RESCINDED
A POLICY RESOLUTION OF THE COUNCIL OF THE
CITY OF SAN LUIS OBISPO ESTABLISHING THE
PROCEDURE FOR THE APPOINTMENT, SUSPENSION
OR DISMISSAL OF ALL NON- EMPLOYEE OFFICERS.
WHEREAS, the State Legislature has amended California
Government Code §54957 to_ prohibit the appointment, suspension
or dismissal of non - employee City officers in executive session
(S.B. 1, 1975 Legislature).
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of San Luis Obispo as follows:
1. This Council hereby establishes the following policy
for the appointment, suspension or dismissal of non - employee
City officers:
Council subcommittees appointed by the Mayor
and consisting of less than a quorum of the Council
shall review and consider all proposed appointments,
suspensions or dismissals of non - employee City
officers. Such subcommittees shall recognize the
chairperson of the concerned commission, board or
committee to be an expert witness available to the
subcommittee in its deliberations; provided, however,
that such chairperson shall not participate in the
decision - making of the subcommittee. The subcommittee
shall submit its recommendations to the Council in
meetings open to the public, and the Council shall
publicly make the final decision concerning all such
recommendations. .

A RESOLUTION OF THE ODUNCIL OF THE CITY OF SAN
LUIS OBISPO FINDING THAT A PUBLIC NUISANCE MAY
EXIST UPON PORTIONS OF THE PREMISES GENERALLY
DESCRIBED AS TERRACE HILL AND ORDERING A PUBLIC
BEARING CONCERNING SAME AND THE ABATEMENT
THEREOF.
BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
1. This Council hereby finds that certain incomplete
graded land conditions and lack of drainage improvements upon
portions of the real property generally described as Terrace
Hill and more particularly described as the open area bounded
by Ella Street, Sierra Way, Bishop Street alignment and Rachel
Street may constitute a public nuisance.
2. This Council intends to hold a public hearing on
November 3, 1975, at 7:30 P.M., in the Council Chambers of the
City Hall, to ascertain whether said imcompletely graded land
and drainage deficiencies constitute a public nuisance which
should be abated.
3. The facts forming the basis for the aforesaid finding
are that said conditions upon said property exist in violation
of the terms of City permits issued for the improvement of said
property and endanger the public health, safety and welfare.
4. Possible methods of abatement are to provide proper
.drainage and grading in accordance with plans approved by the
City.

ROAD; RESCINDING A PARKING RESTRICTION ON LOS
OSOS VALLEY ROAD; PROHIBITING PARKING ON LOS
OSOS VALLEY ROAD AND ON CALLE JOAQUIN; PRO-
HIBITING PARKING AND ESTABLISHING TIME LIMITS
FOR PARKING ON PORTIONS OF SIERRA WAY; PRO -
HIBITING PARKING ON RAMONA DRIVE; PROHIBITING
PARKING ON MILL STREET; AND ESTABLISHING
METERED PARKING ON SANTA ROSA STREET.
BE IT RESOLVED by the.Council of the .City of San Luis Obispo as follows:
1. Parking is hereby prohibited on the northerly side of Madonna Road
beginning at a point 75 feet westerly of the northerly prolongation of the,
easterly property line of Calle Joaquin and thence continuing east to the
entrance road for the Madonna Inn.
2. A bus loading zone is hereby established on the northerly side of
Madonna Road beginning at a point 333 feet easterly of the northerly pro-
longation. of the easterly property line .of Calle Joaquin and thence
continuing 60 feet east.
3. A bus loading zone is hereby established on the northerly side of
Madonna Road beginning at a point 767 feet easterly of the northerly pro-
longation of the easterly property line of Calle Joaquin and thence continuing
55 feet east.
4. Bike lanes are hereby established on the south side of Madonna Road
between Calle Joaquin and the State Highway 101 on -ramp and on the north
side of Madonna Road from a point 75 feet west of the northerly prolongation
of the easterly.property line of Calle Joaquin to the entrance road for the
Madonna Inn.
5. The present parking restriction on the north side of Los Osos Valley
Road beginning at a point 173 feet west of the northerly prolongation of
the westerly property.line of Prefumo Canyon Road and thence continuing
153 feet west is hereby rescinded except as designated in the Vehicle Code.

