A RESOLUTION APPROVING AND PROVIDING FOR THE
EXECUTION OF A FIRST AMENDATORY CONTRACT TO
GRANT TO ACQUIRE AND /OR DEVELOP LAND FOR OPEN -
SPACE PURPOSES NO. CALIF- OSC -334 BY AND BETWEEN
THE CITY OF SAN LUIS OBISPO AND THE UNITED STATES
OF AMERICA.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:.
SECTION 1. The pending proposed 1st Amendatory Contract to Grant to
Acquire and /or Develop Land for Open -Space Purposes No. Calif -OSC -334 is hereby
in all respects approved.
SECTION 2. The Mayor of the City of San Luis Obispo is hereby authorized
and directed to execute Contract No. OSC -334 (G), as amended, in two (2) counterparts
on behalf of the City of San Luis Obispo and the City Clerk is hereby authorized and
directed to impress and attest the official seal of the Public Body on each such
counterpart and to forward such counterparts to the Department of Housing and Urban
Development, for execution on behalf of the Government together with such other
documents relative to the approval and execution of such counterparts as may be
required by the Government.
SECTION 3. This resolution shall take effect immediately.
On motion of Councilman Brown, seconded by Councilman Blake, and on the
following roll call vote:

RESOLUTION NO. 2195 (1971 Series)
A RESOLUTION SUPPORTING ASSEN:BLY BILL 1617.
WHEREAS, Assembly Bill 1617 would authorize cities and counties to levy a 5%
tax on the purchase of alcoholic beverages from any retailer for consumption on the
premises; and
WHEREAS, the only significant opposition to this very important additional source
of revenue for local agencies has come from hotels, restaurants, bartenders and others
who will be collecting the tax rather than those who would be paying the tax.
NOVI, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. The City Council hereby supports the so -called "T'ippler's Tax" and urges
all state legislators to vote in favor of Assembly Bill 1617 which would authorize local
agencies desiring to do so to levy a 57 tax on the purchase of alcoholic beverages from
any retailer for consumption on the premises.
2. The City Council further commends those legislators who have already voted
in favor of this measure.
On motion of Mayor Schwartz, seconded by Councilman Blake, and on the following
roll call vote:
AYES: Councilmen Blake, Brown, Graham and Mayor Schwartz

REPEALING ALL PREVIOUS SALARY RrSOLUTIONS.
BE IT RESOLV ,M by the Council of the City of San Luis Obispo as
follows:
That all previous salary resolutions are hereby repealed and the
following sections enacted to supersede said previous provisions:
Section 1. Salary Ranges. The following salary ranges are adopted
and applied to the several asses of positions indicated in Section 2
hereof.

Section 3. Rules Governing Step Progression.
The following rules shall govern step increases for all employees
hired hereafter and for employees listed under Section 4 below:
1. The first step is the minimum rate and shall normally be the
hiring rate for the class. In cases where it is difficult to secure
qualified personnel, or if a nerson of unusual qualifications is hired,
the City Council may authorize the Administrative Officer to hire at the
second or third step. If a person is hired at the second or third step,
he shall receive the next step when he has comileted trs time requirement
for such advanced step as outlined below and is recommended by the depart-
ment head and Administrative Officer and approved by the Council for
advancement.
2. The second step is an incentive adjustment to encourage an
employee to improve his work. F�mployees may be advanced to the second
step following the completion of six months satisfactory service (three
months for 'Police Officers, beginning level), upon recommendation by their
department head and the Administrative Officer and approval by the City
Council.
3. The third step rerresents the middle value of the salary range
and is the rate at otich a fully qualified, ex!perienced and ordinarily
conscientious employee may expect to be paid after a reasonable period
of satisfactory service. An employee may be advanced to the third step
after completion of six months service (three months for Police Officers,
beginning level) at the second step, provided the advancement is recommended
by the department head and the Administrative Officer and approved by the
City Council.
h. The fourth step is to be awarded only in case of work which is
well above average for tka class. An employee may be advanced to the fourth
step after completion of one year of service at the third step provided
the advancement is recommended by the department head and Administrative
Officer and approved by the City Council.

