Romero, Public Works Director SUBJECT: Consideration of.Accepting Street.Right -of -Way Easement and Signing Street Right -of -Way Agreement for Small Parcel to be Acquired at the Corner of Perkins and Rockview Recommendation It is my recommendation that the Mayor accept the deed of easement and sign the street right -of -way agreement on behalf of the City, following .provisions of Resolution 5370 (1984 Series). Background At its August 6, 1991, the City Council authorized staff to proceed with curb, gutter and sidewalk improvements to a number of locations throughout the community. One of these locations called for completion of a sidewalk on the easterly side of Rockview, between Sweeney and Perkins. Mr. Tim Banducci, owner of the property at the corner of Sweeney and Perkins, questioned where the exact alignment of the curb would be and how the improvement would affect a tree on his property. Staff subsequently met with Mr. Banducci in the field and determined that the tree would not be affected. We did find, however, that the existing pavement turning the.corner from Rockview to Perkins, which is an extremely narrow street, encroaches on Mr. Banducci's property and has for a number of years. Staff feels it is quite desirable to allow traffic to continue in substantially the same pattern it has for many years past, and that it should formalize this ongoing encroachment by acquiring a right -of -way to allow for a proper future curb radius at this location. Staff made an offer to Mr. Banducci to assume the costs of the improvements at this corner, in exchange for the deed of easement. Mr. Banducci has signed documents which now must be verified by the City, thus permitting construction to proceed. D 13b1 Banducci Page Two d Fiscal Impact The City will assume costs of installing 11' of curb, gutter and sidewalk and the improvements around the radius return at a total'; cost of approximately $1,500.