Said parking restriction will automatically be reinstated upon extension
of the improvements on Los Osos Valley Road to the west.
6. Parking is hereby prohibited on the north side of Los Osos Valley
Road beginning at a point 326 feet west of the northerly prolongation of
the westerly property line of Prefumo Canyon Road and.thence continuing
600 feet west.
7. Parking is hereby prohibited on the west side of Calle Joaquin
beginning at a point 182 feet north, of the easterly prolongation of the
northerly property line of Los Osos Valley Road and thence continuing
53 feet north.
8.. Parking is hereby prohibited on the east side of Sierra Way
beginning at the westerly prolongation of the northerly property line of
Bishop Street and thence continuing 99 feet north.
9. A 12- minute parking.restriction is hereby established .on the
easterly side of Sierra Way beginning at a point 99 feet northerly of the.
westerly prolongation of the northerly property-line of Bishop Street and
thence continuing 88 feet north.
10. Parking is hereby prohibited on the east side of Sierra Way
beginning at a point 187 feet northerly of the westerly prolongation of
the northerly property line of Bishop Street and thence continuing 52 feet
north.
11. Parking is hereby prohibited on the north side of Ramona Drive
beginning at the southerly prolongation of the easterly property line of
Elm Court and thence continuing 35 feet east.
12. Parking is hereby prohibited on the southerly side of Mill Street
beginning at a point 215 feet east of the northerly prolongation of the
easterly property line of Santa Rosa Street and thence continuing 65 feet
east.

13. Two -hour parking meters are hereby established on the westerly
side of Santa Rosa Street between Mill Street and Monterey Street, to be
effective 9:00 A.M. to 6:00 P.M., Sundays and holidays excepted.
14. Two 36- minute metered parking spaces are hereby established on
the westerly side of Santa Rosa Street beginning at a point 83 feet
southerly of the easterly.prolongation of the southerly property line of
Mill Street and thence continuing 46 feet south, to be effective 9:00 A.M..
to 6:00 P.M., Sundays and holidays excepted.

A RESOLUTION•OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO, ACTING AS THE OPERATOR OF
WHALE ROCK RESERVOIR, INSTITUTING PROCEEDINGS
FOR THE ACQUISITION OF A PONDING AREA BELOW
WHALE ROCK RESERVOIR, AND REQUESTING THE
STATE OF CALIFORNIA DEPARTMENT OF TRANSPOR-
TATION TO ENTER INTO AN AGREEMENT FOR THE
PURCHASE OF SAID PROPERTY.
WHEREAS, by a Joint Powers Agreement, dated December 12,
1960, the City of San Luis Obispo is the Operator of Whale Rock
Reservior with the power, among other things, to construct
additions and improvements to said Reservoir; and
WHEREAS, the Whale Rock Commission has authorized the City
to initiate proceedings to acquire real property for a ponding
area site below the.dam for said - Reservoir; and
WHEREAS, the City has determined that the State of California
Department of Transportation (Business and Transportation Agency)
has available qualified personnel to acquire said real property.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of San Luis Obispo as follows:
1. This Council requests the State of.California Department
of Transportation to enter into an agreement with the City to
act for the City in the acquisition of approximately 8.25 acres
of real property below Whale Rock Reservoir for ponding purposes.
2.. The.City Clerk shall forward a copy of this Resolution
to the Clerk of the Whale Rock Commission.

2. That the Capital Outlay budget be increased by adding Account
No. 40 -40- 5063 -822 (Fredericks St. Storm Drain) in the amount of $7, 500.00.
3. That the Utility Tax budget be increased by adding Account No.
40 -14- 5763 -805 (Sta. Rosa Park service road) in the amount of $362.50.

A RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO APPROVING A JOINT POWERS
AGREEMENT BETWEEN THE CITY AND THE COUNTY
FOR DATA PROCESSING SERVICES. AND AUTHORIZING
THE MAYOR TO EXECUTE SAID AGREEMENT ON
BEHALF OF.THE CITY.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. This Council hereby approves the Use Agreement dated
October 6, 1975, between the City of San Luis Obispo and the
County of San Luis Obispo for data processing services for
utility billing. A copy of said agreement shall remain on
file in the office of the City Clerk and the Finance Department.
2. The Mayor is authorized to execute said Agreement on
behalf of the City of San Luis Obispo.