5. The fifth step is intended as a reward for outstanding performance.
An employee may be advanced to the fifth step after completion of two years
service at the fourth step provided the advancement is recommended by the
department head and Administrative Officer and justified by a letter of
recommendation from the department head and approved by the City Council.
In applying the above rules, the next step shall be granted, other
conditions having been met, on the following basis:
1. For those having an anniversary date on the 15th of the month or
earlier, the increase shall be effective the first of that month.
2. For those having an anniversary date on the 16th of the month or
later, the increase shall be effective the first of the fallowing
month.
Should the employee not be recommended for increase, or should the
Council not approve a recommended increase on the anniversary date, it shall
be the privilege of the department head and Administrative Officer to
reconsider such recommendation for increase at any during the year,
subject to approval by the City Council.
Section 4. The following employees hired on or prior to the effective
date of this resolution shall be governed by the rules above for step
advancement purposes:

Section 6. Pay Differentials.
When assigned to the fbllowing work, city personnel shall be paid the
salary ranges indicated:

Section 7. "Y" Rate. An employee (otter than police department per-
sonnel) who is not perfarming up to the established standards set for
his job may be "Y" rated, so he ax she would not receive any salary increase
given by the City Council as a result of its annual salary review. If and
when the employee's performance comes up to the standard level, he or she would
then have the "Y" rating removed.
The "Y" rating procedure shall not result (then or later) in the employee
being frozen below the next lower step (approx. 5.7 %) of the new range. For
example: An employee in the fifth step as of June 30, 1971 who is "Y"
rated would not be adjusted in sal ary below the 4th step of the new range
which becomes effective July 1, 1971. Nor would the employee's salary be
reduced below the 4th step of succeeding adjusted pay ranges, except for
dismissal or demotion.

After July 1, 1971, the department head shall give 60 days written
notice to any employee he intends to 'IY" rate, giving the employee an
opportunity to correct his deficiencies if possible.
Section 7. Schedule of salaries for full -time personnel not included
in basic salary ranges.

Section 8. Seniority "ay for Full -time Department Heads Listed in

additional one percent for the first ten years of continuous full -time ser-
vice with the city, one percent for the next five ,years, and one percent

(b) The following minimum time requirements are hereby designated for
such steps:
Step A Starting rate.
Step B After 250 hours working time, 6 months employment, or
one summer, whichever is completed first.
Step C After 750 hours working time, 18 months employment, or
two full summers, whichever is completed first.
Section 11. Part -time Park and Grounds Maintenance Laborers.
The range for part -time park and grounds maintenance laborer shall
be the same as that for recreation leader as set forth in Section 10 above.
Time requirements for Step B shall be 500 hours work or 6 months
employment, whichever is completed first.
Time requirements for Step C shall be 1500 hours work or 18 months
employment, whichever is completed first.
Section 12. Recreation Specialist.
(a) The range for recreation specialist shall be as follows:

(b) The following minimum time requirements are hereby imposed for
such steps.

Expenditures may be made for the purchase of replacements for the specified :Pieces
of equipment only, unless otherwise directed by the City Council.
Adjustments may be made at the time of purchase to meet prevailing market conditions.
If the cost of the equipment is less than, the amount accumulated:
(1) The unused moneys may be left in the equipment replacement fund and placed
in the unallocated reserve; or
(2) Such moneys may be transferred to other appropriate funds by Council action.
If the cost of the replacement is greater than the moneys accumulated:
(1) Funds may be transferred from the general Hind unbudgeted reserve to the
appropriate expenditure account; or
(2) moneys accumulated in the unallocated reserve (within the equipment replacement
fund) maybe used; or
(3) A portion of the cost may be paid from other appropriate departmental accounts.

