HomeMy WebLinkAbout2800-2880RE OEUTION NO. 2899 (1975 Series' RESCINDED A POLICY RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ESTABLISHING THE PROCEDURE FOR THE APPOINTMENT, SUSPENSION OR DISMISSAL OF ALL NON- EMPLOYEE OFFICERS. WHEREAS, the State Legislature has amended California Government Code §54957 to_ prohibit the appointment, suspension or dismissal of non - employee City officers in executive session (S.B. 1, 1975 Legislature). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. This Council hereby establishes the following policy for the appointment, suspension or dismissal of non - employee City officers: Council subcommittees appointed by the Mayor and consisting of less than a quorum of the Council shall review and consider all proposed appointments, suspensions or dismissals of non - employee City officers. Such subcommittees shall recognize the chairperson of the concerned commission, board or committee to be an expert witness available to the subcommittee in its deliberations; provided, however, that such chairperson shall not participate in the decision - making of the subcommittee. The subcommittee shall submit its recommendations to the Council in meetings open to the public, and the Council shall publicly make the final decision concerning all such recommendations. . ATTEST: M Mi I�- I I 1 RESOLUTION NO. 2898 (1975 Series) A RESOLUTION OF THE ODUNCIL OF THE CITY OF SAN LUIS OBISPO FINDING THAT A PUBLIC NUISANCE MAY EXIST UPON PORTIONS OF THE PREMISES GENERALLY DESCRIBED AS TERRACE HILL AND ORDERING A PUBLIC BEARING CONCERNING SAME AND THE ABATEMENT THEREOF. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. This Council hereby finds that certain incomplete graded land conditions and lack of drainage improvements upon portions of the real property generally described as Terrace Hill and more particularly described as the open area bounded by Ella Street, Sierra Way, Bishop Street alignment and Rachel Street may constitute a public nuisance. 2. This Council intends to hold a public hearing on November 3, 1975, at 7:30 P.M., in the Council Chambers of the City Hall, to ascertain whether said imcompletely graded land and drainage deficiencies constitute a public nuisance which should be abated. 3. The facts forming the basis for the aforesaid finding are that said conditions upon said property exist in violation of the terms of City permits issued for the improvement of said property and endanger the public health, safety and welfare. 4. Possible methods of abatement are to provide proper .drainage and grading in accordance with plans approved by the City. A bus loading zone is hereby established on the northerly side of Madonna Road beginning at a point 767 feet easterly of the northerly pro- longation of the easterly property line of Calle Joaquin and thence continuing 55 feet east. 4. Bike lanes are hereby established on the south side of Madonna Road between Calle Joaquin and the State Highway 101 on -ramp and on the north side of Madonna Road from a point 75 feet west of the northerly prolongation of the easterly.property line of Calle Joaquin to the entrance road for the Madonna Inn. 5. The present parking restriction on the north side of Los Osos Valley Road beginning at a point 173 feet west of the northerly prolongation of the westerly property.line of Prefumo Canyon Road and thence continuing 153 feet west is hereby rescinded except as designated in the Vehicle Code. ATTEST: i i � r •� RESOLUTION NO. 2896 (1975 Series) A RESOLUTION•OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO, ACTING AS THE OPERATOR OF WHALE ROCK RESERVOIR, INSTITUTING PROCEEDINGS FOR THE ACQUISITION OF A PONDING AREA BELOW WHALE ROCK RESERVOIR, AND REQUESTING THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPOR- TATION TO ENTER INTO AN AGREEMENT FOR THE PURCHASE OF SAID PROPERTY. WHEREAS, by a Joint Powers Agreement, dated December 12, 1960, the City of San Luis Obispo is the Operator of Whale Rock Reservior with the power, among other things, to construct additions and improvements to said Reservoir; and WHEREAS, the Whale Rock Commission has authorized the City to initiate proceedings to acquire real property for a ponding area site below the.dam for said - Reservoir; and WHEREAS, the City has determined that the State of California Department of Transportation (Business and Transportation Agency) has available qualified personnel to acquire said real property. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. This Council requests the State of.California Department of Transportation to enter into an agreement with the City to act for the City in the acquisition of approximately 8.25 acres of real property below Whale Rock Reservoir for ponding purposes. 2.. The.City Clerk shall forward a copy of this Resolution to the Clerk of the Whale Rock Commission. Resolution. AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT ON BEHALF OF.THE CITY. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. This Council hereby approves the Use Agreement dated October 6, 1975, between the City of San Luis Obispo and the County of San Luis Obispo for data processing services for utility billing. A copy of said agreement shall remain on file in the office of the City Clerk and the Finance Department. 2. RESCINDED WHEREAS, the Joint Powers Agreement between the City and the State of California for the Whale Rock Project designates the "Director of Finance, City of San Luis Obispo" as one of the City's three voting members on the Whale Rock Commission; and WHEREAS, City Clerk Jean Fitzpatrick has held the combined positions of City Clerk- Finance Director, and has continuously represented the City as a voting member on the Whale Rock Commission since the formation thereof; and WHEREAS, the City has now established separate positions of City Clerk and Finance Director and City Clerk Fitzpatrick no longer serves as the City's Director of Finance; and WHEREAS, Mr. Fitzpatrick's services.on the Commission have been of great value to the Commission and to the City, and the City desires that Mr. Fitzpatrick continue to serve the Commission and the City as a voting member on said Commission; and WHEREAS, the Whale Rock Agreement provides that any member may be represented at any meeting of the Commission by a duly authorized representative.
