) brush attachment. Exercise suitable safety precautions in the use and storage of highly flammable materials. The rapid rate of fire development and spread of these materials can reduce the ability of the sprinkler system to aid in the control of a fire involving such hazards. Automatic Sprinklers must be kept in a cool and dry place. Automatic sprinkler must never be physically altered, such as painted, plated, or coated, once shipped from the factory. If the sprinklers have been in any way modified, they must be replaced. Great caution must be applied to prevent damage to the sprinklers at all stages - before, during, and after installation. Damaged units because of dropping, hitting, over-tightening, or wrench slippage, must be replaced. The Model FR-RES must only be replaced with pendent sprinklers which are listed for residential fire protection service and which have the same nominal K-Factor, the same coverage area, and the same or lower flow ratings (as indicated under Table A “Hydraulic Design Criteria”). When remodeling, such as by adding false beams or light fixtures or changing the location of compartment walls, first verify that the new construction will not violate the installation requirements of the applicable standards of NFPA. Alter the new construction and/or the sprinkler system to suit the requirements of this document and the applicable NFPA regulations. The owner is responsible for the maintenance of the sprinkler system, including inspection and testing of its compliance with this document, as well as the standards of the National Fire Protection Association (e.g., NFPA 25), and the regulations of any other authorities having jurisdiction. The owner should direct any questions regarding the above rules and regulations to the installing contractors or the sprinkler manufacturer. Existing law requires the commission to approve and adopt building standards and to codify those standards in the California Building Standards Code. This bill would authorize a city, county, or city and county to require, by ordinance or resolution, that public restrooms constructed within its jurisdiction be designed to serve all genders, as specified, instead of complying with the plumbing standards set forth in the California Building Standards Code. This authority will become inoperative and be repealed on the date that standards that address all gender multiuser facilities take effect in the California Building Standards Code. Section 118507 is added to the Health and Safety Code, to read: 118507. (a) Notwithstanding Chapter 4 (commencing with Section 401.0) of the California Plumbing Code (Part 5 of Title 24 of the California Code of Regulations), a city, county, or city and county may require new or renovated public toilet facilities within its jurisdiction to be designed, constructed, and identified for use by all genders instead of the design standards for separate facilities for men and women found in the applicable provisions in Chapter 4 of the California Plumbing Code. If a city, county, or city and county exercises the authority provided in this subdivision, it shall do so by adopting an ordinance or resolution. (b) (1) Signs in compliance with Title 24 of the California Code of Regulations shall identify the restrooms for use by all genders. (3) In multiuser toilet facilities, lavatories shall be located either in toilet rooms or grouped in an immediately adjacent common use area accessible to all users. (c) This section shall become inoperative on the date that standards that address all-gender, multiuser facilities take effect in the California Building Standards Code (Title 24 of the California Code of Regulations) and as of that date this section is repealed.