AND NECESSITY REQUIRE CONSTRUCTION OF CERTAIN
1IMPROVENiENTS.
BE IT RESOLVED by the Council of the City of San Luis Obispo that:
1. Pursuant to hearings duly held, the Council of the City of San Luis Obispo
hereby finds and determines that the public convenience and necessity requires the
construction and installation of curbs, gutters, sidewalks and driveway ramp
improvements on those portions of streets within. the City of San Luis Obispo as
set forth on Exhibit "A" attached hereto and incorporated by reference, and determines
that the Special Assessment, Investigation, Limitation and Majority Protest Act of
1931 shall not apply to these proceedings.
2. The Superintendent of Streets shall proceed with the required notification
and construction as set forth in Section 7350.1 of the San Luis Obispo lviunicipal Code.
3. The costs of any such work done by the City, after hearings duly held,
shall become a lien upon said parcels.

A RED ZONE AND ESTABLISHING RED ZONES AND TWO -HOUR

BE IT RESOLVED by the Council .of the City of San Luis Obispo as follows:
1. A red zone is hereby established on the westerly side of Johnson Avenue
commencing at the northerly line of Bishop Street and extending 197 feet northerly and
on the easterly side of Johnson Avenue commencing at the northerly line of Bishop Street
and extending fifty -eight feet northerly.
The loading zone in front of the clinic is hereby rescinded and replaced by a
loading zone located on the westerly side of Johnson Avenue commencing 197 feet
northerly of Bishop Street and extending twenty -two feet northerly.
2. A -red zone is hereby established on the northerly side of Mill Street commencing
at the easterly line of Santa Rosa Street and extending fifty feet easterly.
3. Red zones on the easterly side of Santa Rosa Street between I.:onterey and
Higuera are hereby rescinded and replaced with two -hour parking except that red zones
are retained on the easterly side of Santa Rosa Street commencing at the southerly line of
Monterey Street and extending sixty-nine feet southerly and commencing 116 feet southerly
of the southerly line of Monterey Street and extending fifty-four feet southerly and
commencing 192 feet southerly of the southerly line of Monterey Street and extending
thirty -three feet southerly.
4. Red zones are hereby established on the westerly side of Osos and Santa
Barbara Streets commencing at the northerly line of Leff Street and extending thirty five
feet northerly and commencing at the southerly line of Leff Street and extending forty
feet southerly.
5. A red zone is hereby established on the easterly side of South Higuera Street

A RESOLUTION ENDORSING THE MA SIC PRINCIPLE OF THE
FEDERAL GOVERNMENT SHArMG ]TS TAXES WrrH STATE
AND LOCAL GOVERNMENTS.
WHEREAS, in the division of governmental functions among local, state and
federal bodies in the United States the exercise of powers at various levels is inseparably
related to the distribution of taxing authority; and
WHEREAS, the larger the percentage of total tax revenue at the disposal of any one
level the greater will be the power of that government; and
WHEREAS, today the Federal Government is share of total taxes far exceeds the
total combined share for state and local governments; and
WHEREAS, if present tax trends continue, local governments will not be able to
meet public demands for more and better schools, highways, health facilities, police
protection and other similar services without severe strains upon their respective
economies; and
WHEREAS, the latest Federal budget lists approximately 85 local grant -in -aid
activities and, as a consequence, these programs are beginning to exceed the level of
manageability; and
WHEREAS, the dollar value of grant -in -aid programs has increased from $3.1
billion a decade ago to more than $15 billion in recent years and the continued growth of
such programs makes state and local governments even more dependent upon the Federal
Government; and
WHEREAS, such pro�ams often force the state and local governments to spend
tax money excessively in certain areas in order to match the allocation of Federal funds;
and
WHEREAS, it is vital and essential to strengthen state and local self- government,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo, a Charter City of the State of California, that the City Council of San Luis Obispo
endorses the basic principle of tax sharing in order to make additional revenues available
to state and local governments; and
BE rT FURTHER RESOLVED, that the Congress of the United States is urged to
enact a workable and'realistic tax- sharing program, with consideration given to the
following alternatives; tax rebates, unrestricted block grants, Federal tax credits
against state and local taxes or a transfer of tax sources from the Federal to the state and
local level; and
BE IT FURTHER RESOLVED, that the City is directed to transmit copies of this
resolution to the President and Vice President of the United States, the Speaker of the
House of Representatives of the United States, to each Senator and Representative from
California in the Congress of the United States and to Assemblymen VI. Don i.SacGillivray
and William M. Ketchum.
