Temporary Construction Easement:
A non - exclusive temporary construction easement for the purposes of facilitating
construction within and upon the fee parcel in, on, over, under, along, and across that certain ten
foot wide parcel of land lying immediately adjacent and contiguous to that parcel of land
described in Exhibit "A" and depicted in Exhibit `B ", attached hereto and incorporated herein.
Grantor and City agree to cooperate in facilitating each other's construction on their adjacent
respective properties, to the extent feasible, by maintaining access to and across each other's

property, so long as such access does not unreasonably impair either party's ability to utilize their
properties and to effectuate each of their respective proposed construction projects.
This temporary construction easement and all access rights related thereto shall commence upon
possession and automatically terminate ninety (90) days from the date at which construction of
the parking garage expansion project officially begins, unless otherwise extended upon
agreement by the Grantor.
