Dear Lauren Carpenter, Pursuant to the City’s Commercial Cannabis Business Operator Application procedures, applicants who are granted a Contingent Operator Permit will move onto subsequent phases and will be provided direction as to where and when to submit the required background check application(s). Each Owner and Principal identified on the application must submit to and pass a criminal history background check prior to being issued a final Commercial Cannabis Business Operator Permit. If the Applicant is not the property owner of record identified in the application, then the property owner of record is also subject to submittal and passing of a background check before a final Operator Permit is issued. Background Check Steps: 1. Owners, principals, and property owners of record shall complete the Cannabis Business Employee/Owner Background Check Application through HdL’s online portal. A link to the portal is provided below: https://hdlcompanies.formstack.com/forms/bc_sanluisobispocity a. The submitter must select the Application Type (New Owner / Principal, Renewal Owner / Principal, New Employee, Renewal Employee) that best fits the reason they are applying for a background check and ID badge. b. An application cannot be submitted for review without completing all the required answers and fields denoted by an asterisk (*). c. New Owners and Principals will be required to upload the following documents: a picture or scan of their Social Security Card, a picture or scan of their State -Issued ID, Driver’s License or Passport, a high-quality photo which will be used for the ID Badge, and a signed ad notarized copy of a Release and Waiver form. Included with this letter is a copy of the Release and Waiver form. 2. Once the applicant has successfully completed the Cannabis Business Employee / Owner Background Check Application, if no disqualifiers and no discrepancies are found, then the ID badge will be processed and sent directly to the operator’s address on file. a. If disqualifiers and / or discrepancies are found, then the City will review the results of the background check and may contact the applicant and operator for additional information before deciding to either approve or deny application. Applicants whose Principal(s), Owner(s), and property owner of record all successfully pass the background check will be issued a Final Operator Permit. If any fail to pass the background check, then the Contingent Operator Permit will be revoked, and the Applicant will be disqualified from receiving an Operator Permit. Please note that being awarded an Operator Permit does not constitute a land use entitlement and does not waive or remove the requirements of applying for and receiving permits for all construction including: electrical, plumbing, fire, Community Development Department permits or reviews, and any other permits, licenses, or reviews as deemed necessary by the relevant departments or governmental entities in charge of said permits. Nor does the award of an Operator Permit guarantee that the plans submitted via the application process meet the standards or requirements for building permit issuance and any other permit requirements from other City departments or agencies.
