EASEMENT
CITY OF SAN LUIS OBISPO, a public body of the State of California,
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California corporation,
second party, the right from time to time to construct, reconstruct, install, inspect, maintain, replace,
remove, and use facilities of the type hereinafter specified, together with a right of way therefor,
within a strip or parcel of land or along a route as hereinafter set forth, and also ingress thereto and
egress therefrom, over and across the lands situate in the City of San Luis Obispo
County of an Luis Obispo , State of California, described as follows:

The parcel of land situate in the southeast quarter of Section 5,
the northeast quarter of Section 8 and the northwest quarter of
Section 9, all in T.31S., R.14E., M.D.B.&M., described in the
deed from Sinsheimer Bros. to the City of San Luis Obispo dated
June 27, 1955 and recorded in Volume 809 of Official Records at
page 567, San Luis Obispo County Records.
Said facilities shall consist of:
Such poles, aerial wires, cables, electrical conductors with associated
crossarms, braces, transformers, anchors, guy wires and cables, fixtures and
appurtenances, as second party deems necessary located along the route
described as follows:
Commencing at the found 3 inch brass cap stamped LS 2688 accepted
as marking the northeast corner of said Section 8, and running
(a) north 68`14' west 1,994.1 feet
to a point in the existing line of poles erected on said lands
under and by virtue of the recorded deed from the City of San Luis
Obispo to Pacific Gas and Electric Company dated April 20, 1961 and
recorded in Volume 1248 of Official Records at page 323, San Luis
Obispo County Records, being the TRUE POINT OF BEGINNING of said
route; thence
(1) south 58 °45 1/2' east 2,127.9 feet; thence.
(2) south 43 °51' east 531.2 feet; thence
(3) south 62 °35 1/2' east approximately 514 feet
to a point.in said existing line of poles; excepting therefrom
that portion thereof lying outside of said lands.
First party further grants to second party the right to assign to another
public utility as defined in Section 216 of the California Public Utilities
Code the right to install, inspect, maintain, replace, remove and use pole
line facilities along said route (including ingress thereto and egress
therefrom).

Second party shall also have the right from time to time to trim and to cut down and clear away or
otherwise control any and all trees and brush now or hereafter on said strip or on said parcel of
land or along said route, as hereinbefore set forth, and shall have the further right from time to time
to trim and to cut down and clear away any trees on either side of said strip or said parcel of land or
along said route, as hereinbefore set forth, which now or hereafter in the opinion of second party may
be a hazard to the facilities installed hereunder by reason of the danger of falling thereon, provided,
however, that all trees which second party is hereby authorized to cut and remove, if valuable for
timber or wood, shall continue to be the property of first party, but all tops, lops and brush shall be
burned or removed by second party.
First. party shall not erect or construct any'building or other structure or drill or operate any well under
second party's electrical conductors or within s feet of the center line of said in P i i ne
facilities.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective
parties hereto.

Pacific Gas and Electric Company is currently in the process of upgrading
service to our customers in the Arroyo Grande area. In order to do this, we
will have to acquire an easement across your property. The easement's exact
location across your property is shown colored in red on the attached map.
Please review the attached document and, if it meets with your approval, have
the signature page of the copy marked "PG &E Co. Copy" signed by the appropriate
individuals, have all signatures notarized using the attached jurat, and return
the signed document in the envelope provided. The copy marked "Grantors Copy ",
with map attached, is for your files.
If you will supply us with a receipt for any notary fees incurred, we will
be happy to reimburse you. Also, should you have any questions about this
matter, please feel free to contact Ms. Pat Kelly at 544 -3334, extension 436.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING PAC_.IFIC GAS AND ELECTRIC COMPANY
AN EASEMENT TO INSTALL ELEC_.TRIC POWER LINES
ACROSS C_.ITY PROPERTY LOCATED IN LOPEZ CANYON
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That certain easement agreement with addendum hereto
attached marked Exhibit "A" and incorporated herein by reference, between
the City of San Luis Obispo and Pacific Gas and Electric Company is hereby
approved and the Mayor is authori.zed to execute the same.
SECTION 2. The City Clerk shall furnish a copy of this resolut -ion
and a copy of the executed agreement of easement approved by it to:
Pacific Gas and Electric Company and the Recreation and Parks Department
for inclusion in the property management records.

REPORT 1
SUBJECT: Request from P.G. &E. for ease ent�o install electric power lines across
city property located in Lopez nyon.
CAD RECOMMENDATION:
Adopt resolution granting Pacific Gas and Electric Company an easement
to install electric power lines across City property located in Lopez
Canyon.
BACKGROUND:
On or about March 6, 1987, the City received a communication from
P.G. &E. requesting an easement across city owned property in Lopez Canyon for the
purpose of installing electric power lines. The request was forwarded to the lead
department, Recreation & Parks, for investigation as required by City Property
Management Policy.
Investigation found that the proposed P.G. &E. project would consist of
stringing overhead lines to connect two poles which currently exist -on city
property. To accomplish this, a minimum of two additional poles would be necessary
on city property and brush clearing would have to be accomplished along the proposed
easement.
Staff determined that the proposed easement would not adversely impact current
or future city use of this property and recommend the easement be granted.
ALTERNATIVES:
1. Adopt resolution granting P.G. &E. an easement across city land in Lopez
Canyon for installation of electric power lines.
2. Do not adopt resolution granting easement and request that P.G. &E. route
their power lines to avoid crossing city property.
RECOMMENDATION:
Adopt resolution granting P.G. &E. an easement to install electric power lines
across City property located in Lopez Canyon.
FISCAL IMPACT:
None anticipated.