A RESOLUTION OF THE COUNCIL OF.THE CITY
OF SAN LUIS OBISPO DETERMINING THAT PUBLIC
CONVENIENCE AND NECESSITY REQUIRE CON-
STRUCTION OF CERTAIN IMPROVEMENTS.
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. Pursuant to hearings duly held, the Council of the
City of San Luis Obispo hereby finds and determines that the
public convenience and necessity require the construction and
installation of curb and gutter improvements on that portion
of California Boulevard as set forth on Exhibit "A" attached
hereto and incorporated by reference, and determines that the
Special Assessment, Investigation, Limitation and.Majorty
Protest Act of 1931 shall not apply to these proceedings.
2. The Superintendent.of Streets shall.proceed with the
required notification and construction as set forth in Section
7350.1(f) of the San Luis Obispo Municipal Code.
3. The costs of any such work done.by the City, after
hearings duly held, shall become a lien upon said parcels.

A RESOLUTION OF THE COUNCIL OF THE CITY
OF SAN LUIS OBISPO ESTABLISHING A
PASSENGER LOADING ZONE ON CHORRO STREET,
PROHIBITING PARKING ON MADONNA ROAD, AND
PROHIBITING PARKING ON PACIFIC STREET_
AND MORRO STREET. "
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. Two parking spaces reserved for passenger loading
are hereby established on the westerly side of Chorro Street
commencing 19 feet southerly of the intersection of the
westerly prolongation of the northerly property line of Boysen
Avenue with the westerly property line of Chorro Street.,
thence continuing 36 feet southerly:
2. Parking is hereby prohibited on both sides. of Madonna
Road between Higuera Street and the intersection with the
entry road to the Madonna Inn.
3. Parking is hereby prohibited on both sides of
Pacific Street between Chorro'Street and Morro Street and on
both sides of Morro Street between Pacific Street and Marsh
Street between the hours of Midnight and 5:00 A.M.
On motion of Councilman Petterson, seconded by.Councilman
Norris, and on the following roll call vote:
AYES: Councilmen Graham., Gurnee, Norris, Petterson
and '.Mayor Schwartz

A RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO APPROVING AN AGREEMENT
PURSUANT TO THE COMPREHENSIVE EMPLOYMENT
AND TRAINING ACT OF 1973 (CETA).
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. This Council hereby approves an Agreement dated
September 2, 1975 pursuant to the Comprehensive Employment
and Training Act of 1973 and the Mayor is hereby authorized
to sign said Agreement on behalf of the City. A copy of
said Agreement shall be maintained on file in the Office
of the City.Clerk.
On motion of Councilman Norris, seconded by Mayor Schwartz,
and on the following roll call vote:
AYES: Councilmen Graham, Gurnee, Norris, Petterson,
and Mayor Schwartz

A RESOLUTION OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO DESIGNATING THE CITY CLERK
AS THE DULY AUTHORIZED REPRESENTATIVE FOR
THE CITY DIRECTOR OF FINANCE ON THE WHALE
ROCK COmmissiON UNTIL FURTHER NOTICE.
RESCINDED
WHEREAS, the Joint Powers Agreement between the City and
the State of California for the Whale Rock Project designates
the "Director of Finance, City of San Luis Obispo" as one of
the City's three voting members on the Whale Rock Commission;
and
WHEREAS, City Clerk Jean Fitzpatrick has held the combined
positions of City Clerk- Finance Director, and has continuously
represented the City as a voting member on the Whale Rock
Commission since the formation thereof; and
WHEREAS, the City has now established separate positions
of City Clerk and Finance Director and City Clerk Fitzpatrick
no longer serves as the City's Director of Finance; and
WHEREAS, Mr. Fitzpatrick's services.on the Commission
have been of great value to the Commission and to the City,
and the City desires that Mr. Fitzpatrick continue to serve
the Commission and the City as a voting member on said
Commission; and
WHEREAS, the Whale Rock Agreement provides that any
member may be represented at any meeting of the Commission
by a duly authorized representative.
"NOW, THEREFORE, BE IT RESOLVED by the Council of.the
City of San Luis Obispo as follows:

1. City Clerk Jean Fitzpatrick is hereby designated as
the duly authorized representative of the City Finance Director
to serve as a voting member upon the Whale Rock Commission.
This designation shall continue in effect until amended or
repealed by further order of the Council. The City Finance
Director recommends, and concurs in, this designation.
2. The City Clerk is directed to send a certified copy
of this Resolution to each of the three State agencies
represented on the Whale Rock Commi "ssion.

OF RESOLUTION NO. 2656 FOR SIX MONTHS (SIERRA
WAY, GEORGE STREET AND IRIS STREET ABANDON-
MENT): '
BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
1. Resolution No. 2656 which was adopted on August 19,
1974, with the requirement that the.conditions therein be
fulfilled within one year is hereby amended by changing the
time for fulfilling said conditions from one year to eighteen
months.
